As we have reported on CID/HOA legislation in Sacramento in genera and AB980 specifically, CotoBuzz Journal readers know that builders are using private real estate transfer fees to pay for parks, and other benefits, often required as conditions for getting projects approved by local governments. These fees, are written into property CC&Rs and require future homebuyers to pay a percentage of a home’s sale price to a third party, such as a land trust, to support community benefits.
In today’s (July 30, 2007) issue of the North Bay Business Journal, staff Reporter William Jason writes th at “An emerging form of real estate financing has created a dispute between Realtors and homebuilders over who should pay for community benefits attached to new residential projects”
The article goes on to describe the rift between the builders and the realtors and quotes Alex Creel, chief lobbyist for the Realtors, as saying that “ the homebuilder-backed proposal does not go far enough to limit the size of fees and restrict how the fees must be collected, spent and disclosed” and adds “A third Realtor-supported bill, AB 980, deals only with the disclosure of existing fees:
