Robert Varo steps down from Coto de Caza's CZ Master Association, so what?

Coto de Caza, CA - Coto de Caza's CZ Master Association board of directors reports that Robert Varo will not seek another term.  So what?

Some fifteen years ago, there was a quiet, bucolic hunting preserve called Coto de Caza, once Money/CNN called one of the best places in America, to retire.

Shortly thereafter, Robert Varo joined the CZ Master Association board of directors, ushering in the era of James Harkins as legal counsel, Keystone Pacific as the property management company and UPS for gate access control. and the community was quickly transformed.  . Now it's come per capita exceeds that of its neighbors, gated or ungated.

A cursory look at what took place during Varo's term is listed below.  A more thorough discussion can be found in this blog.

Public safety.


The CZ board of directors quickly fired the CHP for proactive patrol without a suitable alternative.  As if that was not enough, the board also fired the the largest private security company in the world Nd replaced it with one of the smallest ones. And before Al Sharpton and Eric Holder made it fashionable to beautiful-law enforcement, Varo in an en board setting called the CHP extortionists.  

The traffic accident rate in the community skyrocketed and repeated calls to legal counsel, the board and anyone who would listen to do something about the lawlessness we go heeded with tragic consequences: The first traffic fatality in the community was recorded.

This accident coupled with a strong call for the board to resign, finally forced the the board to re-hire the CHP.


NOTE: Historically, there is a correlation between CHP patrol hours, traffic accident rates and traffic fatalities

In over ten years, we have developed simply public safety heuristics for Coto de Caza: if the traffic accident rate reaches a certain level and or the patrol hours are less than 40 hours per week, a traffic fatality is about to happen.  The community has suffered Three Traffic Fatalities during Varo's term, and the data shows that another one is just around the corner.

Power grab

Despite state legislation requiring homeowner associations to adopt direct elections in lieu of an archaic cumulative voting process designed to keep a minority in control, the Varo board sternly refused to use direct elections and instead extended the term district delegates serve, assuring the current board remains in power.  District delegates are the ones who elect the board.

Although optional under Corp. Code §7615(a), the Davis-Stirling Act makes cumulative voting mandatory if called for in an association's governing documents. Civil Code §1363.03(b), the spirit of  SB-61 and SB-1560 is for direct popular election of the board of directors.

According to all the experts we have talked to, not only there are no true benefits to cumulative voting but they also recommend associations amend  governing documents to eliminate cumulative voting to make elections easier to conduct and to makes it easier to replace dysfunctional director.


Also, consider that  there is not a single municipal, county, state, or federal election that uses cumulative voting.  Cumulative voting was intended for stock corporations so small shareholders would have a voice. Otherwise, companies would be completely dominated by large shareholders. Cumulative voting is automatically included in a new homeowners association's bylaws so as to give owners a voice when the association is controlled by the developer. Once the developer is out of the picture, there is no need for cumulative voting.

We stopped publishing  CZ Master Association board election results, once we realized that we could predict with 100% certainty who the directors would be.

CZ Master Association most litigious

Under a Varo regime, the CZ Master Association is the most litigious homeowners association in Southern   California based on the number of filed Small Claims Court. 


Anecdotal evidence, including personal experience, indicates that the CZ Master Association freely uses legal resourcesto stifle dissent.  Worse:  there is a  vast differences between the CZ Master Association and its neighbors litigious activity: Since 2007, the Varo/Yocham CZ board has filed 165 cases with the Orange County Small Claims Court, compared to SAMLARC, with zero records, while the latter is more than 5 times as large, followed by Dove Canyon with 15 cases filed for the same period and five for Ladera Ranch.

Transparency

Obfuscation has been the norm at the CZ Master Association during Varo's term: Request for documents have been denied even for records such as IRS form 990, which by federal statue should be made available to anyone who asks.

In the number of complaints we have filed with local, state and federal agencies, against the board and its representatives, we make the argument that the local governance behaves as if it is above local, state and federal law.

Privacy

Under Varo's board the site is not not only fully commercialized, but the terms of the agreement are onerous.  We previously reviewed the agreement and posted our observations online.  The board threaten legal action.

The bottom line is that using a Qualys tool, the CZ Master Association’s website gets a  failing grade, and so does its security company’s, Universal Protection (UPS) website - Qualys is a pioneer and leading provider of cloud security and compliance solutions 

Going forward

So all law-abiding residents should be jumping for joy with Varo's departure, right? 
Not really.  The current culture has evolved over a decade, where culture is a form of social control,, and the Varo culture is now well entrenched and will likely continue Varo's  tradition of lawlessness and vindictiveness. 

Coto de Caza, CA - The California Highway Patrol  (CHP) traffic accident report for the fourth quarter of 2013 ending December 30, 2013 (4Q2013) shows the traffic accident rate in Coto de Caza is at an all time high at rates comparable to the ones when the CZ Master Association board of directors fired the CHP with fatal consequences in December 2005 and March of 2006.

Coto de Caza, CA –By its own words and actions, it is fair to argue that Coto de Caza’s local governance is not only apathetic when it comes to public safety, but its own actions actually result increase the risk to residents. Worse, seems like adults in Coto de Caza have similar views as the local governance.

Coto de Caza, CA - While the Coto de Caza's total population has been shrinking for the last ten years, including placement of 17 property liens for the month of January 2011 out of roughly 3500 homes, the policies pursued by the CZ Master association board of directors, the local governance, have consistently increased traffic with a reduction in CHP patrol hours, with predictable results. Consider that for close to a decade, we have consistently shown conclusive evidence that there is a direct correlation between the extent of the CHP traffic enforcement efforts and the number of traffic accidents in the community.
