Complaints not restricted to errant attorneys - try judges

Posted By CotoBlogzz

Rancho Santa Margarita, CA - In the piece published in the CotoBuzz Journal June 10, 2009 titled  Lowering the Bar – a Kindler Gentler California Bar, we make the argument that while the California State Bar’s discipline system is designed to protect the public, the courts and the profession from attorneys who violate ethical rules covering their professional conduct, the system is not only toothless,  but the organization seems intent on protecting the guilty.  Case in point top  Bar prosecutor Scott Drexel who took a tough  stance on attorney misconduct was  let go.  Mr. Drexel served as chief trial counsel for four years and worked at the State Bar  for more than thirty years.

Two years earlier the CotoBuzz Journal published a piece encouraging residents to file  complaints “against errant attorneys – but especially homeowner association attorneys.”   Given the lowering of the bar for attorney misconduct in California, should the attorney  complaints stop, given that the it is highly likely the California Bar will not act?  Not at all, quite the contrary.  While the California Bar may not act, the complaints will serve as a document trail just that can be extremely useful should litigation be necessary.

The aforementioned piece makes the assertion that all we need to file an attorney complaint, we learnt in Kindergarten – click here for details.  See example of actual complaint.  – Click here

However, complaints are not restricted to errant attorneys, as  George K. Staropoli,  President of Citizens for Constitutional Local Government illustrates with a complaint of judicial misconduct he filed against Arizona Robert Carter Olsen. Click here for copy -  Mr. Staropoli states that procedure is rather straight forward, and just like going to court, the violation a specific rule(s) of conduct must be stated.  Then, documentation must be provided in support of the charge of misconduct.

If you advertise here, you are aiding and abetting the CZ Master Association in trademark infringement

Mr. Staropoli’s illustration is quite timely considering the California  judicial civil war  with
the Alliance of California Judges pushing legislation to reduce the powers of the Judicial Council, headed by the chief justice and the Administrative Office of the Courts(AOC). A special commission appointed by Chief Justice Tani Cantil-Sakauye to investigate the Administrative Office of the Courts delivered what the Sacramento Bee describes as a scathing report  that, in essence supports the rebel judges’ arguments, including characterizing the AOC as a top-heavy and unwieldy organization with deficient  management processes.

Obama's Not freudians

The latest Obama Freudian in the growing list is no Polish Joke - Psychological fingerprint or damaged Neurons?

Posted by CotoBlogzz

We continue to argue that  President Obama's  Freudians  are not errors, as much as they are  indicators of his  psychological fingerprint. A troubling pattern if you will:

Psychological fingerprint, or Damaged Neurons?

"That's Bad Crazy . . . You Don’t Want Billionaires Paying The Same Tax Rate As Jews . . . I Mean Janitors”

Or  'I've Visited 57 States' Freudian Slip - There are 57 member states in the  Organization of the Islamic Conference, which roughly coincides with the number of countries currently boasting a Muslim majority population

Or  "You've had enough of him, but I have to deal with him every day,"  referring to Israel ' Prime Minister

The there is the President's  condemnation of the English Embassy in Tehran, then getting it wrong a second time, called it the Embassy of the United Kingdom.

The President also  thinks Hawaii is in Asia.

You may recall that President Barack Obama  in celebration of Jewish Heritage Month issued a proclamation laude ding  Nazi supporter Gertrude Stein.  Stein, who was Jewish, supported the puppet Vichy regime in France in the Second World War through her friend, historian and Nazi collaborator Bernard Fay.

Forget about the President's " more flexibility after my "re-election" comments to Medvedv about missile defense system.

The latest Obama Freudian in the growing list is no Polish Joke.

During the Presidential Medal of Freedom ceremony, the President  was
Trying to honor  a famous Pole, Jan Karski, a resistance fighter who sneaked behind enemy lines to bear witness at the atrocities being committed against Jews. President Obama referred to him being smuggled "into the Warsaw ghetto and a Polish death camp to see for himself" - as opposed to a Nazi death camp in German-occupied Poland.

On second thought, perhaps the  Freudians in this case are less of a psychological fingerprint, and more long term brain damage due to drug abuse.  According to the National Institute on Drug Abuse, " Research has shown that, in chronic users, marijuana had an adverse impact on learning someone and who smokes marijuana every day may be functioning at a suboptimal intellectual level all of the time.  And while  Research into the effects of long-term cannabis use on the structure of the brain has yielded inconsistent results .. This uncertainty may stem from confounding factors such as other drug use, residual drug effects, or withdrawal symptoms in long-term chronic users."

Award Recipients::

Brooke Howell, Speech student from Laguna Niguel, is currently on the award-winning Saddleback College Speech and Debate Forensics Team.  In the next two years, she plans to continue as a member of Forensics to improve her public speaking.  Her long-term goal is to attend law school.  Brooke performed an award-winning speech.

Photos of his sculpture were displayed.

Learon Inbar, Visual Arts student from Trabuco Canyon, plans to pursue a bachelor’s degree in Theatre Design with a focus in costume and set design.  She recently learned that she has been accepted to UCLA. Her long-term goal is to seek an assistantship to a costume or set designer and eventually earn a master’s degree in Theatre Design.  Her drawings were displayed.

Daniel Frazier, Photography student from Chino, is a veteran who was deployed overseas three times in five years. His goals are to successfully transfer to a four-year university and start a double major to graduate with a bachelor’s degree in business and photography.  He found passion in photography and wants to build his photography business following college.  His photography was displayed.

Timothy (Chase) Chandler, Music student from San Clemente, is a trumpet player who switched to vocal music last fall.  He plans to pursue voice and vocal performance which has been a different and transforming experience compared to trumpet, piano and guitar.  He actually started “performing” instead of just playing or singing and he is anxious to see where this takes him in the next 3-5 years.  He performed an operatic piece by Mozart.

Kenneth Breadhoff, Cinema-Television-Radio student from Mission Viejo, plans to pursue his studies at a four-year university and he would also like to create his own audio production-company that features a website to promote up-and-coming voice-over actors.  Audio recordings of his voice-over work were played and he read a poem that he wrote.  The scholarship money will help him regain some finances he lost during the recession.

Andrew Garig-Meyer, Cinema-Television-Radio student from San Juan Capistrano, plans to pursue a higher degree in film and continue to direct short films.  He plans to use his scholarship money to purchase a director’s view finder and to put some of the money towards buying a car, which is an essential need for a filmmaker as many film locales are in the middle of nowhere and requires shooting at dawn.

Isadora Sharon, Dance student from Laguna Niguel, plans to study many dance styles and to return to martial arts to create an abstract style of dance.  She is also auditioning for Chapman University in the fall.  As a long term goal, she plans to use her studies in anthropology to travel and learn cultural styles of dance.  She performed a multi-cultural dance.

Andrew Lloyd Webber & Tim Rice’s Joseph and the Amazing Technicolor Dreamcoat comes to Saddleback College

Posted by CotoBlogzz

Rancho Santa Margarita,  CA – Saddleback Civic Light Opera is presenting Andrew Lloyd Webber and Tim Rice’s Joseph and the Amazing Technicolor Dreamcoat, a musical for the whole family to enjoy, on June 8-24 in the McKinney Theatre.

Directed and choreographed by K. C. Gussler and musically directed by Lex Leigh, this biblical saga of Joseph and his coat of many colors comes to life in this delightful musical parable.  Set to an engaging cornucopia of musical styles, from country-western and calypso to bubble-gum pop and rock ‘n’ roll, this Old Testament tale emerges both timely and timeless.

In this vibrant story, a narrator tells us we are about to hear the story of a person like any one of us - a dreamer - whose dreams come true. We jump back to Biblical times and meet Jacob, who had twelve sons of whom Joseph was his favorite.  To show his love for Joseph, Jacob gives him a multi-colored coat.  Joseph's brothers resent the favoritism and the fact that Joseph has high aspirations.  But we won’t give away what happens to Joseph due to the jealousy of his brothers.  Come to the McKinney Theatre at Saddleback College on June 8th – 24th to find out for yourselves!

Dates:  June 8, 9, 15, 16, 22, 23 at 7:30pm and June 10, 17, 24 at 2:30pm.

Turn the far left’s Old Faithful into a Nightmare

Annoy a leftist, point to Senator Rubio’s version of the Dream Act

Posted By CotoBlogzz

Rancho Santa Margarita, CA –  If you think of Wyoming when someone utters the words Old Faithful, you may not realize that there is a Geyser in Calistoga, California that erupts with reliable frequency, but not as reliably as the far left’s use of the race card.

For years, the far left has been using  the DREAM Act and  the mostly far left & hyphenated media has not only bought the message, but it also continues to amplify it.  Take for instance the headline leading up to the 2010 election:   WHILE SENATOR REID PROMISES DREAM ACT VOTE IN 2010, REPUBLICAN SENATORS PRESS FOR MASS DEPORTATION

The Far Left's Old Faithful is not in Yellowstone, Calistoga, CA  or Wyoming

The article goes on to say:  “… an interview yesterday with Univision’s Jorge Ramos, Senate Majority Leader Harry Reid (D-NV) said that he would bring the DREAM Act to a vote in the “lame duck” session after the midterm elections, regardless of the election results. Meanwhile, Republicans on the Senate Judiciary Committee sent a letter to Homeland Security Secretary Janet Napolitano asking how much it would cost to implement their mass deportation strategy”

The DREAM Act (acronym for Development, Relief, and Education for Alien Minors,) first introduced in the Senateon, 2001, by Dick Durbin and Orrin Hatch  would provide conditional permanent residency to certain illegal aliens who graduate from U.S. high schools, arrived in the United States as minors, and lived in the country continuously for at least five years prior to the bill's enactment.

Now, the mostly left Wing and Hyphenated media with a target market of the  dependent, apathetic and or as the President's  might say, stupid electorate, is well versed at using weapons of mass disinformation to manipulate the electorate, including  the use of the race card. We continue to make the argument that If there is any   intellectual integrity left at NBC/CBS/CNN their entire executive staff should be fired, for the Travon  Martin case, exploiting the race card, for example.  Remember Meg Whitman’s NannyGate?

If you advertise here, you are aiding and abetting trademark infringement

Consider for example the recent movement by the far left to have the term  ‘illegal’ immigrants fit the  definition of a hate crime and  instead use the term "potential new tax contributor ."  even organizations like   The Society of Professional Journalists have jumped on this latest bandwagon!

Never mind that the President and the Democrats controlled the White House, the House AND the Senate, yet failed to advance the DREAM Act ball.

Why?  Because the unresolved issue is more valuable to the far left, as it enables the radical left to paint the GOP as racists and Hispanic-phobic.  Worse, the Hispanic community keeps falling for the Charlie-Brown act every election cycle.  Sadly, it is not only the Hispanic community that allows itself to be manipulated, but also a good number of voters on the right, fall on the same  trap responding with divisive language, such as the one exploited by America’s Voice.com.

But now, the Far Left' and the Mostly Far Left & Hyphenated Media’s  DREAM Act may be turning into a nightmare:  Senator Marco  Rubio (R-FL) has been working on his  version of the DREAM Act, and the far left is not happy.  “One of the things that has already been documented is that the White House  been calling in DREAM Act advocates and asking them, almost ordering them, not to work with me on this issue,” said Sen  Rubio  in a radio interview earlier this month.

For those who may view the Hispanic community as a homogenous voting block, consider that a recent Pew Hispanic survey found that nearly four decades after the United States government mandated the use of the terms “Hispanic” or “Latino” to categorize Americans who trace their roots to Spanish-speaking countries, that these terms still haven’t been fully embraced by Hispanics themselves.   The survey also supports our continued argument that the GOP should not pander to the Hispanic community, It’s the Brand, Stupid:

Hispanics believe learning English is important. Nearly nine-in-ten (87%) Hispanics say adult. Hispanic immigrants need to learn English to succeed in the U.S.

Hispanics, more so than the general public, believe in the efficacy of hard work.

On some social issues, Latinos hold views similar to the general public, but on others, Latinos are more conservative. Virtually identical shares of Latinos (59%) and the general public (58%) say homosexuality should be accepted by society. However, on abortion, Hispanics hold a more conservative view than the general U.S. public—half (51%) of Hispanics say it should be illegal in most or all cases, compared with 41% of the general public.

Religion is more important in the lives of immigrant Hispanics than in the lives of native-born Hispanics. Nearly seven-in-ten (69%) immigrant Hispanics say religion is very important in their lives, compared with half (49%) of U.S.-born Hispanics. Among the general population of the U.S., 58% say religion is very important in their lives

Conclusion:

As the 2012 election approaches, we continue to argue that the far left and the President have a good chance at a second term for four reasons:

  1. The Mostly Radical Left and Hyphenated Media have a vested interested in the status quo
  2. The media’s target market:  Dependent, apathetic and or stupid electorate
  3. Class warfare.
  4. The GOP’s failure to have a credible response to charges of racism.

Like it or not,  the results of the 2012 will ultimately be decided by the Hispanic vote, homogenous or not.  A sure way dismantle the Far Left’s stranglehold on the Hispanic voting block and neutralize its use of WMD while having fun, is if you annoy a leftist by pointing to Senator Rubio’s version of the Dream Act, AND  if the GOP remembers that It’s the Brand, Stupid!

Death of Globalization will Shatter China

The populist movement sweeping the world is a direct threat to China as globalization’s biggest winner. A rebellious tone has swept the world with the Arab Spring, Socialist victories in France and Greece, Argentina nationalizing oil assets, Indonesia imposing a 50% tax on mineral exports and the Occupy movement here in the U.S. All these events demonstrate rejection of globalization’s faith in supra-state institutions such as the European Union, the World Trade Organization, International Monetary Fund and the G8. This upheaval represents a new rise of nationalism and an enormous rejection of China as the world’s biggest exporter.

Early last week, China Daily reported the nation’s foreign-exchange reserves had actually dropped from February to March by $4.69 billion, “dragged down by short-term capital outflows.” The Chinese authorities publicly announced that the banking reserve ratio would be lowered to allow banks to expand lending by $63 billion. But the influential Stratfor Global Intelligence blog reported China’s four largest state-owned banks slashed lending by 99% in the first two weeks of May as bank deposits fell 16% in April and continued to fall in May. This may explain why Chinese buyers have been defaulting and deferring coal and iron ore deliveries.

Under the international rules of globalization, Chinese state-owned-enterprises (SOEs) are required to honor their purchase commitments, especially as prices fall. But back in August of 2009, China's State-owned Assets Supervision and Administration Commission (SASAC) told the six foreign banks that provide over-the-counter commodity hedging services that SOEs reserved the right to unilaterally default on contracts. An SASAC official was quoted “as saying that almost every SOE involved in foreign exchange or trade had some exposure to derivatives such as crude oil, non-ferrous metals, agricultural commodities, iron ore and coal, although only 31 SOEs were licensed to do so.” According to one European coal trader, after Chinese traders defaulted on at least six thermal coal cargoes they were being re-offered at a discount. He added: “That doesn't even take into account the losses on freight rates. So rather than being bankrupted by these deals, they would rather dishonor the contract to survive.”

The IMF in 2000 identified four basic aspects of globalization; trade and transactions, private capital and investment movements, migration and dissemination of knowledge and technology. China’s communist leadership positioned the nation to win in this new era by welcoming unlimited amounts of foreign direct investments, but closing its capital account to prevent Chinese citizens from investing overseas. Consequently, two thirds of Chinese wealth ended up as deposits in state-owned banks at low interest rates. Chinese banks leveraged these deposits by a factor of 45 times to funding the growth state-owned-enterprises, regardless of profitability.

China’s industrial capacity has far outstripped China’s ability to consume the goods those plants produce, in order to maximize employment of impoverished Chinese peasants. When the Great Recession began in 2007, the Chinese were already spending an exorbitant 42% of GDP on capital investments. Instead of trying to rebalance the economy by encouraging domestic consumption, banks threw good money after bad to push the investment rate to 48% of GDP in 2010. Commodity prices vaulted as the rapid growth of manufacturing capacity made China the world’s biggest consumer of iron ore, coal and other base metals.
The huge monetary stimulus led to an over-heating of the economy, because productive investment opportunities were already non-existent. “Free money” fueled wide-spread inflation and powered a speculative real estate bubble. Chinese wages rose so dramatically that labor costs are now cheaper in Vietnam, Bangladesh and even Mexico consequently; Chinese exports are under heavy price pressure. Now with faltering global demand, financially overextended Chinese businesses are only surviving because bank loans have been refinanced and rolled-over.

The economic theory behind globalization argues that China should go through an extended period of austerity and let business bankruptcies create higher unemployment to drive down wage costs and allow Chinese companies to be more price-competitive. But according to Stratfor, “The Chinese government has made limiting unemployment a fundamental policy objective. Unemployment will lead to social instability and the Chinese Communist Party understands its consequences better than anyone. Unemployment was one of the engines that fueled their rise to power.”

The populist rebellion is a rejection of China’s globalization strategy which only benefits China. Beijing’s massive stimulus program over the last three years has only exacerbated the trade imbalance between China and the rest of the world. The imminent break-up of the European Union and the fading support for the World Trade Organization means nation-states will increasingly be retaliating against Chinese imports by building trade barriers. As exports shrink and unemployment rises, China’s stability will shatter.
