Rancho Santa Margarita, Calif.  - according to announcement by Assistant Attorney General Leslie R. Caldwell of the Justice Department’s Criminal Division, two former federal agents have been charged with wire fraud, money laundering and related offenses for stealing digital currency during their investigation of the Silk Road, an underground black market that allowed users to conduct illegal transactions over the Internet.  

The charges are contained in a federal criminal complaint issued on March 25, 2015, in the Northern District of California and unsealed today.

Carl M. Force, 46, of Baltimore, was a Special Agent with the Drug Enforcement Administration (DEA), and Shaun W. Bridges, 32, of Laurel, Maryland, was a Special Agent with the U.S. Secret Service (USSS).  Both were assigned to the Baltimore Silk Road Task Force, which investigated illegal activity in the Silk Road marketplace.  Force served as an undercover agent and was tasked with establishing communications with a target of the investigation, Ross Ulbricht, aka “Dread Pirate Roberts.”  Force is charged with wire fraud, theft of government property, money laundering and conflict of interest.  Bridges is charged with wire fraud and money laundering. 
According to the complaint, Force , without authority, developed online personas and engaged in a broad range of illegal activities such as complex Bitcoin transactions to steal from the government and the targets of the investigation.  Specifically, Force allegedly solicited and received digital currency as part of the investigation, but failed to report his receipt of the funds, and instead transferred the currency to his personal account.  
In one such transaction, Force allegedly sold information about the government’s investigation to the target of the investigation.  The complaint also alleges that Force invested in and worked for a digital currency exchange company while still working for the DEA, and that he directed the company to freeze a customer’s account with no legal basis to do so, then transferred the customer’s funds to his personal account.  Further, Force allegedly sent an unauthorized Justice Department subpoena to an online payment service directing that it unfreeze his personal account. 
Bridges allegedly diverted to his personal account over $800,000 in digital currency that he gained control of during the Silk Road investigation.  The complaint alleges that Bridges placed the assets into an account at Mt. Gox, the now-defunct digital currency exchange in Japan.  He then allegedly wired funds into one of his personal investment accounts in the United States mere days before he sought a $2.1 million seizure warrant for Mt. Gox’s accounts.     
Bridges self-surrendered today and will appear before Magistrate Judge Maria-Elena James of the Northern District of California. Force was arrested on Friday, March 27, 2015, in Baltimore and will appear before Magistrate Judge Timothy J. Sullivan of the District of Maryland today.
The case was investigated by the FBI’s San Francisco Division, the IRS-CI’s San Francisco Division, the Department of Justice Office of the Inspector General and the Department of Homeland Security Office of the Inspector General in Washington D.C.  
The case is being prosecuted by Assistant U.S. Attorneys Kathryn Haun and William Frentzen of the Northern District of California and Trial Attorney Richard B. Evans of the Criminal Division’s Public Integrity Section.

Rancho Santa Margarita, CA - Hasan and Jonas Edmonds, two Aurora, Illinois, men were arrested Wednesday night for allegedly conspiring to provide material support to ISIS, according to  Assistant Attorney General for National Security John P. Carlin

Army National Guard Specialist Hasan Edmonds, 22, a U.S. citizen, was arrested without incident at Chicago Midway International Airport by members of the Chicago FBI’s Joint Terrorism Task Force (JTTF) while attempting to fly to Cairo, Egypt.  

Jonas Edmonds, 29, a U.S. citizen, was arrested without incident at his home in Aurora.  Both defendants were charged in a criminal complaint filed yesterday in U.S. District Court of the Northern District of Illinois with one count of conspiring to provide material support and resources to a foreign terrorist organization.  The initial appearances of Hasan Edmonds and Jonas Edmonds are scheduled for today before U.S. Magistrate Judge Sheila Finnegan.

 In late 2014, Hasan Edmonds came to the attention of the FBI.  The investigation subsequently revealed that he and Jonas Edmonds had devised a plan for Hasan Edmonds to travel overseas for the purpose of waging violence on behalf of ISIS.  
Hasan Edmonds, a current member of the Illinois Army National Guard, planned to use his military training to fight on behalf of ISIL.  As part of their plans, Hasan Edmonds booked airline travel to depart yesterday from Chicago and arrive in Cairo today, with layovers in Detroit and Amsterdam.
Both defendants also planned for Jonas Edmonds to carry out an act of terrorism in the United States after Hasan Edmonds departed.  In particular, both defendants met with an FBI undercover employee and presented a plan to carry out an armed attack against a U.S. military facility in northern Illinois, an installation where Hasan Edmonds had been training.  
Jonas Edmonds asked the FBI undercover employee to assist in the attack and explained that they would use Hasan Edmonds’ uniforms and the information he supplied about how to access the installation and target officers for attack.
According to Assistant Attorney General Carlin the defendants .." plotted to attack members of our military within the United States.  Disturbingly, one of the defendants currently wears the same uniform of those they allegedly planned to attack.  I want to thank the many agents, analysts, and prosecutors who are responsible for disrupting the threat posed by these defendants.”
Conspiring to provide material support to a foreign terrorist organization carries a maximum penalty of 15 years in prison and a $250,000 fine.  
The case was investigated by the FBI’s JTTF, which is comprised of special agents of the FBI, officers of the Chicago Police Department and representatives from an additional 20 federal, state and local law enforcement agencies. 
U.S. Customs and Border Protection, U.S. Immigration and Customs Enforcement’s Homeland Security Investigations (ICE-HSI), the Illinois State Police, the Aurora Police Department and the Illinois National Guard also provided significant assistance. 
The government is being represented by Assistant U.S. Attorneys Barry Jonas and John Kness of the Northern District of Illinois, and Trial Attorney Lolita Lukose of the National Security Division’s Counterterrorism Section.

Seeking additional victims of Indo Chinese Islamic Center pastor Ahmad Henry Osman charged with molestation

Rancho Santa Margarita, CA  - The Orange County District Attorney's Office (OCDA) and Santa Ana Police Department (SAPD) are seeking the public's help in identifying potential additional victims of a former church pastor charged with molesting two girls under the age of 14. 

According to the OCDA, Ahmad Henry Osman, 52, Tustin, is charged with two felony counts of performing lewd acts upon a child under the age of 14 with a sentencing enhancement allegation for multiple victims. I He is being held on $1 million bail and is scheduled for a pre-trial hearing tomorrow, March 27.

Osman is accused of violating his position of trust as a pastor at The Indo Chinese Islamic Center (IIC) in Santa Ana. Osman is accused of teaching bible classes at IIC and befriending the victims and their family members.

On or about Feb. 25, 2015, Osman is accused of entering a home where both victims were staying, under the guise of performing a daily prayer. He is accused of luring 9-year-old Jane Doe 1 into the room in which he was praying and performing lewd acts upon her.
On the same day, but at a later time, the defendant is accused of performing lewd acts upon 6-year-old Jane Doe 2.

Jane Doe 1 reported the crime to a family member and SAPD, who investigated this case and arrested Osman the next day on Feb. 26, 2015.

Vehicle Belonging to Erica Alonso, Laguna Hills Missing Person Located

Rancho Santa Margarita, Calif. –  On Wednesday, March 25, 2015 at approximately 2:00 p.m., Orange County Sheriff’s deputies located a white 2014 Honda Civic EX, California license plate #7FSS563 in the area of Cedarbrook and Redwood, Aliso Viejo in the Glenwood Park neighborhood, according to OCSD spokesperson Jeff Hallock 

The vehicle belongs to Erica Alonso, 27, Laguna Hills, a reported missing person since Sunday, February 15, 2015. 

Alonso was reported missing by her family after she was last seen leaving her boyfriend’s house in the city of Irvine.  Orange County Sheriff’s Department investigators have been actively pursuing leads and information since the report of Alonso’s disappearance.

Investigators responded to the area where the vehicle was located in an attempt to collect any additional information or evidence.  The vehicle has been towed and investigators have begun processing it for evidence.

The Orange County chapter of Mothers Against Drunk Driving (MADD) honors 14 OC deputy district attorneys

Rancho Santa Margarita, CA - The Orange County chapter of Mothers Against Drunk Driving (MADD) honored 14 Orange County deputy district attorneys today for their time and effort in prosecuting driving under the influence (DUI) cases in 2014 at a luncheon  held at the Richard Nixon Library and Birthplace in Yorba Linda.

Six Orange County District Attorney (OCDA) prosecutors including Senior Deputy District Attorney Jennifer Walker and Deputy District Attorneys Jim Bilek, Devin Campbell, Stephen Cornwell, Anna McIntire, Devin Campbell, and Nick Miller, received the 2015 Diligent Prosecutor Award to recognize their support to victims and their families and diligent efforts in criminal prosecution of DUI defendants. 


Each was nominated by their OCDA supervisor or a MADD victim advocate. The recipients were verbally recognized and received a plaque at the luncheon.
Additionally, the eight members of the DUI-Drug (DUID) vertical prosecution team were recognized for their collective efforts to prosecute drug impaired, and combination (alcohol and drug) impaired drivers. The DUID team members recognized for their efforts were Hoon Chang, Anna Chinowth, Shiba Etemandian, Ed Grubaugh, James Hong, Jake Jondle, Sherin Larijani, Nick Miller, and Erika Pennington.


The 14 honored deputy district attorneys prosecuted defendants who faced charges ranging from misdemeanor driving under the influence to felony murder. The efforts of the prosecution resulted in the defendants' convictions with sentences as high as 30 years to life in state prison.
The Orange County Chapter of MADD was formed in 1981 and offers services and education to the local community, including youth programs, victim services, and special events. MADD works closely with Orange County law enforcement agencies to support the prosecution and apprehension of those who put the public at risk by driving under the influence of alcohol.

Rancho Santa Margarita, CA Jose Carillo, a Department of Motor Vehicles (DMV) employee was arrested and charged today for accepting bribes from customers in exchange for providing California driver's licenses, according to the Orange County District Attorney's office ( OCDA) 
 Jose Alberto Carrillo, 47, Fresno, is charged with two felony counts of altering public documents and two felony counts of computer access and fraud. He was arrested today in Fresno and is out of custody on $20,000 bailH
At the time of the crimes, Carrillo worked as a Motor Vehicle Representative at the Westminster DMV Office.
On May 10, 2012, Carrillo is accused of offering to alter a customer's DMV record to reflect that the customer had passed a written driving test, that he had previously failed, in exchange for $100. Carrillo is accused of instructing the customer to go to the men's bathroom to hide the money in between papers to avoid video surveillance. When the customer returned from the bathroom, the defendant is accused of accepting the money that was hidden between the papers. Carrillo is accused of unlawfully accessing the man's DMV record on the computer and falsely inputting that the customer had passed the written tests.
An interim License was issued to this customer. Without the record being altered to indicate that the customer passed the written tests, the CDL process could not have continued and the interim CDL could not have been issued.
On June 4, 2012, Carrillo is accused of illegally accessing another customer's DMV record after business hours and entering false information that the customer had provided a U.S. birth certificate as proof of presence in exchange for $500.
This customer was issued a CDL. Without proof of legal presence, the CDL process could not have continued and the CDL could not have been issued.
The DMV became aware of the issue when one of the customers who had paid Carrillo came into the DMV complaining that he had not received his permanent CDL as promised. The DMV Investigations Division investigated this case.
Senior Deputy District Attorney Brock Zimmon of the Special Prosecutions Unit is prosecuting this case.

Recognizing FOIA professionals at DOJ Sunshine Week, is like Geico using Pinocchio as motivational speaker.

Rancho Santa Margarita, CA - This past Monday, individuals from around the government and members of the public gathered in the Great Hall of the Robert F. Kennedy Building to celebrate the start of Sunshine Week 2015. The annual event, held in commemoration of the sixth anniversary of the issuance of Attorney General Holder’s FOIA Guidelines, to recognize and celebrate the accomplishments of agency FOIA professionals.
Ironically, according to a new analysis of the administration’s FOIA data by the Associated Press, the Obama administration continued its less than stellar transparency record in 2014, breaking the previous year’s record for denying and censoring requests under the Freedom of Information Act.  Additionally, A Tuesday report from the Center for Effective Government, an open government advocacy group, analyzed 15 major agencies and found that most received unsatisfactory marks when it comes to processing requests, maintaining its disclosure rules, and updating its FOIA websites.
Then there is the current State Department scandal, over former Secretary of State Hillary Clinton’s exclusive use of a private email account.  The state department  Iprocessed 23 percent of all requests and took, on average, 540 days to fill simple FOIA requests when the law dictates that it should take 20 days.
During Sunshine Week, Acting Associate Attorney General and Department of Justice Chief FOIA Officer Stuart Delery served as the keynote speaker and highlighted a number of FOIA initiatives undertaken at the Justice Department over the last year, including:
  • The FOIA Improvement Initiative a comprehensive review of FOIA operations at the Department’s thirty-seven components designed to share best practices and identify areas for improvement,
  • FOIA Training Modernization – OIP’s recently released suite of electronic FOIA training resources, designed for members of the federal workforce at every level, and
  • Best Practices Workshop Series – the ongoing series aimed at gathering together FOIA professionals from around the government, as well as civil society, to share experiences, lessons learned, and strategies for success on a variety of topics.

Based on aforementioned reports, the new initiatives sound hollow and just a waste of taxpayer money.
Agencies and members of the public were asked to submit nominations for six award categories. The following awards were presented by Acting Associate Attorney General Delery and Director Pustay:
  • Exceptional Service by a FOIA Professional: Martha Wagner Murphy (National Archives and Records Administration), Cynthia Floyd-Coleman (Environmental Protection Agency), and Manizheh Boehm (Federal Highway Administration)
  • Award for Exceptional FOIA Service by a Team of Agency Professionals: The Federal Highway Administration Headquarters Chief Counsel FOIA Team, the Department  of Agriculture FOIA Training Subcommittee, and the Office of Personnel Management FOIA Service Center team.
  • Lifetime Service Award: Debbie Verzi (Social Security Administration), and Brenda Dolan (Department of Commerce)
  • Excellence in Management: James Holzer (Department of Homeland Security), Michael Marquis (Department of Health and Human Services), and Kathy Ray (Department of Transportation)
  • Outstanding Contributions by a New Employee: Arnon Dayak (Food and Drug Administration), and Alexis Graves (Department of Agriculture)
  • Outstanding Customer Service: Roberta Parsons (Department of Commerce), Harriette Boyd (Department of Commerce), and Judith Lewis (Environmental Protection Agency)

Once again, based on results, the awards are tarnished, at best.


Big Band Swing Dance Fundraiser for Student Scholarships at Saddleback College

Rancho Santa Margarita, CA – The Angels for the Arts at Saddleback College will hold its annual  scholarship fundraiser, The Big Band Swing Thing, Saturday, April 11th at 7:00 p.m at the Norman P. Murray Center, 24932 Veterans Way, Mission Viejo. 

Featured will be Joey Sellers and Saddleback’s own Big Band along with talented vocalists who will croon classics of the day. In addition, there will be two entertaining dance performances by the Saddleback College dance students. The pieces, choreographed by Dance Department faculty Marji Himes and Lacey Yell, are Jumpin’ at the Woodside, and Takin’ the A Train

The festivities will also include beer, wine, appetizers, taxi dancers, a silent auction, opportunity drawings, and other surprises of the era. Also don’t forget to wear your 40’s style attire.

The price $25 per person or 2 for $40. The event sold out last year so get your ticket early. If you don’t have a dance partner, taxi dancers will be available for a small fee. Proceeds benefit scholarships for Saddleback students in the Arts.

Forget Furgeson PD, DOJ Slams the San Diego Police Department

Rancho Santa Margarita, CA - The San Diego Police Department volunteered to undergo a review by the U.S. Department of Justice’s Office of Community Oriented Policing Services (COPS)  following a series of misconduct incidents over the course of five years.  Today, the DOJ announced the completion of  an assessment of the San Diego Police Department’s policies and practices for preventing, detecting and investigating misconduct, including 20 specific requirements.
The report focuses on 17 cases of misconduct over five years and includes a review of how the cases were handled, and of the department’s policies and accountability system.  
The report identifies a number of deficiencies in recruiting practices, supervision and training of officers, accountability systems, and mechanisms for reviewing citizen complaints and leadership.  The assessment recommends a comprehensive approach to all aspects of policing that can help prevent misconduct.  This includes the training and supervision of officers, the recruitment and selection of new officers, accountability mechanisms, internal investigations and disciplinary practices.

Lharimi Lamsen arrested on suspicion of Wells Fargo Bank

Rancho Santa Margarita, Calif. -  On Monday, March 16, 2015, Orange County Sheriff’s deputies arrested Lharimi Lamsen, 30, Stanton, on suspicion of bank robbery.  Lamsen was arrested as he fled the area of the Wells Fargo Bank where he is suspected of having just committed an armed robbery.  

According to Orange County District Attorney spokesperson, Lt. Jeff Hallock, at approximately 2:02 p.m., deputies responded to the Well Fargo Bank in the 27800 block of Vista Del Lago.  As deputies arrived, Lamsen was seen running on the street adjacent to the bank.  Following a short foot pursuit by deputies, Lamsen was detained and taken into custody. Lamsen is suspected of having entered the bank and brandishing a handgun, ordering employees and customers to the ground.  Lamsen fled the bank with an undisclosed amount of cash which was later recovered from the scene.  

Based on evidence and information collected during the investigation, Lamsen is believed to be responsible for a March 6th bank robbery at the Wells Fargo Bank in the 26000 block of Town Centre, Lake Forest.

Lamsen was arrested for bank robbery and booked into the Santa Ana Police Department Jail as investigators intend to pursue federal charges again Lamsen.

The investigations were conducted by the Orange County Bank Robbery Apprehension Team (BRAT), a Federal Bureau of Investigations (FBI) task force participated in by the Orange County Sheriff’s Department.

Rouzbeh Javaherian, Los Angeles pharmacist pleads guilty to Medicare fraud scheme.

Rancho Santa Margarita, CA -  Rouzbeh Javaherian, who owned and operated a pharmacy in Los Angeles pleaded guilty today in connection with a Medicare fraud scheme, according to announcement by Assistant Attorney General Leslie R. Caldwell of the Justice Department’s Criminal Division.
 Javaherian, 34, of Beverly Grove, California, pleaded guilty to health care fraud in connection with a scheme to defraud the Medicare Part D program through a pharmacy called Emoonah Inc., doing business as Westaid Pharmacy and Medical Supply (Westaid).  
According to admissions in the plea agreement, Javaherian was a licensed pharmacist and owner of Westaid, which was located in Los Angeles.  From January 2008 to November 2014, Javaherian devised and executed a scheme to defraud the Medicare Part D program by paying illegal cash kickbacks to Medicare beneficiaries to induce them to submit their prescriptions to Westaid.  Javaherian then filled some of those prescriptions, but also submitted false and fraudulent claims to Medicare Part D plan sponsors for prescriptions that he did not actually fill.
From January 2008 to November 2014, Javaherian received approximately $644,060 in overpayments from Medicare as the result of the fraud scheme.
Sentencing is scheduled for June 1, 2015, before U.S. District Judge Stephen V. Wilson of the Central District of California. 
The case was investigated by the FBI, and was brought as part of the Medicare Fraud Strike Force

HOA does the impossible - dissolves itself

Perhaps other associations can use the DBPOA process to get rid of misguided directors.  This is a major undertaking, as it requires a big time investment:  1. challenge non-sensical moves such as the CZ Master Association's Public Safety Creeping Elegance,  and 2. Become well-versed in 
Corporation Code, Civil Codes and governing documents.

The major obstacle for those wishing to dissolve an association is to replace their current board with like-minded individuals, something DBPOA was able to do.  Once the power-grabbing directors were out, the new board voted to dissolve and hired an attorney  to file the dissolution documentation with the California Secretary of State and the California Attorney General’s Office. 

For associations, such as the CZ Master association, still using the arcane cumulative voting process in lieu of direct elections getting rid of current directors is next to impossible - the current board has been in power for more than a decade.  The only viable option in that case is litigation.
