If you thought the $67 million lawyer pants law suit was an isolated instance……
In the Laguna Audubon II homeowner association in Aliso Viejo, and 82 year old couple face a $1,400 parking ticket, a lawsuit, and a lien preventing them from selling or refinancing their home!
An Orange County Register’s article published today, titled Parking face-off takes toll quotes Carol Henderson as saying "They don't deal with common sense. They just decide what the law is.” The article also provides background information on the relationship between certain homeowners and the board “…several homeowners attended an association meeting in December 2006 where several protested against the fines and the association's enforcement of parking. A petition was organized to recall the board” CotoBuzz readers may want to consider the activity of the California Law Revision Commission on (TR-855) and to Assembly Bill 980 and possibly have friends and family write CLRC - Simply put, the situation with private property located inside common interest developments is getting worse - with little to no control in protecting individual personal assets.
