Roving DUI Saturation Patrols Scheduled for this weekend

Santa Ana, CA - The Orange County DUI Task Force known as the "Avoid the 38," will be out in force this weekend.  The "Avoid the 38" is a Multi-Agency DUI Task Force  established by local and state police in response to the staggering deaths of previous years caused by drivers under the influence of alcohol and or drugs.

Roving DUI Saturation Patrols are planned this weekend in the cities of Costa Mesa, Cypress, Garden Grove, Irvine and La Palma as well as the Sheriff’s South Contract Cities as part of the Task Force’s ongoing efforts to lower impaired driving. The DUI Patrols will be working Friday, October 29 through Sunday, October 31.

The Task Force reminds the public that nighttime is an especially dangerous time to be on the road, but Halloween weekend is often one of the deadliest times of the year for impaired drivers. According to the CHP’s Statewide Integrated Traffic Reporting System, 16 individuals died and 417 were injured on Halloween in Alcohol Involved Collisions during the past five years.



The Avoid 38 Task Force (http://www.stopimpaireddriving.com)   recommends:

  • Plan a safe way home before the festivities begin
  • Before drinking, designate a sober driver
  • If you’re impaired, use a taxi, call a sober friend or family member, or use public transportation
  • If you happen to see a drunk driver on the road, don’t hesitate to call 911
  •  Friends Don’t Let Friends Drive Drunk. If you know someone who is about to
  • drive or ride while impaired, take their keys and help them make other arrangements to get to
  • where they are going safely

We will add our two cents to the Task Force recommendations:  Whether drinking or not, do not text while flying, otherwise what you see below is highly likely!

Orange County Style Justice - Woman faces 19 years for DUI-Related Deaths

SANTA ANA, CA  - Jessica Lynn Shekell was convicted today for killing two sisters and injuring their two nieces by crashing head-on into their vehicle while driving the wrong direction on the freeway, according to the Orange County District Attorney's  Office

Shekell, 22, Anaheim, pleaded guilty to two felony counts of vehicular manslaughter with gross negligence while intoxicated, one felony count of driving under the influence of alcohol causing bodily injury, one felony count of driving with a blood alcohol level over .08 percent causing bodily injury, and sentencing enhancements for causing great bodily injury. Shekell faces a maximum sentence of 19 years and eight months in state prison.


Consider that  Trevor Mark Coffman,  convicted of causing a high-speed freeway crash, killing two elderly passengers and severely injuring their elderly driver, is  expected to be sentenced to four years in state prison at his sentencing hearing Jan. 7, 2010, while  Hope-y, Change-y Judge Robert Fitzgerald  gives treatment to DUI driver who kills pedestrian in Hit& Run Incident and  Andrew Gallo convicted  of DUI-related three counts of second-degree murder in the death of Angels rookie Nick Adenhart and two other people in April 2009 faces  up to 50 years in state prison when he is sentenced on Dec. 10.  What is wrong with this picture? 

On Oct. 25, 2009, Shekell consumed several alcoholic beverages at two bars in Placentia while out with friends. At approximately 2:55 a.m. on Oct. 26, 2009, Shekell drove while under the influence of alcohol the wrong direction eastbound into oncoming traffic on westbound State Route 91 (SR 91) in her Toyota pick-up truck near Gypsum Canyon Road. Two California Highway Patrol officers observed the defendant driving 50 mph the wrong direction and initiated a traffic break on the freeway in order to stop Shekell's car. 

As the officers exited SR 91 and re-entered the freeway heading westbound to attempt to stop the defendant, Shekell crashed head-on into a Chevrolet pick-up truck driven by 49-year-old Sally Miguel. Sally Miguel, her 30-year-old sister Patricia Miguel, and their nieces, 15-year-old Mary Miguel and 11-year-old Sara Miguel, were driving home to San Bernardino after spending the evening together at Knott's Berry Farm. 

Shekell's vehicle and the victims' vehicle were totaled. Sally Miguel was pronounced dead at the scene. Patricia, who was riding in the front passenger seat, was transported to Western Medical Center, where she was pronounced dead shortly after 4:20 a.m. Shekell caused the crash that resulted in the blunt force injuries that killed both victims. Mary and Sara Miguel were also transported to the hospital to be treated for internal injuries they had sustained in the crash.

Shekell was transported to the hospital and treated for facial trauma and fractures to her arms. Approximately 45 minutes after the crash, Shekell had a blood alcohol level of .26 percent.

Treasury looking to hire Freedom of Information Act officers to help it find ways to withhold information from release to public'

The Freedom of Information Act (FOIA), signed into law by President Lyndon B. Johnson on September 6, 1966 allows for the full or partial disclosure of previously unreleased information and documents controlled by the United States Government. The Act defines agency records subject to disclosure, outlines mandatory disclosure procedures.  

Now the Treasury department is hiring FOIA officers to help it find ways to withhold information from release to the public meaning that the parasitic bureaucracy OFS,  tasked with overseeing the Troubled Asset Relief Program (TARP,) is trying to hire people who will withhold information from release to the public.

Turns out that the headhunting firm Phacil used to find the loophole eagles are President Obama’s darlings and  “commended at the White House during National Small Business Week for being selected the SBA New Jersey State Small Business Persons of the Year.”





Perhaps we should apply for the position, as we know a number of loopholes as described in the piece titled California's Public Records Act - Its the Loopholes Stupid

In California FOI IS known as the Public Records Act (PRA) or  Government code 6250  - it stipulates that, the Legislature, mindful of the right of individuals to privacy, finds and declares that access to information concerning the conduct of the people’s business is a fundamental and necessary right of every person in this state. I defines “writing” as meaning  any handwriting, typewriting, printing, photostating, photographing, photocopying, transmitting by electronic mail or facsimile, and every other means of recording upon anytangible thing any form of communication or representation, including letters, words, pictures, sounds, or symbols, or combinations thereof, and any record thereby created, regardless of the manner in which the record has been stored

In the aforementioned piece, we describe our PRA experience with various government entities including The California Law Revision Commission, The Orange County Sheriffs Department, The California Department of Fish and Game, The Orange County Transportation Authority and practices used to withhold information from the public in diametrically opposed to the sprit and the law of Code 6250

Now we have the city of Rancho Santa Margarita:  On October 20, 2010, we filed a PRA request with the City of Rancho Santa Margarita asking for a  breakdown of council members/ vote to adopt parasitic bureaucracy LAFCO’s recommendations to include at least the communities of Coto de Caza and Las Flores in the city of Rancho Santa Margarita’s  sphere of influence, including recommendations made by individual council member for or against the sphere of influence concept and or annexation.  To date, no response.  While the city can still response within allowed deadlines, we are concerned it will try to hold of any and all information after the elections, given that Tea Party-like candidate Jesse Petrilla is dead set against LAFCO’s recommendations.

Billoti & Adams charged with murder in Huntington Beach Park

SANTA ANA, CA  - 
Billoti & Adams have been charged with murdering a man in a Huntington Beach park after setting up a meeting to return a stolen cell phone. Marissa Star Bilotti, 19, Huntington Beach, is charged with one felony count each of murder, first degree residential robbery, and first degree residential burglary. Derek Christopher Adams, 22, Huntington Beach, is charged with one felony count each of murder, first degree robbery, and aggravated assault with sentencing enhancements for the personal discharge of a firearm causing death and the personal use of a  firearm, according to the Orange County District Attorney’s office.  If convicted, Bilotti faces a maximum sentence of 31 years to life in state prison and Adams faces a maximum sentence of 57 years to life in state prison. 







 At approximately 11:00 a.m. on Oct. 22, 2010, Adams and Bilotti, are accused of going to the Newport Beach home of Cody Masher, a parolee who was dating a woman in whom Adams was romantically interested. The defendants are accused of breaking down the door and entering Masher's home to confront him and his girlfriend. They are accused of getting into a verbal argument with Masher's girlfriend and stealing money from her purse. 

Bilotti is accused of continuing to argue with the girlfriend as Adams went into the kitchen to retrieve a knife. Adams is accused of then punching and hitting Masher before stabbing him, causing a superficial wound. The defendants are accused of stealing Masher's cell phone and fleeing the scene. 

Throughout the day, Adams is accused of using Masher's cell phone to send text messages to the Masher's girlfriend. He is accused of arranging to meet Masher's girlfriend at Murdy Park in Huntington Beach to return Masher's cell phone. 

 Bilotti is accused of covering the license plate of her car and driving Adams to the park. She is accused of concealing a folding knife iand waiting in the car. Adams is accused of being armed with a firearm and getting out of the car to wait for Masher's girlfriend.

At approximately 3:30 p.m. Masher's girlfriend arrived at the park with two friends, including Gregory Heintz. Heintz got out of their vehicle and began to approach Adams. Adams is accused of throwing Masher's cell phone to Heintz and then shooting him one time in the stomach. Bilotti is accused of removing the cover from her license plate and the two defendants are accused of fleeing the scene.

Witnesses wrote down the defendant's license plate number and called 911. Huntington Beach Police Officers quickly located the defendant's car and pulled them over.  The defendants are accused of having a firearm in their vehicle when contacted by police and were arrested at the scene. 

Heintz was transported the hospital and died shortly thereafter. 

Senior Deputy District Attorney Sonia Balleste of the Homicide Unit is prosecuting this case.

No Good Dead Goes Unpunished: Brother & Sister Act Charged with DNA related Murder in Door-Door Salesman Pretense

SANTA ANA, CA  - Alejandro and Gladys Romero, brother and a sister have been charged with the robbery and murder of a Santa Ana man by gaining entry into his home by pretending to be fruit salesmen.

The Romero siblings, 33, both of Santa Ana, are each charged with one felony count of special circumstances murder during the commission of robbery, kidnapping, and burglary with an additional sentencing enhancement for the personal discharge of a firearm causing great bodily injury and death, according to the Orange County District Attorney’s Office.  




On June 5, 2000, Gladys Romero is accused of posing as a door-to-door fruit saleswoman and gaining entry into Juan Gomez's home by asking for a glass of water. Once inside, Gladys Romero is accused of opening the door to allow her brother, Alejandro Romero, to enter the victim's home. Both defendants are accused of being armed with firearms. 

The defendants are accused of tying up Gomez and his family in the living room of the home. Gomez struggled and was able to break free from his ties. Alejandro Romero is accused of struggling with Gomez and shooting the victim. Gladys Romero is accused of then shooting Gomez when he was on his knees. The defendants are accused of stealing a purse and fleeing the scene. Gladys Romero is accused of leaving her own purse at the scene.

Gomez died at the scene. His family freed themselves and called the Santa Ana Police Department (SAPD), who investigated this case. SAPD Crime Scene Investigators collected DNA evidence at the scene. 

The case remained unsolved and without a suspect for 10 years. On Sept. 30, 2010, DNA taken from Gladys Romero on a misdemeanor conviction was linked to DNA that was taken from her purse left at the murder crime scene. The DNA evidence along with witness statements connected the defendants to the case.

SANTA ANA, CA  - Trevor Mark Coffman, driving under the influence of alcohol and marijuana was convicted today of causing a high-speed freeway crash, killing two elderly passengers and severely injuring their elderly driver, according to the Orange County District Attorney's (OCDA) office.

Coffman, 38, Laguna Niguel, pleaded guilty to the court to two felony counts of vehicular manslaughter with ordinary negligence while intoxicated with a sentencing enhancement allegation for causing great bodily injury to an elder. He is  expected to be sentenced to four years in state prison at his sentencing hearing Jan. 7, 201.  Compare the sentence to the one adjudicated by  Hope-y, Change-y Judge Robert Fitzgerald who gives treatment to DUI Driver who kills pedestrian in Hit& Run Incident or Andrew Gallo convicted  of DUI-related three counts of second-degree murder in the death of Angels rookie Nick Adenhart and two other people in April 2009 facing  up to 50 years in state prison when he is sentenced on Dec. 10.  Seems like the Orange County Justice is a function of the the victim's prominence.  That is, if the victim is famous, the defendant is punished the most.

On March 15, 2007, 76-year-old Sally Lee Howd and her 82-year-old husband Frank Howd were returning home with 72-year-old Catherine Malloy, a visiting friend whom they picked up from Los Angeles International Airport. They were driving southbound in the carpool lane on Interstate 5 and collided with a black Toyota Celica, which was disabled with no emergency signal lights on the freeway south of El Toro Road. 


In the evening of March 15, 2007, Coffman consumed several alcoholic drinks following a recreational softball game. At approximately 11:20 p.m., the defendant drove southbound on Interstate 5 while intoxicated in his pick-up truck with a friend in the passenger seat. Coffman failed to stop due to his intoxication and crashed into the victims' Volvo, which was disabled as a result of the earlier collision. Witnesses called 911. 


Coffman killed passengers Malloy and Frank Howd and severely injured driver Sally Howd. Malloy was pronounced dead at the scene. The two other victims were transported to the hospital to be treated for their injuries. Frank Howd suffered internal injuries and a broken pelvis and died the next day from multiple traumatic injuries that were caused by the crash. Sally Howd sustained a skull fracture, broken ribs, and cuts to her face.


When contacted by police at the scene, Coffman displayed objective signs of intoxication including impaired balance and coordination, watery eyes, and an odor of alcohol on his breath. The defendant had a blood alcohol level of .10 percent and tested positive for marijuana. Coffman was arrested after being transported to the hospital and treated for a broken collar bone and scratches.

Rancho Santa Margarita, CA :  The President of the United States is in Southern California today  in what is characterized as a  Chile Mine Rescue Mission-like effort to rescue the political careers of political lifer Jerry Brown and Madame Boxer also known as Senator Boxer.

Part of the reason for using the term Chile Miner Rescue is that it is laser-focused, Herculean and requires use of specialized glasses:  The thought is that a successful Brown/Boxer rescue, can assist The Witches of the West in ObamaLand,  with the successful transformation of Hopey & Changey into  the Seven Dwarfs: Deafy, Dizzey, Wheezy, Whiny, Whoppy,  Grumpy and Dopey.  Although we understand that Whoppy has left the room and may be replaced by Whiny.

Earlier this week, Vice President Joe Biden headlined a fundraiser in San Francisco.  Joe Biden is on his way to California to host a high-dollar fundraising event in San Francisco tonight. Barack Obama will make his third fundraising visit to California on Friday to pump even more money into Barbara Boxer's campaign bank account. And last night, Barbara Boxer's campaign released a radio ad recorded by Barack Obama.

Those using standard vision and opposed to Hopey and Changey  in the first place, may take comfort that the President’s track record is not very good at 0-4

Bean Counters Charged in $1.5 Million Check Processing Scam

SANTA ANA, CA  - Maria Yarris and Eric Wayne Helgem,  Chief Financial Officer (CFO) and accountant respectively,  have been charged with stealing over $1.5 million from their employer by processing over 800 unauthorized checks to themselves, according to the Orange County District Attorney's (OCDA) office.

Yarrish, 40, Buena Park, is charged with 40 felony counts of computer access and fraud. Co-defendant Eric Wayne Helgemo, 50, Vista, is charged with 38 felony counts of computer access and fraud. Both defendants face sentencing enhancements and allegations for property damage over $1.3 million, causing loss over $100,000, and aggravated white collar crime over $100,000. If convicted, Yarrish faces a maximum sentence of 37 years in state prison and Helgemo faces a maximum sentence of 35 years in state prison. The defendants are being held on $1.5 million bail and are required to prove that bail money is from a legal and legitimate source.

In August 2000, Yarrish is accused of being hired as a human resources representative for Pacific Polymers, Inc., a chemical sealant company. In January 2002, Helgemo is accused of being hired by the same company as the Vice President and CFO. Helgemo directly supervised Yarrish.

Yarrish is accused of having the responsibility of processing employee timesheets using a computer payroll and paycheck system. Helgemo, who prepared financial reports for the company owner, is accused of having the responsibility of reviewing the weekly payroll and paycheck reports upon completion by Yarrish.

Between 2003 and 2008, Yarrish and Helgemo are accused of stealing over $1.5 million from Pacific Polymers by processing between one and 11 fraudulent paychecks per pay period for the two defendants. Helgemo is accused of taking 593 fraudulent payments amounting to over $1.1 million. Yarrish is accused of taking 229 fraudulent payments amounting to over $340,000. The fraud went undetected for several years, as Helgemo was entrusted to monitor Yarrish's work.

In June 2008, Pacific Polymers was sold to Illinois Tool Works, Inc. (ITW) and the defendants' jobs were subsequently eliminated. The theft was discovered after the purchase by ITW during an audit of Pacific Polymer's finances. The case was investigated by the Garden Grove Police Department.

Deputy District Attorney Marc Labreche of the Major Fraud Unit is prosecuting this case.

Hope-y, Change-y Judge Robert Fitzgerald Gives Treatment to DUI Driver who kills pedestrian in Hit& Run Incident

SANTA ANA - While a
 California jury convicted Andrew Gallo of DUI-related  three counts of second-degree murder in the death of Angels rookie Nick Adenhart and two other people in April 2009 and, faces up to 50 years in state prison when he is sentenced on Dec. 10, The Honorable Judge Robert Fitzgerald gives treatment to Shana Lynne Calderon.


Shana Lynne Calderon  was sentenced yesterday to one year in a residential treatment program in lieu of jail and three years of formal probation for hitting a pedestrian and fleeing the scene, resulting in the victim's death one week later, according to the Orange County District Attorney's (OCDA) office.






Calderon, 21, Newport Beach, pleaded guilty to the court Aug. 13, 2010, to one felony count of hit and run causing death, one misdemeanor count each of driving under the influence of alcohol and/or drugs, driving with a blood alcohol level of .08 or more, possession of controlled substance paraphernalia, and driving without a valid license. At the time of Calderon's plea, the DA objected to the court's offer of jail and probation, arguing for a state prison sentence. 

At approximately 1:30 a.m. on Dec. 12, 2009, Calderon was driving in her white 1995 Ford Explorer southbound on the California State Route 55 as it turned into Newport Boulevard in Costa Mesa. The victim, 29-year-old Michael McLaughlin, stepped into the street as Calderon moved into the right hand turn lane and hit the victim at the intersection of Newport Boulevard and 19th Street. The defendant struck the victim causing him to hit the windshield and fly into the street. Calderon parked her vehicle nearby, walked to the scene, and spoke to a witness at the scene. Calderon and her passenger then fled the scene. The victim was transported to Western Medical Center in Santa Ana, where he died a week later due to blunt force trauma caused by the crash.

Approximately two hours later, Calderon turned herself in to the Costa Mesa Police Department. Calderon displayed objective signs of intoxication including bloodshot and watery eyes, flushed face, slurred speech, and a strong odor of alcohol on her breath. At the time of her arrest she was in possession of two hollowed-out pen containers used to ingest prescription drugs. At the time of the crash, Calderon was driving without a valid driver's license.  

Deputy District Attorney Jason Baez of the Homicide Unit prosecuted this case.

California Joins Multi-State Coalition to Protect Homeowners Facing Foreclosure

SAN FRANCISCO - Attorney General Edmund G. Brown Jr. announced today that California has joined a coalition of demagogues including 49 attorneys general in a Freddie Mac, Fannie Mae look-alike contest billed as “ a multi-state effort to demand that lenders find solutions to serious and potentially widespread problems in the foreclosure process across the country.  - In other words, these homeowners are the same ones Freddie Mac & Fannie Mae encouraged to live beyond their means – then had to foreclose – now they will be allowed to continue to live in the same homes, without having to pay anything.



"While California continues its own vigorous efforts to ensure that homeowners facing foreclosure are treated fairly and lawfully," A byproduct of Brown’s “fair justice,” is that he gets to produce yet one more ad telling California’s how he is fighting for re-distribution of wealth.  Although his actions will force the mortgage industry to shed even more jobs, it will create thousands of new attorney jobs who will try to seize the property from the banks and give them to the homeowners who could not pay in the first place – gratis. 

On Friday, Brown called on all lenders in California to halt foreclosing on California homes until they can demonstrate that they are complying with state law.

Bank of America announced on Friday that it was temporarily halting foreclosures nationwide. 

The multi-state group will review how lenders verify foreclosure documents nationally.  Other than this, not sure what else the group will do other than to use it as collateral material for mid-term elections. The group was formed after several lenders and loan services admitted that officials, dubbed "robo-signers," had vouched for the accuracy and completeness of foreclosure documents without reviewing them.

AG Files $60 Million lawsuit Against Loan Modification Audit Scam


Sacramento, CA -  --California's Attorney  General (AG) Edmund G. Brown Jr. today filed a $60 million lawsuit against  US Loan Auditors, My US Legal Services, the three owners: attorney and real estate broker James Sandison, Jeffrey Pulvino, and Shane Barker, as well as two California attorneys, Sharon L. Lapin and Jonathan G. Stein, who  lured desperate homeowners with a deceptive marketing scheme that promised to obtain mortgage modifications through the use of computer-generated "forensic loan audits."  The suit demands civil penalties, restitution for victims, and permanent injunctions to keep the companies and other defendants from fraudulently marketing forensic loan audits and legal services of little value. 



The companies, based in Rancho Cordova, work together to market and sell "forensic loan audits" to homeowners, who pay thousands of dollars in up-front fees for a dubious computer-generated review of their mortgages. The audits purport to show violations of law by lenders, which sales agents cite to convince homeowners they have a strong legal case. Sales agents use these findings to encourage homeowners to stop making their mortgage payments and instead pay additional fees to bring "predatory lending" lawsuits against their lenders, according to the AG.

Both companies deceive homeowners by assuring them that filing these lawsuits will give them "legal leverage" to obtain a loan modification and prevent lenders from foreclosing or collecting monthly mortgage payments. Homeowners who filed these lawsuits have lost thousands of dollars and placed themselves in greater danger of losing their homes. 

My US Legal Services bilks clients for months, filing cookie-cutter complaints with little or no merit, billing unjustified monthly fees, and then dodging clients' phone calls or stringing them along with false assurances that a settlement is in progress. 

Hundreds of California homeowners, many of them facing possible loss of their homes, have been duped into paying thousands of dollars to the two companies -- one homeowner paid more than $55,000 -- but received little or no relief.

Meanwhile, the litigation mill run by My US Legal Services has littered courts with hundreds of lawsuits that have scant chance of success. Two federal judges have expressed concern about the legitimacy of these lawsuits and have several times sanctioned attorneys involved.
