Rancho Santa Margarita, CA –  On Sunday, August 31, 2014, Search & Rescue personnel from the Orange County Sheriff’s Department’s Reserve Bureau located a missing mountain biker who was lost in the Cleveland National Forest off Ortega Highway, approximately ten (10) miles east of the San Juan Capistrano city limits.

According to OCSD spokesperson Lt. On Saturday, August 30, 2014 at approximately 12:00 p.m., the missing mountain biker became separated from his riding partner as they rode San Juan Trail from the Blue Jay Campground to the Ortega Fire Station.  After searching for several hours, the missing mountain biker’s partner contacted the Sheriff’s Department and a search was immediately initiated. Approximately 10-15 Sheriff’s Department Search & Rescue personnel searched on foot throughout the night with support from Sheriff’s Air Support.

The missing mountain biker was eventually located this morning on foot in an area off the trail, approximately three (3) miles east of the Ortega Fire/Ranger Station. He was evaluated and treated by Orange County Fire Authority paramedics.

The Sheriff’s Department recommends people take necessary precautions when engaging in outdoor recreational activities in rural areas of the county by traveling  in groups, providing itineraries and an expected time of return, bringing a communication device and always carry a flashlight.

Anna Bryson votes against Eric Schlosset's "Fast Food Nation"

Anna Bryson votes against Eric Schlosset's "Fast Food Nation"

From Anna Bryson post on FACEBOOK

Tonight (8/27/14) I voted against having Eric Schlosser’s "Fast Food Nation" as an assigned text in Capistrano Unified schools.  I was the only Trustee willing to vote against the leftist ideological indoctrination in this book.

The book is unscientific. It is anti-capitalism and explicitly pro-socialism.

I said in public debate that the book is not balanced and does not present both sides. I cited Cynthia Crossenn, who deplored the author’s “cavalier manipulation of data.” She gives as an example the author’s claim on a typical day in the U.S., "one-quarter of the adult population visits a fast-food restaurant." But this claim is not based on sound social-science research – the author even admits that this is his own “estimate.”  This book should not be assigned to Capistrano students in the absence of reading that provides more about fast food than this author’s unproven opinion.

I also cited economist Thomas DiLorenzo who said that "Fast Food Nation" “has nothing at all good” to say about the fast food industry – which I find to be wrong and unfair to students.   DiLorenzo goes on to point out that American consumers are as educated “as they have ever been” and “can judge for themselves where the best place to eat is.”  DiLorenzo adds that
Wendy’s, McDonald’s, Burger King and other fast-food restaurant chains have in recent years catered to Americans’ growing interest in a healthier lifestyle and have cut down on fat, put out more salads, and offered low-carb foods.

I complained that the title as presented to board for approval did not give the book’s full title: “Fast Food Nation: The Dark Side of the American Meal.”  The title itself indicates that the book is one-sided.

The fact that this book  is recommended by the College Board should not determine the decisions of the Capistrano Board.  We are elected to represent the parents and taxpayers of the Capistrano district and not to blindly follow the dictates of some outside group.  The fact that there are alternative books available makes it even more distressing that this slated, biased book was approved by the school board.

I am disappointed that my fellow Trustees did not stand up for Capistrano’s children.

The Obama Administration's Continued War on Christians

The Obama Administration's Continued War on Christians

Posted by CotoBlogzz

Having lost in the Supreme Court, the Obama administration had announced yet another (8th!) revision to the HHS mandate.

Under their proposed ‘new’ rule, if a non-profit charity like the Little Sisters of the Poor or Notre Dame has a religious or moral objection to paying for abortion drugs, the federal government will force their insurance plan administrator or traditional insurance company to pay for those abortion drugs -- and then reimburse them!

The worst part is the government will directly use the coverage offered by the objecting employer to contact every employee to let them know that abortion drugs are available to them at no cost!

The Bottom line is that Christian employers are coerced  into partnering with the federal government to make sure their employees have access to FREE abortion drugs.

Catholic social service agencies and other Christian organizations do not want to participate any way whatsoever in the provision of child-killing medicines. Yet the new rules merely create a phony diversion. The Little Sisters would be required to inform the federal government they object -- so the federal government can step in and provide the abortion drugs anyway.

And what if the objecting corporations or non-profits refuse to comply?  Up to $36,500 in fines, per year, for every employee!   And President Obama and his allies think this is just fine.

So what happens next?  the lawsuits will continue and the Obama administration will keep revising and revising this rule -- to get around court decisions.

To fix this problem, CatholicVote.org has called for the full repeal of Obamacare as it does not see a real ‘fix’ that will solve this attack on religious freedom until it is wiped from the books.

You don’t need to ‘fix’ the First Amendment.

So what’s next? With your help we will continue the fight in the courts, while doing everything possible at the ballot box to enable us to end the nightmare of Obamacare.

Cumulative voting is designed to protect minority owners

By Donie Vanitzian

QUESTION: We recently bought a home in a large development with a homeowner association and are new to the concept of boards and this type of living environment. We're told the same directors have been on the board and controlling the association for over 13 years. The directors said their attorney and management company advised them to get rid of cumulative voting. They're campaigning for owners to "support the board" in eliminating cumulative voting. We're uncertain how to vote. What's cumulative voting, and why does the board want to eliminate it?

ANSWER: Ridding the association of cumulative voting has nothing to do with "supporting" the board and everything to do with disenfranchising minority owners under a mask of "fairness."

A caveat to fairness in cumulative voting is that only titleholders should be allowed to vote and no single owner, including the developer, owns the majority of properties. Where the common interest development is not yet completed, the association has a developer-controlled board of directors or the developer owns majority shares or properties, more often than not, those cumulative votes favoring the developer are designed to outweigh and outvote all other voters.

Under Civil Code section 5115(c), if the governing documents provide for cumulative voting, the association shall allow for cumulative voting using the secret ballot procedures provided in Section 5115. An article or bylaw provision authorizing cumulative voting may be repealed or amended only by approval of the owners (defined in Corporations Code section 5034) except that the governing article or bylaw provision may require vote of a greater proportion of owners for its repeal, under Corporations Code section 7615(a).

Cumulative voting allows the titleholder to multiply his votes by the number of directors to be elected. The owner may vote this cumulative total for a single candidate or distribute his votes among any number of candidates (the total number of his votes being equal to the number of shares he is voting multiplied by the number of directors to be elected). In any election of directors by cumulative voting, the candidates receiving the highest number of votes are elected, subject to any lawful provision specifying election by classes, according to Corporations Code section 7615(c).

The purpose of cumulative voting is to ensure minority interest representation on the association's board of directors. While majority board directors may not use their power to control corporate activities to benefit themselves alone or in a manner detrimental to the minority, without adequate representation abuse of the process becomes a common occurrence. Any use to which directors put the corporation or their power to control the corporation must benefit all members proportionately. Such conduct is inconsistent with a director's duty of good faith and inherent fairness to minority owners, courts have found.

Titleholders have valuable property rights that vest at the time of their property purchase. Concerned about minority disenfranchisement, courts recognize that although a dollar amount as compensation for such disenfranchisement might be speculative, the "damage is real" and "equity demands that minority members be placed in a position at least as favorable as that which the majority created for themselves."

The destructive consequences of an entrenched board far outweigh the fears that cumulative voting will upset the status quo. Recalcitrant directors intent on remaining on the board begin by amending and rewriting governing documents, inserting terms favoring their reign, eliminating cumulative voting, making decisions outside of meetings and implementing rules with iron fists. However, those actions can have unintended consequences such as reducing individual titleholder wealth through disenfranchisement on the one hand and devaluing property on the other hand. When the minority's vote does not carry the same weight as that of the majority, the minority's worth is lessened.

The purpose of cumulative voting is neutralized when an association (1) staggers terms directors in office can serve; (2) campaigns for or recommends certain candidates, or presents a slate of nominees to be elected together to fill board positions; (3) has annual elections for only one class of directors each year; (4) forces votes by acclamation rather than by nomination that includes proxies and ballots; (5) forces a vote by voice or show of hands; (6) calls for a voice vote of "ayes" and "nos," (7) keeps the same board directors year after year; (8) removes all proxy voting.

Majority directors who get control of the board then do as they please with support from the majority and leave minority owners in the dark, effectively disenfranchising minority voters. The minority then has no one on the board to watch its interests, to protect against waste, extravagance or mismanagement. Couple those actions with a management company vendor that in essence resorts to aiding and abetting the board in order to continue its contract renewals. Through these types of actions, the majority, having obtained absolute control of the association's operations, banking and financial proceeds, along with "unlimited legal paid advice," is free to plunder and abuse its positions of trust with impunity.

The object of cumulative voting is not to tie the board's hands but to protect the minority from disenfranchisement for the want of some representative to look after their interests.

Rebecca Benedict ran from the apartment down an adjacent path to escape. Brian Benedict chased her with a firearm and shot the victim several times. Brian Benedict then went back into his apartment, grabbed his son, and put the boy in the car. Witnesses and neighbors, who feared the defendant was going to flee the scene with his son, physically restrained Brian Benedict until police arrived.

The Irvine Police Department and the UCI Police Department investigated this case.

Senior Deputy District Attorney Matt Murphy of the Homicide Unit is prosecuting this case.

Robert Holloway, CA investment manager found guilty in $33 million investment scam

Robert Holloway, CA investment manager found guilty in $33 million investment scam

Posted by CotoBlogzz

Rancho Santa Margarita, CA - Robert L. Holloway, 55, was found guilty after a 7-day trial by a federal jury in the District of Utah of four counts of wire fraud and one count of making and subscribing a false income tax return, according to announcement by Assistant Attorney General Leslie R. Caldwell of the Justice Department’s Criminal Division,

Court documents established that Holloway operated an investment entity called US Ventures LC, which was founded in 1999.    Holloway served as the chief executive officer and managing partner of US Ventures.   From October 2005 until at least April 2007, Holloway recruited investors for US Ventures by making false representations about the company, including that US Ventures used proprietary trading software that was consistently profitable, US Ventures generated returns of 0.8 percent per trading day and US Ventures would retain a 30 percent share of investors’ profits as a management fee.

Additionally, during the course of US Ventures’ existence, Holloway generated and distributed reports to investors showing false daily returns.  Evidence showed that between October 2005 and April 2007, contrary to the returns shown on the reports Holloway distributed, US Ventures in fact lost more than $10 million in trading and the “profit” figures on the investor reports were entirely fabricated.   Holloway and US Ventures also made “profit distributions” to investors that consisted of funds solicited from new investors, not actual profits.   US Ventures raised more than $33 million from investors for its trading activities.

Evidence at trial also showed that Holloway misappropriated investors’ funds for a variety of personal expenses, including supporting his then-wife’s eBay business and purchasing hundreds of thousands of dollars of jewelry.   During 2006 alone, Holloway diverted more than $1.2 million in investor funds to a “business” account that Holloway used for as a personal account, despite the fact that he falsely claimed a gross income of only $27,500 on his personal tax return for 2006.

U.S. District Court Judge Robert J. Shelby, who presided over the trial, set sentencing for October 20, 2014.

The case was investigated by the FBI’s Salt Lake City Field Office and the IRS-CI’s Las Vegas Field Office.
