Re: Enforcement of Senior Citizen Homeowners Associations Federal and
State Laws.
Leisure World Laguna Woods a Senior Citizen Homeowners Association located in Orange County, California was built in 1964 and completed in 1982. Professional Community Management, Inc. (PCM) has been the managing agent since Leisure World Laguna Hill’s inception. Leisure World was the largest Senior Citizens Homeowners Association in the United States and PCM, Inc. has become one of the largest Managing Agents of Homeowners Associations in the United States. PCM should know the Governing Documents as they have written, administered, managed and filed these documents for 47 year with the Directors,
employees, homeowners, Orange County Recorder and the Secretary of State.
These are facts. Other facts are:
(1.) PCM, GRF and Hart, King & Coldren have stated and published false information stating that
Golden Rain Foundation and United Laguna Hills Mutual have no CC&Rs.
(2.) GRF has Sold common area land against the "88" CC&Rs, Article VI and the Davis-Stirling Act #1359.
(3.) The Name change of Leisure World was done without the necessary homeowners’ vote and Management neglected to file the necessary documents for the fictitious name of Laguna Woods Village.
(4.) GRF has demolished and built a New Golf Starter Building without the Approval or Vote,
as per "88" CC&Rs, Article IV, Section 8. (5.) GRF, United, Third and Fifty have Breached
the Original Trust by not delivering to each Homeowner, each year, an Operational Budget as per the Terms of the Original Trust.
6.) And last but not least the systematic removal of the assets, money and land from the Original
Trust to other entities thus depleting the Original Trust.
Recently it was reported that the IRS contacted GRF and told GRF under 501(c)(4) (Social Welfare Code) that GRF no longer qualified for nonprofit status. WHY??
GRF also reported that after negotiating with the IRS, GRF changed the tax code, as of January l, 2012, back to the IRS tax code 528 (Homeowners Association).
On August 3, 2010 GRF retained First American Title Company to do a GRF Land Investigation. Missing from the GRF Land Investigation list was Leisure Worlds Cable
TV System. WHY??
GRF formed a partnership between Leisure Worlds Cable TV and Connection. How is it possible for the nonprofit corporation GRF to form a partnership with Connection a for profit corporation??
With Connection filing for Chapter 11 Bankruptcy how does this affect GRF's Cable
TV partnership with Connection?
Is GRF included in the bankruptcy? GRF has a fiduciary duty to the homeowners of this senior citizen community by informing this community about the ownership of the Cable TV and if this
community is involved in Connections and Broad Bands bankruptcy.
On October 4, 2011, Golden Rain Foundation retained a Trust Law Firm for $50,000 to do a Golden Rain Foundation Trust Analysis. GRF should release the Trust Analysis to help clear up the controversies which have arisen in this community regarding the ownership of the assets, money and land held in Trust.
For several years the homeowners of this Senior Citizens Homeowners Association have given all of the documentsand information listed above to the Orange County District Attorney, Orange County Sheriff, Orange County Public Officials, IRS and the California Attorney General. The homeowners who gave these documents and information to these Agencies find it amazing that all of the letters, complaints , facts and governing documents given to the these Public
Official have been ignored.
NO Public Official has come forth to Enforce State and Federal Laws. WHY NOT? Who is responsible for enforcing City, County, State and Federal Laws?

Laguna Woods Village, CA -Whether the United Board recall is absolutely necessary is debatable. What is not debatable is the Golden Rain Foundations board’s behavior during the June 2, 2009. When all residents wanted was a little respect, board president Erwin Stuller resorted to unnecessary defamatory and personal attacks. What is more appalling is that the rest of the board failed to step in and apply a modicum of decorum to the proceedings. Such behavior is not only despicable but calls for an apology and stepping down. The video clip capturing Mr. Stullers less than despicable behavior during the proceedings are quickly becoming a rallying cry against abusive HOA directors.
