Democratic presidential hopefuls made history last night as they debated gay voter issues, the first time that an ensemble of major-party candidates for president appeared together specifically to address a gay and lesbian audience in a national telecast carried live on the gay-oriented cable network Logo, owned by Viacom Inc
The three leading Democrats in the race -- New York Sen. Clinton, Illinois Sen. Obama and former North Carolina Sen. Edwards -- struggled to explain why they oppose same-sex marriage but support civil unions that confer all the same legal rights that married couples enjoy.
The two candidates backing full marriage for same-sex couples were Ohio Rep. Dennis Kucinich and former Alaska Sen. Mike Gravel. “There is greater power than the power of human law”, uttered Kusinich at one point in the debate.
In his book, Values in a time of upheaval, Joseph Cardinal Ratzinger proposes a balance of faith and reason that avoids the extremes of fundamental theocracies and secular, relativist states. As he takes a discerning view of the history of Europe, he asks the question: Where do we stand now? He then goes to mention what he characterizes as three essential elements that must be included in the European constitution “if it is to do justice to the task of providing the moral foundations for the common European structures that are now taking shape”.
Ratinzger then goes on to detail these three imperatives as “the absoluteness that must be affirmed with regard to human dignity and human rights. This is antecedent to every law promulgated by the state”. The second is marriage and the family: “Monogamous marriage, as the basic structure for the relationship between a man and a woman and as the cell for the construction of civic society, has been formed by biblical faith….This is not a question of discrimination. Rather, we must ask what is a man and what is a woman, and how we may correctly shape the relationship between them. If this relationship becomes detached from legal forms, while at the same time homosexual partnership are increasingly viewed as equal in rank to marriage, we are on the dissolution of our concept of man and the consequences are grave”. The third element is religion.: “ I limit myself therefore to one point that is fundamental in all cultures, namely reverence for that which is holy to other persons and reverence for the Holy One, God. One can certainly demand this even of those who are not themselves willing to believe in God. Where this reverence is shattered, something essential in a society perishes It would seem that the fundamental question in the gay and lesbian debate is not whether a person is gay by choice or genetics, whether it is a civil rights issue or a lifestyle decision. The question is whether you believe as Rep. Dennis Kucinich does that there is no higher law than human law, or whether you believe as G. Hirsch (Ein Bekenntnis zu den Grundwerten, October 12, 2000) asserts, that there are rights that “exist in virtue of their own law, and the legislator is obliged a priority to respect them. They are higher values that the legislator must obey in his work” – The question is who takes precedence in Logo Vs. Logos?
