Communicating with Homeowner Association Board of Directors

By design, a HOA/CID board of directors has a fiduciary responsibility to engage in public discourse with residents in issues dealing with association affairs: with supporters as well as critics.

Denying this right to certain homeowners, or placing restrictions, such as, “do not send copies to the CotoBuzz Journal” as was done by certain members of the Coto de Caza Board of directors, or the unilateral policy articulated by Robert Miller, GRF president, “as president of GRF, my policy is not to respond to matters conveyed to me by email. Please write a formal letter to me and I’ll make every effort to satisfactorily respond to the matter”, or even the case of a hand-delivered letter to the (GRF) finance committee on 7/31/2007 by representatives of the Resident’s Voice, with a promise from the finance committee to respond as of January 8, 200, there has not been a response) is as best capricious, at worse a breach of fiduciary responsibility.

Interestingly enough, the first recorded use of homing pigeons used to send a message was circa 776 BC. The message was to announce the winner of the Olympic Games to the Athenians. In 59 BC Julius Caesar keeps people informed with handwritten sheets and in 1850, Paul Julius Reuter sposcthe opportunity to speed up news between Brussels and Berlin by using homing pigeons to bridge the gap in the telegraph.



In the Information Age, the CID/HOA board of directoms have spotted the opportunity to delay responding to stakeholder’s queries by seecting the slowest and less reliable method of communication at best, or ingoring residents altogether.





Curiously, the last time we check the Civil Code, section 1350.7 allows for documents to delivered by one or more of the following methods:



(1) Personal delivery.

(2) First-class mail, postage prepaid, addressed to a member at the address last shown on the books of the association or otherwise provided by the member.

(3) E-mail, facsimile, or other electronic means

Free Concerts at Saddleback College

January 24, February 14, March 27, April 24 and May 8



The Music Department at Saddleback College presents Concert Hour, a variety of individual and ensemble performances on Thursdays from Noon to 1 p.m. in Fine Arts Room 101. Admission is free.

Songs of Love and Loss on January 24. Soprano Eileen O’Hern and Saddleback faculty member Norman Weston perform two song cycles about love and loss. Also included in the program are Robert Schumann’s Frauenliebe und Leben and Mr. Weston’s September Songs set to texts of Dorothy Parker.


Duo-Piano Recital on February 14. Saddlback music professor Dr. Rebecca Rollins joins her duo-piano partner, Dr. Robert Sage, music professor at Azusa Pacific University in a dynamic two-piano concert.


The Medium on March 27. Gian Carlo Menotti’s The Medium will be presented in concert with members of Saddleback College ’s Vocal Music Program under the direction of Dr. Scott Farthing. This one hour long, two act opera was first presented by Columbia University in 1946 and is the story of Madame Flora and a dark incident that occurs during one of her fraudulent séances.


Music and the Politics of Oppression on April 24. Each generation of performing artists is influenced by the environment surrounding their creative activities. Some careers change and flourish, while others languish in exile. How composers, writers and performers responded to oppression from within the United States during the 20th century is be the topic of this concert hour. Dr. Carmen Dominguez gives a pre-concert lecture on the guiding theme of the next Symphony Orchestra performance.


Saddleback Music Students in Recital on May 8. Voice, instrumental, piano and jazz students perform in recital. Come and show your support for these aspiring musicians.


Saddleback College is located at 28000 Marguerite Pkwy in Mission Viejo , just east of Interstate 5 at the Avery Parkway exit. Parking is available in Lot 12. Take Avery Parkway to Marguerite Parkway turn left to the second traffic light, which is Saddleback’s Marguerite entrance. Turn right into the campus and take the second left to “ Theatre Circle ,” turning right into Lot 12.
The Music Department has established a comprehensive program which is considered to be one of the finest in California : a complete lower-division curriculum for transferring music majors, numerous performance groups, private and group lessons, a full concert series with faculty and guest artists, and general music courses. The nationally recognized faculty is dedicated to performance and to teaching in all areas such as vocal, instrumental, jazz, guitar and piano. Other music classes include harmony, musicianship, composition, history and appreciation of western art music, rock, jazz and world.

J. Randall Ismay, Laguna Niguel resident investigated for sexual abuse of minors

According to the Orange County Sheriff’s department, On Tuesday, January 8th, members of the FBI’s SAFE Task Force and the Orange County Sheriff’s Department served an arrest and search warrant on Ismay’s residence.

In the process, agents discovered evidence that Ismay may have sexually assaulted a yet to be determined number of minor and adult males.

Anyone who has had contact with Ismay in the recent past or knows of individuals who may have had contact with Ismay is encouraged to contact the FBI’s Orange County SAFE Task Force @ (714) 245-2576.

Hiring Service Providers Not a laughing matter – Babysitter gets 25 to Life for murder

Sunyhe Choi, 32, Irvine, was convicted by a jury October 2, 2007 of murder and child abuse causing death. Choi, a babysitter was sentenced today to 25 years to life in prison for murdering her eighbor's 9-month-old baby girl, whose parents she mat at church. Choi is married and has a 4 year old child.
On August 1, 2005 at about 3:30 p.m., Choi called her husband for help while she was taking care of baby Nicole. Choi's husband came home and called 9-1-1 approximately nine minutes later. Emergency personnel arrived to find that baby Nicole was cold and not breathing with a large red bruise of the front of her head. They attempted to revive the infant for 45 minutes while in transit and at the hospital, but Nicole was pronounced dead at the Irvine Medical Center. A week earlier, Nicole's mother noticed a bruise on Nicole, which Choi attributed to an "accidental fall."

"Baby Nicole's life was cut down by the defendant before Nicole could tell her mom what the defendant had done to her, and before she could even take her first step," stated Senior Deputy District Attorney Steve McGreevy. "The defendant refuses to accept responsibility for what she did and deserves to spend the rest of her life in prison."

The latest issue of the CZ Master association’s newsletter prominently asks the question, who is your Dely? and then anathematizes the immediate past CZ president’s allegations of a political assassination.

“Who is your delegate? Did you even know your district had a delegate? You should not only know who they are, but you should have their contact information. In return, they should have their contact information in case of an emergency”, reads the newsletter. This being the case, do you also know how many delegates RSM used in the recent launch of a pro-active emergency notification initiative a few weeks ago? Zilch, Nada, Zero?

Lessons learned? The past CZ president may be right – forget about direct democracy in Coto. Also as properly previewed by local community journalists, Coto de Caza better brace for a 2008 season of Deliverance (as in inbreeding)– as in the 1972 movie, or as in the forget about direct elections and cling to a corrupt delegate system, given that the right delegates are significantly vested in the community.

The CotoBuzz Journal continues to argue that the best way to fight resident apathy is through individual involvement. A delegate system, such as the one in Coto de Caza promotes does not fight apathy, it promotes it by concentrating information and decision making in a small group of individuals with a stake in the stats quo.

Direct popular elections will either come to CZ by a vote of our Members or court action. This is inevitable because it would be very easy to pursue a Class Action Lawsuit to make it happen striking down our current corrupt system in accordance with the spirit and intent of new California laws governing HOA’s. What judge is going to rule against democracy in favor of the same system that exists in Communist China, Cuba or Vietnam?. Joe Morabito

Your comment about Communist China, Cuba or Vietnam, reminds me that these countries also actively control the information available to their residents. Similar to the message in the newsletter which in essence says: Do not believe the past CZ president’s assertion that there was a political assassination.

Additionally, the mezgeresque argument that video taping of board meetings were terminated because of cost and lack of interest are more appropriate for the environments you suggested: The cost is a non-issue, and one of the many reasons for video taping board meetings is to battle apathy – one resident at a time! - Buzz

“MERIT CHARGES HAVE NO MERIT” - MERIT - Recently Coto de Caza Board of Directors Jerry Mezger dared insult Coto de Caza resident’s intelligence by blaming the road certification fiasco on Keystone’s predecessor, consequently neither the Sheriff, nor the CHP are allowed in for pro-active traffic patrol within Coto de Caza: “ Our streets need to be re-certified every five years with a new survey. Vista del Verde’s certification expired in December 2005 without being re-surveyed because no one (no one at Keystone nor any former Board member I’ve talked to) knew they expired on that date. The original certification was done on Merit’s watch and, if they had a tickler file (e.g. like attorneys do for patent fee renewals), it never made it over to Keystone” – Jerry Mezger April 29, 2006.

INTENSIVE VS. PENSIVE PUBLIC SAFETY: COTO DE CAZA Vs. LADERA RANCH - CZ board member, Metzger has characterized the current Coto de Caza traffic patrol as “intensive” – only after the board was coerced into bringing back the CHP – the problem is that since the association has not invested in a tickler file for its service providers, those responsible let road certification expire on all but Coto de Caza Drive – apparently making this road the more intensively patrolled street in the history of Coto de Caza!

Coto de Caza Intruder, Gate Access and the Coto de Caza Budget - Most Coto de Caza residents are now familiar with the intruder taken into custody today, alleged to be a worker at the stables.

The association is spending close to $2,000.000.00/year on private security. Something like $150,000.00 alone for printing of customized passes. The problem is that the community is not getting its money’s worth. The gate access process currently in place is the most liberal we have seen in the last 14 years – perhaps the gates should be open, as Varo/Mezgar have done with Oaknoll/Oakwood gates – much more efficient and anyone can come in and go as they please without bothering anyone, including the gate guards.

Why live in a Gated Community such as Coto de Caza? - According to the conclusion of the international conference on private urban governance, more then half of all new homes in the U.S. are guarded in some way. This might seem like a somewhat extreme reaction on the American anxiety, but the whole trend towards gated communities could actually be a good thing and a revival of the old Greek ideal of the city-state

Is Coto CAN a de facto subsidiary of the CZ Master association?

In the past, CZ board critics have argued that too close of a relationship between the CZ Master association and Coto CAN unnecessarily expose CZ residents to additional liability.

The usual suspect response from the board has been that the CZ Master is not related to Coto CAN, other than to supply some sort of subsidy, disguised as a newsletter publication fee.

The January 2008 CZ newsletter (Coto Voice) makes the issue as clear as mud. The cover page announces a “Community Safety Fair”, mostly characterized as a fund raiser for Coto CAN, including a list of the scheduled vendors to be present at such fair. The CZ president in the same newsletter extols the fair's virtues.

For close to a decade now, we have argued that the CZ board of directors should take a proactive stance anent public safety. Public Safety awareness being one of the key elements in any effective public safety campaign – a Public Safety Fair can be an effective tool, as long as it is not viewed as a “farmer’s market” - that is such fair can be counter productive, given the continuous credibility gap.

As advertised in the newsletter, the CZ Master association and Coto CAN are but the same entity – we have a lawyer’s letter claiming as much.

Some of us predicted liability for CZ when Varo/Mezger fired the CHP which was ignored and sure enough there was a serious accident that resulted in a settlement. The Association had to pay $50,000 of the deductible; but that won’t be all as our insurance rates will now be impacted. I have warned CZ Board Members to close those Oakview/Oakknoll gates in accordance with the agreement that was a condition of development because of the breach to our security and the liability that is involved and once again the Board continues to ignore this problem. I have encouraged the Board to stay clear of anything that might connect Keystone’s “Executive Director” to CZ as an employee in fact to avoid any employee practice litigation which again Varo/Mezger as big dopes ignored. Many, many times former CZ Board Members have told the current Board to stay clear of CotoCAN which was set up separately and specifically to shield CZ with our deep pockets from liability. And, of course the CZ Board under Varo/Mezger always ignored this advice. I hope that Yocham/Hylka are smarter than Varo/Mezger. Please, Please, CZ Board Members do what is necessary to maintain an arms distant relationship from CotoCAN. They are an accident waiting to happen. Oh wait, there was an accident at a CotoCAN event when the float ran over a little girl’s dancing foot. Fortunately, there was no permanent damage; but had there been, you can bet CZ would have been sued. Let us hope that Yocham/Hylka fully understand the implications of involvement with CotoCAN. Lennar knew exactly what they were doing when they set up CotoCAN as a separate entity. CZ Board Members better get the message to avoid liability for our Members. For your reference, and since according to Mezger, the CZ Master Associations does not use a Trademark Attorney with a tickler file to remind the property manager of the things it must do (like have road certification up to date) to manage the affairs of the association, the property manager needs to make sure that for each UPS employee, there is a "Guard Card" for each such employee. “MERIT CHARGES HAVE NO MERIT” - MERIT - Recently Coto de Caza Board of Directors Jerry Mezger dared insult Coto de Caza resident’s intelligence by blaming the road certification fiasco on Keystone’s predecessor, consequently neither the Sheriff, nor the CHP are allowed in for pro-active traffic patrol within Coto de Caza: “ Our streets need to be re-certified every five years with a new survey. Vista del Verde’s certification expired in December 2005 without being re-surveyed because no one (no one at Keystone nor any former Board member I’ve talked to) knew they expired on that date. The original certification was done on Merit’s watch and, if they had a tickler file (e.g. like attorneys do for patent fee renewals), it never made it over to Keystone” – Jerry Mezger April 29, 2006.

INTENSIVE VS. PENSIVE PUBLIC SAFETY: COTO DE CAZA Vs. LADERA RANCH - CZ board member, Metzger has characterized the current Coto de Caza traffic patrol as “intensive” – only after the board was coerced into bringing back the CHP – the problem is that since the association has not invested in a tickler file for its service providers, those responsible let road certification expire on all but Coto de Caza Drive – apparently making this road the more intensively patrolled street in the history of Coto de Caza!

Coto de Caza Intruder, Gate Access and the Coto de Caza Budget - Most Coto de Caza residents are now familiar with the intruder taken into custody today, alleged to be a worker at the stables.

The association is spending close to $2,000.000.00/year on private security. Something like $150,000.00 alone for printing of customized passes. The problem is that the community is not getting its money’s worth. The gate access process currently in place is the most liberal we have seen in the last 14 years – perhaps the gates should be open, as Varo/Mezgar have done with Oaknoll/Oakwood gates – much more efficient and anyone can come in and go as they please without bothering anyone, including the gate guards.

Why live in a Gated Community such as Coto de Caza? - According to the conclusion of the international conference on private urban governance, more then half of all new homes in the U.S. are guarded in some way. This might seem like a somewhat extreme reaction on the American anxiety, but the whole trend towards gated communities could actually be a good thing and a revival of the old Greek ideal of the city-state

The presidential elections are in its primeval stage, yet it has already started: Governator Arnold Schwarzenegger is proposing to hike the cost of insurance for millions of California homes and businesses in the budget he unveils Thursday.

Arguably, the most prominent supporter of President Bush’s fight against terrorism was Britain’s Tony Blair, the UK’s former PM.

Using a different type of PM, the immediate past president of the Towers (50), Richard Wurzel, recently sent a letter to all 311 resident units of the Towers strongly suggesting a holiday thank you of at least $500 per unit. The request stated that the $500 gift should be a check made out to PCM which would then distribute the funds equitably to employees who worked so hard all year.

The Governator’s plan calls for 1.25% levy on all residential and commercial property policies, with the money to be used for firefighting efforts. Perhaps analogous to the Lottery’s funds used (or not) for education – but that is a different story.

The economics of this makes sense," Gov. Schwarzenegger said, left, asserting that the new costs would be $10 a year for the average California homeowner. "Consumers and the state will end up saving money." – we understand trickle down economics. This is not trickle down economics, but pure unadulterated tax-and-spend economics.

Instead, Governator should turn to a PM to request something like $500 per household in Caleeforna – That PM would then distribute the funds equitably to fire fighters who worked so hard during the fire season.

Looking ahead to 2008 – Deliverance for Coto de Caza

2008 promises to be some sort of deliverance for Coto de Caza and the canyons – as in the 1972 movie Deliverance, a motion picture drama starring Burt Reynolds, Ronny Cox, Jon Voight, and Ned Beatty and directed by John Boorman- so appear to claim local community journalists.

The film is noted for the memorable music scene near the beginning that sets the tone for what lies ahead: a trip into unknown and potentially dangerous territory. The character Drew Ballinger plays the instrumental "Dueling Banjos" on his guitar with a mentally-challenged hillbilly youth named Lonnie, implied as being an inbred albino. The boy eventually outplays Drew with his banjo.

According to the journalists, the six issues that could face Coto de Caza and the canyons in 2008 include the fall out from the (2007) fires, a trashy reality TV show, expansion of the 241 toll road, the CZ golf club expansion, the general store revamp and the upper Chiquita reservoir. Apparently the reason for including the reality show is so that their compadres can keep busy.

There is no discussion of the up to 450% housing job cuts in the US the previous year and the impact this has on 2008. Even though a good number of Coto de Caza residents (& environs) work in the housing (and related) industry.

There is no mention of direct democracy in Coto de Caza, or whether direct democracy will die a natural death, as expressed by the previous CZ Master association board of directors president.

There is no discussion of public safety issues, even though a lawsuit filed on a DUI-related accident revealed that the CZ Master administration based their defense mostly on what previous boards had done – not what the administration did not do. Further, although the collision rate for 2007 was lower than the previous two years, the DUI collisions in the fourth quarter may bring in additional lawsuits.

The 2008 CZ budget, the lack of landscaping renovation planning or potential CZ dues increase was not touched upon.

There is no mention of the pattern of (corruption) allegations surrounding Orange County involving current and previous officials, starting with certain supervisors, Tax Collector Chriss Street, the Sheriff and former Sheriff collaborators, turned witnesses for the prosecution. Reminiscent of the recent financial collapse of Orange County, the Tax Collector continues to trade in speculative financial instruments.

Ironically, Mr. Street's association with the Treasurer's office dates back to 1994 when he and John W. Moorlach sounded the alarm on risky investments made by then County Treasurer Robert Citron. Early last month, Moody's Investors Service said it might downgrade dozens of structured investment vehicles (SIV). Twenty percent, or $460 million, of the county's $2.3 billion Extended Fund is invested in SIVs. Moorlach sought to have Street stripped of his authority to manage the county's $6 billion of investments in September amid federal and local corruption probes. He said Street was too distracted by the probes to manage the county's money. Moorlach’s response to the SIV issue? Let’s wait and see if we have a problem!

Finally, there is no mention of a presidential election, the winds of change behind Senator Barack Obama’s sails or those of Governor Huckabee.

Coto de Caza Collision Statistics 4Q2007 - was not a good quarter!

The last quarter of 2007 was chthonic anent traffic collisions in Coto de Caza. While the community enjoyed a significant dip during the third quarter, the fourth quarter recorded a total of 8 collisions, three of them DUI-related, not unlike the one that resulted in a lawsuit.

An allaying element is that the total collisions for 2007 are still lower than 2006, and even lower that the fatal 2005.
Sources tell us that a CZ board (YOH) may finally be open to a public safety awareness,



such as the one proposed by CHP’s captain Elzig- at a time when the traffic accident rate within Coto de Caza was doubling on a yearly basis the Board decided to terminate the contract with the CHP! Then, captain Elzig alluded that “accidents; could be a misnomer – implying that these could be treated instead as “traffic crimes”, since as the captain put it, “these are preventable”, and mostly a result of DUI, DWOP (driving while on the phone) or speeding. We are told that plans are underway for a community public safety awareness exhibit.

We trust said exhibit is a serious efforts effort, rather than the traffic control plan unveiled by the CZ board in April 29, 2005: Coto de Caza has traffic-patrol plan - Enclave would pay for extra Rancho Santa Margarita deputy hours to cover it. So reads a headline in the April 29, 2005 OCR. We asked the CZ board on numerous occasions to let us know what the plan entailed – we never heard from the board, and fatal results speak for themselves.

As previously reported by the OCR, the recently deposed CZ BOD president resigned because of an alleged attempt at a political assassination – but now the story seems to be taking a different twist – Apparently the former president is no longer in Keystone’s LOPR (List of prominent residents)

According to our sources, the deposed president was operating more like his predecessor – that is, using the association as a personal fiefdom. The tipping point appears to have been a stealth "meeting notice” where a hand-picked director was to have been selected, coupled with a stern warning to the general manager to “do as I say, or else”!

Perhaps like the non-existent, (which later we found) Oakwood/Oaknoll agreement, or the non-existent (existent) Keystone’s LOPR, there is a reported long list of grievances presented to the eventually deposed king, when legal counsel gave the green light

Given that the CZ board of directors and the deposed CZ president refuse to comment on the subject, he question rmains" was it political assassination, or political suicide?
