Enforcement alone is not going to solve public safety issues - OCS Hutchens

During our recent interview with newly appointed OC Sheriff Hutchens, we asked her rhetorically, why issues such as culture, budget and the flawed process used by the board of supervisors to narrow down the list of candidates dominated the public forum when talking about the OCSD instead of public safety. She was quick to point our that she would rather talk about public safety

The sheriff got her wish June 26 when she visited Cox Communications taping of Cox Forum, during which she spoke about public safety in general and the importance of not being complacent, even in a safe community, specifically, echoing a common theme heard around common interest development communities, such as Coto de Caza – resident apathy. She urged residents to remain vigilant, and have an active neighborhood watch, as compared to a complacent one that forgets about burglars once a crime has been dealt with.

During our interview, the Sheriff expressed a belief in the use of metrics as a way to manage public safety. During the Cox interview, the Sheriff said that she has not had a chance to review crime and vandalism issues prevalent in some South County communities, but she emphasized that enforcement alone is not going to solve the issues – the same point we have been making for the last six plus years.

In the interview with Cox Forum anchor Terry Wedel, Hutchens spoke about the “C” word, as in changing the OCSD’s culture. ," Hutchens said. "It's really an advantage to come in new," the Sheriff told us during our interview, and repeated again with Wedel. She also added, "I think it will be a department that will be out of the papers in terms of the negative press," . Of course, our watchdog journalistic persuasion advises us to trust but verify: We are already seeing symptoms that the Sheriff is taking an active role in controlling the message distributed to the media. After asking the Sheriff for her promised 120-day plan, we have not received a response, for instance

New OC Sheriff to Host 4th Cruise for Make A Wish Foundation

Sheriff Hutchens will be one of the volunteers t flipping pancakes for the kids


July 2, 2008


On Friday July 4, 2008 at 10:00 a.m., Orange County Sheriff Sandra Hutchens, the American Legion Newport Harbor Post 291, The American Legion Yacht Club and Electra Cruises, will co-host a pancake breakfast and harbor cruise for “Make–A-Wish” children and their families.

“Make-A-Wish” Foundation grants the wishes of children with life threatening medical conditions.

Sheriff Hutchens will be just one of the many volunteers that will be flipping pancakes for the kids and their families. “We are inspired by the work of the Make-A-Wish Foundation,” Said Sheriff Hutchens. “It’s wonderful to spend some time with these children and their loved ones and give them a chance to get away, relax and have some fun.”

At approximately 11:30 a.m. guests will board the Electra Cruise Ship at the 15th Street Public Dock to cruise the bay and view the Old Glory Boat Parade.

Debunking the theory advanced by CZ supporters who claimed traffic accidents were a fact of life in Coto

Gas prices keep going up, up, up and traffic accidents in Coto de Caza continue a downward trend that started in 2005, shortly after the two traffic fatalities and when the Coto de Caza board of directors was coerced into bringing back the CHP for traffic enforcement .



So, is there an inverse relationship between gas prices and the number of traffic accidents within Coto de Caza?



Are Coto Soccer Moms responsible for most of the traffic accidents, as previously asserted by a former member of the board of directors?



Are Coto teens mostly responsible for most of the traffic accidents, as previously asserted by another former member of the board of directors?



Looking at the data and asking the CHP, apparently the real reason for the drop in collision rate is that the "CHP and the residents are doing a great job", according to CHP's Christopher Goodwin





The second quarter of 2008 not only registered the lowest number of accidents since 2001, but also recorded the lowest number of citations per enforcement hour - 0.71 citations per hour recorded in April 2008.

The data certainly debunks the theory advanced by nay sayers and supporters of the CZ administration who claimed traffic accidents were a fact of life in Coto and because of population explosion, it would be impossible to achieve 2001 accident rate levels- which for the record, we have always claimed to be within the realm of probability. Nay Sayers even used the analogy of the number of traffic accidents in Interstate 5 close to LAX!

We asked the CHP if the significant drop in citations per enforcement hour were due to management policy, or whether Coto residents were now more safety conscious. An answer was not readily available, but Office Christopher Goodwin speculated that the "decrease is most likely due to our presence and residents being more cognizant of their driving. I believe CHP and the residents are doing a great job and we hope that traffic collisions remain at low
levels", he said.





DUIs continue to be a factor, however, albeit a decreasing one: DUI was a factor in 50% of the traffic accidents reported in the first quarter of this year, whereas for the second quarter only 33%
On the other hand, the Peter Pan Syndrome continues to be alive and thriving in Coto de Caza, as the age group of 40 years and above accounted for 28% of all the traffic citations issued in April 2008 by the CHP.

Youth Running Club Comes to Saddleback Valley

Curriculum designed for young athletes to promote health and wellness as well as the technical aspects of the sport


June 29, 2008


The Saddleback Running Club' mission is to promote the sport of cross country and distance running by providing local, young, female and male runners, 3rd - 8th grade, high quality coaching, training and administration, developing each runner individually through consistent year round practice and instruction, while fostering a team concept

Nationally recognized and award winning coach Liam Clemons and coach Dennis Kelly of Trabuco Hills High School will oversee the camp and the program, with the inaugural season kicking off August 4th 2008.

.”Our curriculum will be designed and geared towards the young athlete to promote health and wellness as well as the technical aspects of the sport. The sport of distance running is a great way to stay in shape at the same time develop skills that can help an athlete with all other sports” said Toki Rathor program director for Saddleback Running Club.


A free mini running camp will take place, July 21, 22, 23 @ THHS. Registration for the camp is free and can be completed by going to http://www.saddlebackrunningclub.com/ Registration information for the season will be available at the running camp.

Mahatma Gandhi and The United States of Obama

Mohandas Karamchand Gandhi, commonly known as Mahatma Gandhi, was not only a major political and spiritual leader of India, but also the Indian independence movement, and can be viewed as India’s Founder.

Ganhdi was a pioneer of Satyagraha—resistance to tyranny through mass civil disobedience, firmly founded upon total non-violence, and widely emulated by Dr. Martin Luther King and Cesar Chavez. In India, Ganhdi is officially accorded the title Father of the Nation. On June 15 2007, the United Nations General Assembly unanimously adopted a resolution declaring October 2 2007 to be the "International Day of Non-Violence".

Senator Obama, echoing Gandhi’s non-violence proclamation “I object to violence because when it appears to do good, the good is only temporary; the evil it does is permanent.” insists that if elected as president of the United States, he will unilateraly withdraw immediately from Iraq, and wil meet with Iran’s holocaust denier Mahmoud Ahmadinejad, as well as any other anti-west dictator, wihtout any pre-conditions. Of course, Gandhi also said, “I cannot teach you violence, as I do not myself believe in it. I can only teach you not to bow your heads before any one even at the cost of your life”.

Naturally, just like there is some concern for the Senator’s dark side, there is a dark side to the great Mahatma Gandhi, including charges that he used to beat his wife up routinely, that he was an adulterer and had a spiritual marriage with two British women, for example. Additional incidents are described in the Ruppe News website.
Last week, the Barack Obama campaign unveiled a new campaign symbol mimicking the US presidential seal. Instead of the presidential seal's "E pluribus unum" which means "Out of many, one" the Obama sign says "Vero possumus," a rough translation for "Yes, we can."

Seven principles widely attributed to Mahatma Gandhi are

Wealth without work,
Pleasure without conscience,
Knowledge without character,
Commerce without morality,
Science without humanity,
Worship without sacrifice,
Politics without principle.
May God, Laxmi, Buddha, Tlahuizcalpantecuhtli, Amitābha, Bhaisajyaguru , Maitreya, Vairocana, the Moon (Tetzahuiltl), The Earth (Texitli), Coatlicue, The Sun, the Wind, the Fire, Zeus, Apolo, or any other god out there, bless the US of O!

Whereas the United States of Obama described by Steven Huron in the Hill’s Briefing Room might look something like:

Access to abortion on demand, anytime, anyplace, anywhere
Abortion paid for by new Socialist Health Care system, run for by big government.
You could even have an abortion after the baby is 90 % born
Prepare to pay more in taxes
You hate the Iraqi War, so elect a liberal democrat, withdraw from Iraq and talk to Mahmoud Ahmadinejad about wiping Israel from the face of the earth – after all the Holocaust never happened.
Smear a presidential candidate trying to contain pork
If you think gas prices are high now, just wait until the democrats shut down every option for drilling in America,
Welcome to the New United States of Obama, where all illegal immigration is legal and where intolerance is not tolerated, all religions are not only welcome, but are foundational, and in fact, there is really no right and no wrong!

Long live the Founder of India, Long live the Founder of the US of Obama and may God, Laxmi, Buddha, Tlahuizcalpantecuhtli, Amitābha, Bhaisajyaguru , Maitreya, Vairocana, the Moon (Tetzahuiltl), The Earth (Texitli), Coatlicue, The Sun, the Wind, the Fire, Zeus, Apolo, or any other god out there, bless the US of O!

It is Official – it is Now Sheriff Hutchens to You Buster!

Now the OCSD have to contend with a self described consensus driven leader who wants to walk the talk – and she is talking loud and clear!

Sheriff Sandra Hutchens was sworn in as the 12th Sheriff of the County of Orange this morning, in a ceremony taking place on the steps in front of the Old County Court House, located at 211 W. Santa Ana Blvd, in Santa Ana.

As predictable, members of the Board of Supervisors, dignitaries, along with city and county officials, are in attendance to witness this historic event, along with unprecedented number of the members of the press.

During an interview with Sheriff Hutchens yesterday we asked her how she could manage to keep herself so calm, cool and collected - the staff surrounding her seemed as cool, but showed a lot of excitement!

She mentioned that she had started to work the minute she was named the new Sheriff by the Orange County Board of Supervisors. We suggested that perhaps she had been working much, much earlier than that. She agreed. This does not bode well for the dead wood lumbering across the OCS department, used to doing “simply what the law requires”, rather than commons sense and lots of heavy lifting.

Digressing, we previously posted that organizational culture can be viewed as the basic pattern of shared assumptions, values, and beliefs governing the way employees within an organization think about and act on problems and opportunities. Observable symbols and signs of an organization's culture include organizational stories and legends, rituals and ceremonies, language, physical structures and symbols. We used the examples of secret grand jury testimony where an Orange County sheriff's detective described a frat- house culture (see OC Register article) in the department, or a former jailed official sharing his “conquest book” – now the OCSD have to contend with a self described consensus driven leader who wants to walk the talk – and she is talking loud and clear!

Interview with Sheriff Hutchens an Utter Failure – Although Not a Waste.

The traps were perfectly laid out, the only thing required was for Sheriff Hutchens to trip and she would then have to agree to one or all of the following:



There is no 100 Days SMART Plan

There is no need to change the OSCD’s culture

The OCSD is running efficiently, hence additional safety costs more money

Political environment in contracted cities is the same as in private (CID) communities – aka as the Public Safety Orphan

There is strategy technology plan (including forensics)

The process used by the Orange County Board of Supervisors to come up with Magic Nine (number of candidates to interview), then with a “BMA score” of six, out of nine, jump to the Elite Two to finally select the new Sheriff, was severely flawed.

And the piece du resistance was to use the OJ Glove Analogy: Does the glove fit? That is, is the current OCSD organization and the Sheriff capabilities and ideal match, or a forced-fit.






Like a good cop, Sheriff Hutchens was able to disarm us with her excellent communication skills and apparent command of the issues. It is clear Sheriff Hutchens expects accountability throughout, starting from the top. She describes herself as consensus-driven transformational leader, and expect the rank and file to embrace change – those who do not will be opted out.

Although the Sheriff does not have a 100-Day plan, we are expecting to see a 120-Day plan shortly.

Given the time constraint and the “chat format”, we were unable to be as confrontational, err…. Make effective use of our watchdog journalism skills. The Sheriff knows her performance is now closely coupled to the political future of supervisors Moorlach, Bates and Nguyen. She appeared not to want to rock the boat with the OCDA’s office.

We did get to ask the Sheriff a rhetorical hypothetical question: If the initial list of candidates had included Hilary Clinton, Condalizza Rice, Carly Fiorina, General Collin Powel, who would have fared better against Sheriff Walters – Of course, the BMA matrix would have eliminated all the aforementioned with the exception of Sheriff Walters. On the other hand, we did not get to use our favorite line so far: We congratulate Sheriff Hutchens, we just hope she has not made any deals with the devil – although we hear the devil is jumping for joy!

All in all a journalistic failure – but not a waste of time – quite the contrary, a breadth of fresh air!

One More Precedent- Closing Down HOA Loopholes

Popular Elections in Coto de Caza Next?

Some Leisure World residents have been waging a battle for fiscal transparency against the local association, the Golden Rain Foundation. The loopholes used by the governing body seem to have been closed down by the California Fourth District Appellate Court, as it ruled in favor of the residents.

The decision reaffirmed a lower court ruling that the GRAF is a common interest development, such as the CZ Master Association, and it must follow state rules on governing associations, such as homeowner's associations.

State law requires that financial records of these associations must be made available to residents.

The court of appeals in publishing its decision means it will be in the casebooks and can be cited as precedent in other cases and other communities.

Uncivil Homeowners Association (HOA) Wars

The real problem for the LWV residents is the fear of retribution whether it is real or not

LWV residents are overjoyed over the recent California Fourth District Appellate Court, as it ruled in favor of the residents. But things are heating up.

According to inside sources, meetings are becoming brawls. Some board members and the managing agent and his top level employees are becoming more and more hostile and snappish. “As if they know the end is near and they are snapping and barking as furiously as they can to preserve any freedom they have left” . They are now (GRF Security committee) trying to close down access to the second floor to all residents.

According to these sources, Milt Johns (General Manager), Linda Wilson (United Board member and reckless driver), Erwin Stuller (demands to be called "Your Honor or Judge" and yet calls member "pompous ass" when addressed as Mr.), Bob Miller (GRF President) to name a few have decided that residents are dangerous and have said they personally (along with Beth O'Brien outgoing president of United) have been "threatened and attacked" by unnamed residents while on the second floor, that unnamed residents have been found sitting behind desks and going through desks, etc. and aimlessly wandering around on the second floor.

During the last GRF security committee meeting (6-19/2008) Scott Dunham, the risk manager and Katy Howe, Maintenance Administrative Services Manager gave a presentation which included the information that it is the obligation of an employer to protect employees(cited is Public law 91-596, the Occupational Safety and Health Act of 1970.) Katie Howe referred to having spoken to "our counsel" and the opinion rendered by that person yet the only referenced opinion in her report is from Hart King and Coldren which is not PCM's counsel but GRF's!!

If indeed, HKC is the counsel to whom she is referring that means that HKC is representing BOTH the housing mutuals and GRF as well as PCM , sort of like a conflict of interest

Former GRF president George Portlock spoke about the need for securing privileged information including bids under consideration and member information that is apparently just lying around on the second floor where just anybody who floats by can read and perhaps misuse information.

It is fair to say that competent security personnel cannot leave sensitive documents just lying around and the employee responsible for such documents becomes liable for the loss of information.

The ability of a contractor to underbid another was an example used by Portlock. If that's an issue here, what is the matter with the supplier management process being used, where documents are just left floating around where just anybody can see them?

However, according to inside sources, immediately after a 3rd mutual board meeting last Tuesday a member tried to secure a membership list and was stonewalled by staff on the second floor by saying it was "restricted information" . Obviously the staff is not adequately trained to understand exactly what the residents do indeed, by law, have access to. Portlock also said that there are only about 25 people who are "making trouble" in the community. “The man is still wearing blinders and has absolutely no idea about how large the grass roots organization is becoming and the anger and discontent the residents feel”, added these sources

In the same security meeting one resident stood to speak during the "community comments" period of the meeting as listed on the agenda. She was immediately interrupted by Erwin Stuller, chair, and told he "didn't have a card" from her. He was probably referring to the few index cards that had been passed out to a few of the attendees prior to the beginning of the meeting. He told people to write their questions on them. When the resident said she didn't have a card he shut her down - several residents who spoke before her also did not have "cards" and were allowed to speak - He told her she was out of order and her time was up and she had to sit down. When the resident objected firmly and loudly the chief of security, Gene Hart, left the dias (where he had been seated next to Stuller) and approached the woman in a threatening manner...Hart is at least 2 feet taller that this woman and substantially heavier than she. She was in no way physically threatening to anybody and was only demanding to be heard as the others had been. When Hart moved even closer to her and looked as though he might grab hold of her (she was telling Stuller to go ahead and have her thrown out or arrested and that that she wanted that to happen) another resident from the audience said firmly to Hart "don't you touch her." Hart backed off slightly. Stuller then called "recess" and stood beside his chair. The atmosphere was very highly charged but it calmed down and Stuller continued. It turns out that the question she wanted to ask was "How many cars do we have in Security?" Well worth the battle over such a horrifying question.

Stuller shut another resident down completely in the same manner later on using the same tactics. There was public comment at the time about the three supposed options being considered for the closing of the second floor. It is of interest to note that the third option was not published or even completely fleshed out by the person who originated the idea in the agenda package as it had only been mentioned to Stuller before the meeting began. Stuller was there only about 5 minutes before the meeting began.

One member put it very nicely when she said that this whole debacle over the second floor being closed off to residents is yet another divisive issue. She said residents should take witnesses with them when they visit the second floor. Access of all kinds is being denied residents. If the managing agent and his management staff are having difficulty with individual residents and/or employees then they should be dealt with as individuals and not tar the entire community with the same brush.

According to inside sources, “one resident was vilified by the managing agent and staff for trying to get information. The case went to court where the resident won a defamation suit. The management company’s employees were the ones who had defamed this person and tried to destroy his life, his reputation, his ability to make a living, his pension and yet not a single disciplinary action has been taken against those managers”

Board members sit on the dais and call residents names. Spouses of board members sit in the audience and call board members who oppose their other halves filthy names. Bob Miller started the last GRF meeting with a long and wandering statement about how name calling wouldn't be tolerated and at that very meeting Erwin Stuller called a resident a "pompous ass". Apparently the GRF board doesn't care to be called "good old boys" or "guys" and yet Ray Gros, GRF member called a resident "sweetheart" in the security meeting while he was being condescending to her and to the rest of the audience. The gasp that arose from the audience at that time demonstrated to him the blunder he made and he backpedalled as fast as he could blaming his "southern" roots for his faux pas.



“A third board member went into a tirade at the last board meeting using expletives and ending with "Jesus Christ" because there was, as usual under the doubtful leadership of Cynthia Connors, yet more strife and disagreement during the meeting”, added our sources. . This same member spoke twice at a recent GRF Finance committee meeting and couldn't seem to contain his expletive usage for even the two brief moments he spoke then. This same member told the third board meeting that "the duty of directors is to enhance the community and we have to spend money to enhance the community. " Obviously this man has not read the bylaws, the CC&Rs or even the Davis-Sterling act about what the responsibility of a director is. It sure isn't to "enhance the community and spend money to do so", our source added

Bob Miller and Harry Curtis (past third and GRF president) sat together at the last third board meeting and after Connors had spent over 8 minutes by the clock telling members that there would be order and discipline and she would tolerate no outbursts, side conversations, etc and that she would use her gavel often , discussed Miller's prostate, Miller's xerographic copy of pelvic x-rays and in general had a tea party that precluded anybody sitting within 20 feet of them hearing what was actually going on in the meeting. When shushed Harry Curtis turned and told the person shushing them to SHUT UP. The only person Connors gaveled was Stan Feldstein when she no longer wanted to hear his argument about an issue. Feldstein, as CotoBuzz readers may recall, was politically assassinated, prior to Connor s taking over.

Connors was called on her limit of 3 minutes per comment per director when Carol Moore, third director, reminded Connors of the rule Connors had put in place. Our sources added that “Connors denied that there was ever a 3 minute speaking rule for directors and Moore reminded her of the last meeting where secretary Larry Souza had been told to time Moore and Sousa had to agree that that had indeed happened. It's all still on the tapes of the meetings and Connors was left babbling in the wind and still pretending to be in control and in the right” When Feldstein tried to make another remark during a debate Connors interrupted him and gaveled him to silence saying that Feldstein had already been heard from and could not speak again.

The real problem for the LWV residents is the fear of retribution whether it is real or not. But many residents will express support privately but will avoid public displays of support out of fear. Where have we seen this before?

As result of the ongoing hostilities between the governing body and residents, apparently the Laguna Woods Village property management company has been asked to call the Sheriff during board meetings, “because residents are getting unruly” – Refer to incident 08-101645 logged 6/3/2008 in the OC Sheriff Blotter (You can find this report at the Orange County Sheriff's web site (http://www.ocsd.org/) by selecting "eServices" followed by "Sheriff's Blotter", then select "Laguna Woods" and the "30-Day View"”

The residents’ response to the affront, renewed calls for the firing of the property management company, along with demands for an apology to grieved residents. “PCM top management needs to be replaced now.”, reads in part a call to action,, which includes an intention to present a request to new OC Sheriff Hutchens “to investigate the Sheriff's response policy to PCM's calls like the one above, and not to allow this misuse of the sheriff's time and resources”.

Continuing, the call to action renews charges of resident intimation

Once again, GRF President Miller needs to put his hat in his hand and apologize to our community for (a) not controlling his board members (including Johns), (b) allowing Director Pompous (Stuller), Heller, and Johns' to intimidate and name call, and now (c) for allowing PCM to call the Sheriff in a further act of "senior abuse" and apparent desire to cut-off all dialog from the community.


The call to action then shines the spotlight on the local governing board

It's shameful that no one on GRF has guts enough to put a halt to PCM's out of control behavior by requesting that a replacement GM and Finance Manager be sent over from Lake Forest. Board members simply accept whatever PCM spits out as truth - too willing to believe we must have riots and owner thieves on the 2nd floor and so PCM must be protected. There is no objective evidence of residents' misbehavior on the 2nd floor - but, there is plenty relating to PCM.



The argument the concludes with what the grieved residents consider the obvious:

We are not the criminals. We are not misleading and misrepresenting those around us. We are not committing senior abuse. We are not committing white-collar crimes and having a "fraud-fest" spending our $90Million in assessments each year. Hey - WE ARE THE OWNERS of the building and everything in it - NOT PCM! We are responsible for the conduct of our board meetings and who sits on the boards - NOT the boards! This community is our investment and we are trying to protect it through participation and speaking up at board meetings.
