FISA Fizzled, Osama, Obama Delighted

On February 17, 2008, the US intelligence community lost critical tools that allowed them to monitor terrorist communications because the House Leadership chose not to extend authorization for the Terrorist Surveillance Program (TSP). The focus of the program is to provide the intelligence community with the tools it needs to protect the United States and its citizens, while also protecting the civil liberties of those impacted by such collection.

FISA was originally passed in 1978 (50 U.S.C. §§ 1801) and the Protect America Act (P.L. 110-55) became law on August 5, 2007, which addressed the changes in technology that have taken place over the past 30 years. The Majority Party has refused repeatedly to consider the Senate’s bipartisan bill in the House, which would update and extend the authorization of the Foreign Intelligence Surveillance Act (FISA). The Senate passed the revised FISA bill on February 12, 2008, by a 68-29 vote.

The Director of National Intelligence, Mike McConnell wrote in an opinion editorial in the Washington Post:

“Expiration would lead to the loss of important tools our workforce relies on to discover the locations, intentions and capabilities of terrorists and other foreign intelligence targets abroad. Some critical operations, including our ability to adjust to dynamic terrorist threats that exploit new methods of communication, which sometimes requires assistance from private parties, would probably become impossible. And the difficulties we face in obtaining this essential help from private parties would worsen significantly if the act expires or is merely extended without addressing this issue. Without long-term legislation that includes liability protection, we will be delayed in gathering -- or may simply miss -- intelligence needed to protect the nation. Is there any doubt that Obamaists are aware that our intelligence capabilities are limited during this time and are more than eager to take advantage of this lapse?

Congressman Ken Calvert and others, in an effort to move this issue forward to the floor, have signed onto H.R. 5440, known as the FISA Amendments Act. H.R. 5440 is the same language as the bi-partisan Senate passed bill.

Consider if immunity is necessary to protect the telecommunications companies that cooperated with the government’s request for surveillance assistance in order to ensure the companies are able to cooperate in the future. The Supreme Court recently rejected a challenge to the National Security Agency’s warrantless surveillance program in the case of Civil Liberties Union v. National Security Agency. A three-judge panel of the U.S. Court of Appeals for the 6th Circuit ruled 2-1 in July that the plaintiffs, led by the ACLU, lacked standing to bring the case.

Consider that if the cooperation of such providers is critical to the government's capacity to pursue electronic surveillance to gather foreign intelligence information, and is also essential for collection of communications records for pattern analysis. If the telecommunication providers who responded to the government's requests or demands for assistance did so in good faith, upon assertions by the government that the demand was lawful and that a court order was not required, would you then conclude the providers should be given relief regarding pending law suits?

Many people are rightly concerned about the privacy issues and the ability of the government to monitor U.S. citizen conversations – this issues is about having the right tools to track terrorists overseas who may be seeking to harm the US

Michael Amzie Holley’s Roofing Slippery Slope and arraignment

Michael Amzie Holley’s, a roofing contractor and business owner will be arraigned tomorrow on charges of failing to provide Workers' Compensation Insurance for an employee who fell from a roof and failing to pay the insurance company more than $700,000 in premiums.
Holley is charged with two counts of perjury by declaration, two counts of recording false and forged instruments, one count of misrepresenting facts to the State Compensation Insurance Fund (SCIF), seven counts of making a fraudulent statement, one count of presenting a fraudulent material statement to obtain compensation, one count of making a false statement to discourage an injured worker from claiming benefits, one count of willfully failing to pay taxes, and one count of failing to file a return with the intent to evade taxes.

Holley also faces sentencing enhancements for aggravated white collar crime over $500,000 and property damage over $150,000. If convicted, he faces a maximum sentence of 19 years and four months in prison. Holley is being held on $2 million bail and is scheduled to be arraigned tomorrow Wednesday, February 27, 2008 at 9:00 a.m. in Department C-55, Central Justice Center, Santa Ana.

Holley is accused of purchasing a minimum workers' compensation policy from SCIF and failing to state that he employed subcontractors, paid workers in cash, hired unlicensed employees, and leased employees from other companies. Holley is accused of paying his employees approximately $815,000 in cash to hide the fact that So Cal Roofing had workers.

Holley is accused of receiving the insurance based on his false declaration, and entering into a contract requiring SCIF to cover all workers employed by Holley, even those employees unknown to the insurance company. Holley is accused of submitting inaccurate payroll reports to SCIF, resulting in a $703,000 underpayment of insurance premiums. To hide the fraud, Holley is accused of failing to file a tax return to avoid paying $188,000 in taxes to the State.

White supremacist convicted of hate crime at Irvine Spectrum

Ryan Lawrence Monfils, 20, a self-proclaimed white supremacist was convicted today of a hate crime for the unprovoked attack of an African-American security guard outside of Dave & Buster's at the Irvine Spectrum. Stanton, pleaded guilty to one felony count of a hate crime battery. He was sentenced to six months in jail, three years of formal probation, and is banned from the Irvine Spectrum.

At approximately 5:30 p.m. on February 2, 2008, Monfils was leaving Dave & Buster's at the Irvine Spectrum with two friends. As he left, the defendant saw the victim, an African-American security guard, standing outside in uniform. Monfils began yelling racial slurs at the victim, threw a lit cigarette in his face, and attacked him by punching the victim repeatedly. Two Irvine Police Department officers on foot patrol arrived at the scene, and Monfils made racial slurs to one of the two police officers, who is African-American.

An Argument Against Democracy – The 2008 US Oprahfied Presidential Elections

According to the Canada Business Center (2003) research suggests that “as much as 93% of a person’s total perception is the result of images conveyed to the brain in one way or another”

It has been said that most of us think we think, but in reality, there are very few people who actually do so. Reasons given are time constraints and the fact that in general our responsibilities increase at an average of 10%/year and lacking a stimulating environment.

Myrna Blyth, long-time editor of Ladies Home Journal and founding editor of More, is author of Spin Sisters: Katie Couric, Oprah, Barbara Walters and others. She charges that these spin sisters are selling misery, feelings of inadequacy and a liberal agenda to women in America. The end result is that a large population cannot think on their own and blindly follow the spin sister's advice.

Consider that in the 2008 Oprahfied Elections, it is plausible that Oprah’s candidate can become the president of the United States - For all we know, Barack Obama could make the best president of the United States ever – we just have not seen any evidence to date, there is any content in his character.

Blyth’s assertions are self-evident in this presidential election – a good number of people in the US cannot think independently and blindly follow recommendations of people such as the spins sister. If this is how democracy works in the 21st Century, perhaps democracy is not your grandpa’s democracy.

We have offered the seven identified OC Sheriff candidates; Jack Anderson, Bill Hunt, Craig Hunter, Kevin Keyes, Ralph Martin, Ken Maddox and Paul Walters, the CotoBuzz Journal as a platform to communicate with their respective potential supports. We have also posed to them a number of questions – we shall be publishing their responses in the order we receive them.

Following is a virtual chat with candidate Kevin Keyes


CBJ: Do you agree that the OCSD needs a corporate culture extreme makeover?

K. Keyes: Yes, while there are many good people, the good must weed out the bad and we would implement an accountability program. Mediocrity is not acceptable, accountability is.
CBJ: What are your top ten priorities for the OCSD if selected?

K. Keyes: Well, there is actually another election soon after the appointment so I will give you an initial list and see how we do.

The first and most important is to restore honor to the office that was taken by its last office holder.

Second is to restore the trust of the taxpayers.

My executive team would immediately begin a financial accounting audit. All vendor contracts, contractors, suppliers would be required to re-bid all jobs and services supplied to the department. All monies will be noted on where the funds come from and where it all goes made available to the taxpayers. The new round of competition should provide for significant cost savings. This would include retirement and benefit packages. All costs itemized and all expensed noted. No more “MISC” columns.

I would change the CCW policy to a “shall” issue approach. The 2nd amendment gives Americans that right, not the sheriff’s office. There are many laws for who can and cannot carry a weapon but the interest must be to assist those asking not make it more difficult or reserve ccw’s for only those politically connected.

Work with union to change union work rules on sheriff rotations on jail service and work with jail division to reduce costs.

Begin complete implementation of existing computer networks so officers in the field have access to data.

Review sheriff threat and review need for protection unit. A review of all staffing requirements in tandem.

Meeting with federal counterparts and implement screening for illegal aliens in custody and arrange for turnover to feds for deportation.

Meet with all department leaders, develop a five-year plan on all equipment replacements for future budgeting, cost analysis, cost reductions.

Then, I’ll have to get re-elected.

CBJ: What/who is your biggest obstacle to getting the post?

K. Keyes: While I have been in the professional business community for 27 years, I am not a public figure. I am also not a career sheriff. I am a citizen of our community that believes I can do the job and am interested in fixing the problems.

CBJ : What do you see as the main problems with the Orange County Board of Supervisors

K. Keyes: I have not met with them yet to determine their course of action so I cannot determine that yet.

CBJ : What do you see as the main problems with the Orange County DA?

K. Keyes: Their lawyers.

Seriously, I read your website and saw you use satire so I thought I’d throw it in.

I would like to have a new attorney for the office and they would meet with the DA, review all existing known problems and a plan to correct within 30 days.

The sheriff’s department is huge, it will be difficult to implement major changes but the longest journey starts with the first steps. I believe by example I can earn the trust and respect of the officers and restore the pride of being an OCSD member a badge they can wear with pride.

CBJ: Do you agree that the OCSD needs a corporate culture extreme makeover?

C. Hunter: I believe there are many honest and hard working managers and leaders at all levels of the Sheriff's Dept. What they need is a new leader with a proven track record in law enforcement who will be a strong role model, lead by example with integrity and provide a new vision of teamwork and accountability.

CBJ: What are your top ten priorities for the OCSD if selected?

C. Hunter: I have one goal and that is to lead a Sheriff's Department that is better prepared to protect and serve the people of Orange County, now and for many years to come. Within that goal, there will be numerous strategies and initiatives that as a team, we will develop and implement.

CBJ: What/who is your biggest obstacle to getting the post?

C. Hunter: The bottom line, I believe, is convincing at least three board members that I am the best candidate for the following reasons:

I am first and foremost a law enforcement leader- it is what I know and where I excel. I am not a politician , but I have conservative values and I would be re-elected as Sheriff.

I am interested in this appointment because it is the next logical step in a goal-oriented career path. Not simply to be Sheriff, but to advance the role, strategies and culture of the policing profession.

Lastly, that my experience leading all daily police operations in Anaheim, the states 10th largest city, will serve the Sheriff's Dept well. The Sheriff's job is about developing effective policies and future leaders, something I have done in Anaheim.


CBJ: What do you see as the main problems with the Orange County Board of Supervisors

C. Hunter : The Board of Supervisors needs a Sheriff who is willing to work together not only with the Board, but with other OC Dept heads and OC leaders in general. They need a Sheriff who sees the position as part of a bigger team and not an island.

CBJ: What do you see asthe main problems with the Orange County DA?

C. Hunter : The Sheriff and the DA are the leaders in OC law enforcement. They must work together and that has been missing. I believe Mr. Rackauckas needs and deserves a teammate and that is something that I would bring to the Sheriff's Department.

The official search to find a replacement for former OC Sheriff Michael Carona is in its infancy and there are already at least seven declared contenders, including interim Sheriff Jack Anderson and Sheriff Carona’s nemesis Bill Hunt.

Corruption, ethical management, transparency, civilian oversight and relations with the Orange County Board of Supervisors seem to top the agenda, over public safety and terrorism – a good measuring stick for public servants in Orange County.

Sharia Law, Activist Judges and the US Constitution

The Archbishop of Canterbury Rowan Williams has said that the UK must make allocation for the application of Sharia law in the UK. Williams says this is an unavoidable accommodation that promotes social harmony.

Jay Tolson, a senior writer at U.S. NEWS & WORLD REPORT who has followed the story and written about it on his blog Faith Matters believes that all depends on what is, is: “In some respects, the archbishop is right that it's a pumped up controversy, because technically British law already allows any third-party institution to adjudicate a matter as long as the two parties agree upon this third party. Jewish courts have handled many civil issues for centuries in England. So, in some sense, it's not controversial in that way. But, of course, there are other reasons why people are upset”, Tolson is quoted by Religion & Ethics Newsweekly, dated February 15, 2008.

In response to the observation that Sharia seems quite extreme in many parts of the West, including the United States, especially given the treatment of women, Tolson writes: “Well, that's precisely the issue…..he's really poked a hornet's nest with a stick. … He knows that there is a big debate in the Islamic world itself about what Sharia means - -- Sharia is a very strict set of laws, a code, you might say. There are others who argue that Sharia is a very general set of principles that should inform the laws. It's not a prohibition against women going into the world without a veil, for example. So this debate is really quite sharp right now, and there have been efforts in other Western countries to introduce Sharia”

The Sharia Academy, founded in Florida in 2004 claims to “adhere to the principles of Ahlus-Sunnah Wal-Jama'ah and the guidance and knowledge contained in the Book of Allah (i.e. the Glorious Qur'an), the Sunnah (way) of His Messenger Muhammad, peace and prayers be upon him, and the applications of his Companions, may Allah be pleased with them”

Omar M. Ahmad founder of CAIR said:"Islam isn't in America to be equal to any other faith, but to become dominant" he said. "The Koran, the Muslim book of scripture, should be the highest authority in America , and Islam the only accepted religion on Earth," he said.

In his blog dated February 9, 2008, Ken McCracken asks a rhetorical question: Afraid Of Sharia In The U.S.? We Already Have It, concluding it is not a big deal, since:

And of course the application of Sharia law was indeed a perfectly normal matter. American courts are governed by American law, but American law has long provided that parties to contracts can provide for alternative dispute resolution mechanisms (such as arbitration). American law has likewise long provided that some contractual disputes would be resolved with reference to foreign law, especially when the law is expressly provided for by the contract. It doesn’t matter whether the arbitration or the foreign law is secular or religious—secular and religious rules are treated basically equally, on the principle that the parties’ contractual choices should be honored unless some extraordinary circumstance makes it unfair to do so.



Not a big deal, unless of course activist judges cite Sharia and other foreign mechanisms to re-interpret the US Constitution!
The Arch Bishop of Canterbury is nuts. Sharia Law allows for the killing/murder of women who disobey their fathers without penalty. JM

As a 28 year resident of Berkeley, who values peaceful alternatives to conflict, thank you for having the courage and conviction to tell military recruiters they are not welcome in Berkeley. AS THE MOTHER OF TWO TEENAGERS, ONE OF WHOM HAS RECEIVED UNSOLICITED AND UNWELCOME RECRUITMENT MATERIALS FROM THE MILITARY, I know this is a very important issue to me and to many other families – Code Pink

On the other hand, we have Sergeant Major Todd. Todd recently retired from the Army after 25 years of being a green beret. S.M. Todd responsibilities while in the Army was to oversee anti-terrorist teams.

S.M. Todd was disgusted when he heard the comment, "I support the troops, but not the war." He then explains how he feels about the war on Islamic extremists:

Just understand that my Brothers and I voluntarily fought to give you the choice.



I wish that I had written this letter two years ago. Brave men that I personally knew died. I held some of them in their last moments on this earth. I rejoiced in their great accomplishments and selfless sacrifice to fight a wrong and to free the oppressed. I cried when they died. They left families and friends behind. This is the life that we voluntarily chose. Some gave all, all gave some. The dead are at peace: The living remain with the guilt.. Why them and not me? We bear scars that run to the deepest depths of our souls... We are handicapped, and bear the guilt that you will never know.



I did bad/evil things to bad/evil people.. They deserved it. I will do it again with as much vengeance and jubilation if I ever have the chance.



This is another reason why the military who fight and die have a saying. We went to war; America went shopping!



The American public as a whole have not had to sacrifice anything as of yet except: During World War 2, all Americans had to sacrifice: Millions of loved ones during a National Draft, gas rationing, copper and all metals, rubber, meatless Tuesdays, cotton and linen (for bandages), lead for bullets.. etc. etc... Since 9-11-2001, the American public enjoyed the record level benefits of investing in the DOW and New York Stock Exchange. It is only recently by having a Democratic majority Congress that we are now on the verge of a recession.



Never forget 9-11-2001 and the men who make sacrifices to try to ensure that it will never happen again on USA soul. More American lives are lost per year on U.S. highways than we lost in the Global War on Terror as of this date. Do not let my Brothers die in vain. Petition your Congressman and Senators to stay the course that they voted on. Yes they voted to send America to War, it is not an illegal war. Hold them accountable for their actions and their votes.. Make them stand by their vote and finish it. If we do not WIN this war, America will forever be the victim of attack and peril... We will be forced to bow down before our enemies, we will be slaughtered and beheaded as a Christian Nation as they have already done to our Brothers that they captured.



Pray for our Country and our Leaders. This is an election year and we need divine intervention to keep our country strong and prosperous. This Nation was founded on Christian beliefs, do not believe the myth that our constitution guarantees separation of church and state. Our nation was founded on Christian ideals. Our Nation's founders, no matter their faults; openly prayed in "English" during the opening of every official government meeting in the Name of God Our Father. I challenge you to find the guarantee of separation of church and state in the U.S. Constitution. It does not exist.

Will the Berkley City Council ever understand? It is doubtful Code Pink ever will!

YMCA Youth Counselor at RSM convicted of molesting a minor

February 8, 2008


According to the Orange County DA, John Brandon Mohler, 34, was convicted today of sexually assaulting a 10-year-old girl during program hours on-site at a Rancho Santa Margarita YMCA facility.

Mohler, a Lake Forest resident, pleaded guilty to lewd acts on a child under 14. He was sentenced to one year in jail, five years formal probation, and will have to register as a sex offender.

Between March 1, 2007 and March 31, 2007, Mohler molested Jane Doe during program hours while working at the YMCA in Rancho Santa Margarita at 22232 El Paseo.

Opera Pacific, “The Magic Flute”: a review

The Magic Flute, Magically Delicious - Best Family Entertainment Value in Orange County Hands Down

With a few star performances, an engaging set, and vibrant costumes, Opera Pacific concluded its four-performance run of The Magic Flute Saturday evening, February 2, 2008

Mozart’s final opera has a basic, prevailing “Good versus Evil” theme with a few minor twists and some comedic relief. Nicole Cabell, as Pamina the princess, gives a technically sound performance showcasing her wonderful voice, yet highlighting her limited acting talents. Chad Shelton as Tamino, Pamina’s prince rescuer/hero, also shows off his sub-par acting skills, while his singing lacks emotion and is mostly strained throughout the performance. This is unfortunate due to the fact that the story is centered around the young lovers and although one can appreciate Cabell’s singing (she did deliver with the aria to Tamino), Shelton fails to present himself (in voice and stature) as a strong character, thus failing to convince the audience of his “hero” status.



Public Service Announcement

Although the two main characters fall short of their respective roles, the supporting cast, for the most part, pick up the slack. Rod Gilfry is excellently cast as Papageno, the Hedonistic bird-catcher who is befriended by Tamino and accompanies him on his journey. Gilfry’s stage presence and poise not only give great comedic relief, but allows us to tolerate Tamino more. The Queen of the Night, performed by Luz de Alba Rubio, is also wonderfully cast as Pamina’s autocratic and megalomaniac mother. She shows off her range of voice and acting and leaves no doubt who people are rooting against.
Morris Robinson, as the wise Sarastro, lends his bass to the sympathetic role. The power of the lower register fits nicely with the character, and makes the audience warm up to him that much faster.


The audience does not warm up to Monostatos, Scott Scully, who gives a delightfully “evil” performance as Sarastro’s servant who falls out of favor and joins forces with the Queen. The Three Ladies - Erin Wood, Priti Gandhi, and Audrey Babcock - blend together well, do not step on each others toes, and make grand entrances and exits. It should be noted, as one opera lover observed, that the opera is not over ten minutes into the performance when the Three Ladies make their debut.

Director Dr. Michael Hampe does a fantastic job of keeping the show moving and allowing the cast to sing their requisite roles. Dr. Hampe collaborated with Alberto Andreis to design the set and what we see is a very innovative and intricate mix of moveable walls, trap doors, and backdrops that heightens the experience. Zandra Rhodes lends her personal style to the costume development, using bold colors and geometric patterns that do not distract, but enhance the magical theme of the opera.

If political contribution activity is any indication as to how Laguna Woods Village will vote in this year's presidential elections, then LWV is barely Navy Blue, whereas Rancho Santa Margarita is undisputedly Red Romney Country where Senator Clinton is conspicuously absent, and so is any democratic candidate for that matter.

Bill Richardson got the bulk of the contributions from LWV with a 28% share, followed by 21% for Senator McCain, 6% for Governor Romney and 3% for Senator Obama.

Only individual contributions from California are included. The donor information – only donations of $200 or more are detailed – is submitted to the Federal Elections Commission by campaign committees.
Ladera Ranch is also LDS/Romny Country with most of the political donations going to Governor Romney. Senator Clinton is also nowhere to be found

Hello All: John McCain has two timed the Republican Party for the last 27 years. Let me count the ways:

McCain/Kennedy that would have given amnesty to 12,000,000 illegal aliens.
McCain/Feingold that prevents Republicans from contributing to elect Republicans and limits free speech.
Voted two times against the Bush Tax Cuts.
Supports closing Guantanomo where the Terrorists are in jail.
Supports ending water boarding to get information from Terrorists.
Was involved in the Keating Savings and Loan Scandal which cost taxpayers over $400 Billion. Should have gone to jail for that one.
McCain/Liberman specific to global warming that will raise all energy cost in this country and cost jobs.
John McCain is not a conservative Republican. He will reach across the aisle all right with Democrats to raise taxes. He has never had a job outside government in his life. He is a kept man supported by his rich wife. McCain can’t deal with the economy since he has never worked in it. John McCain does not have the temperament to be President. He is arrogant and stubborn. McCain will get us into even more wars.

While Mitt Romney is not perfect by any means, he can beat Hill and Bill by first uniting the Republican Party. If McCain is the nominee, conservative Republicans will sit out this election and we will lose. McCain will tear the Republican Party apart which will take years to recover. Remember, Pete Wilson in California who destroyed the Republican Party here and it has never really recovered. A vote for McCain is a vote for Hill and Bill. I am voting for Mitt Romney as the only candidate who can beat Hill and Bill. JM

When You Have the CLRC on your side, Who needs Lobbyists?

According to its website, the California Law Revision Commission (CLRC) has the responsibility for the continuing substantive review of California statutory and decisional law. The Commission assists the Legislature in keeping the law up to date by:

1. Intensively studying complex and sometimes controversial subjects

2. Identifying major policy questions for legislative attention

3. Gathering the views of interested persons and organizations

4. Drafting recommended legislation for legislative consideration

So the question is, where does the Attorney-Client Privilege After Client’s Death (Study K350 Memorandum 2008-8) fall in the commission’s mandate? Or consider that In a scathing letter to the California Law Revision Commission ominously titled The Temple of Blame and Wholesale Titleholder Disenfranchisement, arbitrator and author D. Vanitzian questions the motives for the mad rush to “pass pork-barrel project, as she refers to the Statutory Clarification and Simplification of CID Law. We asked CLRC Executive Secretary Brian Hebert to comment on Vanitzian’s letter and he declined.

What do we make for example of other professional organizations, such as the Institute of Electrical Electronics Engineers (IEEE), the world's largest technical society. The IEEE brings members access to the industry's most essential technical information and develop/propose technical standards of benefit to consumer’s worldwide – members pay for their membership, their work is voluntary, and whether their work endures or flops is left to the consumer.

Likewise the Video Electronics Standards Association (VESA), an international non-profit corporation representing a voting membership of more than 165 corporate members worldwide sets industry-wide interface standards for the PC, workstation, and consumer electronics industries. Again, members pay for admission and success or failure is up to the consumer

The Better Business Bureau’s (BBB) stated values include to “Strive to do our very best. Be accountable to the general public, our members, and to each other for everything we do. Commit to providing the highest quality service with excellence and consistency everywhere we operate”. Businesses that earn BBB accredited business status contractually agree and adhere to the organization’s high standards of ethical business behavior. The BBB is arguably one of the most trusted organizations on both sides of the aisle – whether a business, or a consumer. Compare that to the California Bar. Consider that attorneys make and/or influence and/or have great input into the laws that protect them and their actions.

Anyone ever try to sue for malpractice today? Good luck. Anyone try to file a complaint against an attorney at the State Bar today? Good luck. Anyone try to sue for malicious prosecution today? Good luck

In cash-strapped California, does it make sense to have a tax-payer paid Commission where attorneys make and/or influence and/or have great input into the laws that protect them and their actions? In other words, who needs a lobbyist when you have attorney friends in the CLRC? Is it any wonder that the California Governor recently asked the Commission to justify its existence and its dogged pursuit of HOA/CID legislation that benefits attorneys and not homeowners? And just as fast the Law Revision Commission as of 2 Feb 2008, “will not be considering common interest development law at the upcoming February 14 meeting. The topic will be scheduled for a later meeting”? To be clear, CLRC Executive Secretary Brian Hebert pointed out that the Governor’s “… proposed budget would continue the CLRC budget, with the same 10% cut proposed for every state agency. There has never been any question from the Governor about our work on CID law.” Do not know what is more troubling: That the Governor may have asked the CLRC to justify its work, or that the Governor did not ask the CLRC to justify its work, as Mr. Hebert pointed out.

We think that the California Bar is in a dire need of reform so it can be more responsive to consumers, perhaps patterned after the BBB. We also think the CLRC has outlived its usefulness.

In other words, when you have an attorney friend with the CLRC, who needs to have registered lobbyists?

OCDA Celebrates the Year of the Rat – 26th Annual Tet Festival Parade

February 4, 2008

The Orange County District Attorney's Office (OCDA) announced it is proud to participate in the 26th annual Tet Festival and Parade this weekend, Saturday, February 9, 2008.

The 2008 Tet Festival is a celebration of the Vietnamese New Year, "Year of the Rat", and will feature entertainment, games and prizes, food, art and culture vendors, and exhibitors from local business, government, and law enforcement agencies.

District Attorney Tony Rackauckas will participate in the Tet Parade, beginning at 10:00 a.m. at the intersection of Bolsa Avenue and Magnolia Street in Westminster. Mr. Rackauckas, along with other government and community leaders, will also attend the Tet Festival's Opening Ceremonies at 12:00 p.m. at Garden Grove Park in Garden Grove.

We should note that the OCDA As part of its ongoing commitment to improve the quality of life in Orange County communities, celebrated the holiday season with 40 special families at the 9th Annual Adopt-a-Family event, Saturday, December 15, 2007. In Other words, the OCDA speaks Tet, special families and holidays, but no Habla Christmas or poor families.

Vote wrongly if you will, but vote!

If political contribution activity is any indication as to how Coto de Caza will vote in this year's presidential elections, then Coto is Redder than Red Meat.

Rudy Guliani got the most money from Coto residents with a total of $41,928 and an average of $1,352 per donation, followed by Romney at $17,800 with an average of $741 and MacCain with $15,250 and an average of $1694. Is there a message in these figures? That is, more donors per Romney, with smaller donations, even though he can afford and may be able to buy the US Presidency?

On the democratic side, Obama had two registered donors with a total of $1,000 and Senator Clinton received $3,300. Might explain why democrats are conspicuously absent from the Coto Discussion Forum
The earliest donation recorded in this database is January 2007 and the latest one is September 2007, and of course is not indicative of the Obama Bump or the Giuliani failed Florida strategy.

Only individual contributions from California are included. The donor information – only donations of $200 or more are detailed – is submitted to the Federal Elections Commission by campaign committees.

Coto de Caza is Red But California is Blue, Blue, Blue

I assume that my donations for Romney would have been booked as Nevada not Coto. And, the big amount of money going to Guiliani just indicates that Republicans who remain in California are fairly liberal or moderate. The Conservatives have already moved to Nevada which is one of the reasons Nevada is a Red state, just barely anyway because of Las Vegas and California is a Blue State . After Pete Wilson destroyed the Republican Party in California , it has never recovered. The Republican Party in California is truly a minority party. Hollywood and Bay Area types with money are all left wing Democrats. California is lost. This state has gone over to the dark side. And, specific to the Presidency unless a new initiative requiring apportionment passes, given the Electoral College system, California Republican votes don’t matter much anyway. It is actually a really good argument against our Corrupt Delegate Electoral system as CZ Members are regularly disenfranchised. Of course, on the national scene the Electoral System actually makes it harder for Democrats to win which is the only reason to support it. JM

The gutting you refer to directly led to the gutting of the California educational system, and replaced it with one of the most powerful unions in the country – the California Teacher’s Association. Wit Capo’s board actions.

That also raises a question: If Coto is so Red, and puts its money where its mouth it is, why is that the CZ board of directors in deed and actions seem to reflect an Obama country?

Consider that attorneys make and/or influence and/or have great input into the laws that protect them and their actions.

Anyone ever try to sue for malpractice today? Good luck. Anyone try to file a complaint against an attorney at the State Bar today? Good luck. Anyone try to sue for malicious prosecution today? Good luck. Gee, what's happened to the "teeth" in the law? Law? Did someone say LAW? Anyone try to question an attorneys' billing invoices? Good luck.

Anyone interested in the influence that the California Law Revision Commission or other such Commissions have on YOUR LAWS?

Take a look at the California Law Revision Commissions "PROJECTS" section.

For example: look to see how many attorneys are writing-in with their "suggestions" and how many of those attorneys' suggestions are being heard, recognized, used, or incorporated into the CLRC text, by the California Law Revision Commission, or Commission in your home State. (These commissions influence our laws, most of the time detrimentally, those are the words of a lobbyist and uh, well, attorney too)

Gee, if I didn't know better I'd think that those attorneys writing into these Commissions are on to something. That is, why bother lobbying or paying a lobbyist to lobby the Legislature when you can use the California Law Revision Commission to do that lobbying for you for free, kinda like putting your tax dollars at work? How many of those attorney-generated "suggestions" actually transpire into laws that the rest of us have to live by, or better yet, are FORCED TO HIRE AN ATTORNEY for.

Want to know how some of these laws make it to the California Legislature when the Laws that everyday citizens want passed, no one can be bothered with?

Take a look at the (below) "Attorney-Client Privilege After Client's Death" PROJECT--scope of supposed study (when you're through with that, look at the bastardization of the California Probate code). You're thinking, what's so bad about that?!

Gee, even after my death, when my family learns how badly my attorney failed my Will and Trust (oh, and got PAID doing it) my incompetent (or worse) attorney will be let off the hook by not only the California State Bar but the Court system too! Why, you ask? BECAUSE HE'LL ARGUE IN HIS DEFENSE: ITS ATTORNEY CLIENT PRIVILEGE. That is now the catch-all defense for errant attorneys. There's much more on this, but for a later date.

Next to the Evidence Code, Wills and Trusts are arguably the most abused sections of our laws in California. Ponder this: Someone dies. You take the Trust/Will to a probate attorney, or better yet, someone who PROFESSES TO BE CERTIFIED AS A SPECIALIST BY THE CALIF. BAR. <= watch out for that. Don't be too impressed with these labels.

What's the FIRST thing that happens?

The attorney reads the documents, sees that you've been left $150,000 and immediately says, I CAN HELP YOU (remember the person who left it to you is dead) and with all this Attorney-Client privilege...well, you be the judge. Anyway, this attorney that you go to begins to claim his/her share of ALL that money--he knows how much you've got in the kitty $150,000. Its now his to play with. What could be worse than that?! In order for him to tell you he can help you, he has to read the entire trust and will to learn what's in there. He gets paid for that. Then he starts to work on what you've been left. Contingency agreements? You better believe it. Soon, before you know it, he's now working on what the others got in the will and trust too. Next, you've got a lien on your inheritance, can't think it will happen, I have proof that it has already happened, over and over again.


Why bring this up? Because the situation is worse if you own property in a common interest development (CID/HOA) If the above situation happens to you and there is such deed-restricted property that has been willed or in a trust, all I can say is Good Luck!

Funny you should mention it. Nevada has no Corporate or Personal state income tax and no estate tax. Further, there are initiatives coming up that would raise the gambling tax charged casinos from 6.75% to 9.75% of gross income. In doing so, there is another initiative that would eliminate Property taxes. That would only leave the 7.25% sales tax which is lower than California . Let’s face it, gambling and tourists fund everything in Nevada and if these initiatives pass, which seems likely tourists coming from California and all other states will be paying for nearly all of our state expenses.
