Over the weekend, Pat Caddell made one of the most forceful, persuasive arguments, asserting  that the media has become the enemy of the American people.  More forceful than anything right wing Rush Limbaugh or Ann Coulter have made to date.

Patrick Hayward "Pat" Caddell is a former public opinion pollster and a political film consultant.

Contents. He  worked for Democratic presidential candidates George McGovern, Jimmy Carter , Gary Hart, Joe Biden, and Jerry Brown. He has served as a consultant to various movies and television shows, most notably the movies Running Mates, Air Force One, Outbreak, In the Line of Fire, and the serial drama The West Wing.

His analysis on polls and campaign issues often puts him at odds with the current leadership of the Democratic Party.  Caddell is a regular guest on the Fox News Channel, and he is listed as an official 'Fox News Contributor'. This has earned him the label of a "Fox News Democrat" by critics such as liberal opinion magazine Salon.com

According to Slate, Caddell was involved in identifying people willing to participate in the anti-Obama documentary The Hope and the Change, produced by Citizens United. Currently Caddell takes almost exclusively pro-Republican positions, so in many political circles, he is now considered a Republican.

Whether you agree or not with Pat Caddell’s political tendencies, he supports the argument I have made over the last four years that ABC, CBS, NBC and CNN are in the tank for the current administration and the Benghazi Debacle is now Exhibit A:

Coto de Caza, CA - We have been covering public safety in general for the last ten years and specifically comparing and contrasting public safety between Coto de Caza and the Ladera Ranch communities.  The data consistently shows that the crime rate in Ladera Ranch is trending down or stable as compared to the one for the Coto de Caza community.  That streak ended the third quarter ending September 2012.

That is not to say that the the Coto de Caza crime is under control - it is not, as it continued to inch up from the last four quarters.  Notably, 20 cases of theft were reported, 7 vandalism and 4 fraud.

On the other hand, the Ladera Ranch crime rate jumped to 3Q2006 levels.  From previous experience, there is an OCSD reporting error, or a public safety issue in the community.  In this case, 42 cases of theft were reported and eight burglary.

My Meeting with the "Ruler" - the "Czar"

We met for 1 hour and 20 minutes.

Basically I started out the meeting with "You know from my email some information about me, and I know nothing about you, so if you could give me your feelings on Security that would be a good place for us to start."  He stated I don't get involved much with security because I have "Good" people taking care of that. My biggest concern other than Landscaping is We are forming a safety committee. I hope your still planning on being at the meeting and I confirmed that I was.

He then said  "I understand that you live with your daughter and I asked him how he knew that and he said "Someone told him" and I replied Mr. Edmonds, and he said No.

I got up from my chair and said Mr. Varo, If we are not going to be truthful with each other I might as well leave. He stated, What's the problem. I replied "I know you didn't get that information from a "Guard", it had to be Mr. Edmonds. Lets be honest with each other. He thought a minute and said, I think it was Kevin that told me that. I said lets continue with our discussion.

I said look, I have no ax to grind here, I am a concerned Resident and things are going to have to change Security wise or your going to have another big problem on your hands in addition to Public Safety.

I informed him of all the items in the notes that I gave you and he said that's not his problem, that's why he is paying Universal and CJ. He stated that CJ is the best City Manager ever and that he considered Kevin compared to the guy that Securitas had in the position, on a scale of 1 to 10, he consider Kevin a 12. I said "A 12" the man is swimming upstream and has no prior management experience. How come there is no communications between Kevin and the Orange County Sheriffs Department especially since Kevin was working in the Orange Sheriffs dept. He had no answer except to say when the call center, and the Transponder staff and Kevin move into there new quarters he is going to make a spot for the Sheriff and turn it into a Sub Station. He wants the CHP out of Coto because they are too expensive.

I asked him how he felt about a couple of nights a week that Universal provides NO PATROLS because they have the Patrol guys manning some of the gates due to guard calling off. I am aware of that happening a few times but not many.

I said Mr. Varo, your being snowed by the people that you have running the show, they are telling you what you want to hear. The real Security problems are going unsolved and getting bigger by the day..

He then stated that he has 3500 residents here and that they are "All Type A personalities". We discussed the access issues and he stated there is northing he can do about that. Its all those "Other" people like the ones that live in the Village that are causing the problems.

I asked him if he ever visited any of the gates and he said the only one he had ever been to is the South Bend gate. I replied, sure, you live down there right?

I stated that I have asked Kevin to spend a day at each gate to see and feel what the guard feels and he refuses to do so. I informed him of my verbal warning that Kevin gave me, and he replied, "Your kidding me" I said No sir , I'm not kidding you.

I told him about The party that Mr. Jones the VP from Universal had and that the guards were informed to wear there Blazers because we need to impress the guests of Mr. Jones. I said I bet you saw no IR's or tickets given to Jones's guests double and triple parking and he said "That's ok as long as there were No resident complaints and if so that's a different problem. I said how come we were not instructed to were the Blazers for Thanksgiving, Christmas, New Years, Easter, Mothers Day. He had no comment.

I sent him the link to my video of the North gate. I'm sure I have forgotten some items here but I think you get the jest of what went on. I thought he was going to walk out and say "That's enough" but he stayed and took what I had to say. I told him I did not expect things to change much Security wise but that I will attend every open Bod meeting from this point on and he stated, If your going to come to the meeting and have nothing but complaints after complaints that's going to be a problem. I said Mr. Varo, I am A Resident here and I can complain about anything I want to if I feel its important enough.

The meeting ended and we shook hands and he said I will see you on Tuesday at the Safety Meeting. I said ok, and then I said one more thing. I don't know what else Mr. Edmonds has told you about me but I do know that he did not tell you that I was one of the top 2 guards employed at Coto and if he didn't, shame on him.

Litigious Coto de Caza Homeowners Association

Coto de Caza, CA – It has been widely known and publicized that ever since Robert Varo took control of the largest homeowners association in Coto de Caza, the  CZ Master Association board of directors,  with direct support from Mr. James Harkins, the CZ Master Association board of directors has failed to comply with SB-61, SB1560 and  failed to abide by the business judgment rule, aka good faith, enabling Mr.  Varo et al to rule the community with impunity for over ten years.

Although optional under Corp. Code §7615(a), the Davis-Stirling Act makes cumulative voting mandatory if called for in an association's governing documents. Civil Code §1363.03(b), the spirit of  SB-61 and SB-1560 is for direct popular election of the board of directors.

According to all the experts we have talked to, not only there are no true benefits to cumulative voting but they also recommend associations amend  governing documents to eliminate cumulative voting to make elections easier to conduct and to makes it easier to replace dysfunctional directors.

Also, consider that  there is not a single municipal, county, state, or federal election that uses cumulative voting.  Cumulative voting was intended for stock corporations so small shareholders would have a voice. Otherwise, companies would be completely dominated by large shareholders. Cumulative voting is automatically included in a new homeowners association's bylaws so as to give owners a voice when the association is controlled by the developer. Once the developer is out of the picture, there is no need for cumulative voting.

The problems with cumulative voting far outweigh any theoretical benefit related to minority interests. Cumulative voting makes it easy for disruptive, fringe, and single-issue candidates to get on the board. Moreover, once a bad director has been elected, cumulative voting makes it almost impossible to  remove that director from the board. With conventional voting, i.e., casting one vote for each candidate, candidates must seek a broader base of support thereby increasing the likelihood that more moderate, business-like candidates are elected. If a director is dysfunctional out of control, a conventional (non-cumulative) voting system allows the membership to more easily remove and replace that director.

But wait, there is more – anecdotal evidence indicates that the CZ Master Association freely uses legal resourcesto stifle dissent.  But even armed with this information, we were not ready to see the vast differences between the CZ Master Association and its neighbors litigious activity: Since 2007, the Varo/Yocham CZ board has filed 165 cases with the Orange County Small Claims Court, compared to SAMLARC, with zero records, while the latter is more than 5 times as large, followed by Dove Canyon with 15 cases filed for the same period and five for Ladera Ranch.

The Rancho Santa Margarita Landscape and Recreation Corporation, or SAMLARC comprises roughly 13,000 units and maintains most streetscapes, medians, parks and trails within the community. In total, SAMLARC runs and maintains 13 parks, 4 pools, a lagoon, a lake, and numerous trails within the community. One of SAMLARC's most popular parks, Central Park located next to City Hall, contains a large amphitheater where a number of community events are held each year. Central Park is also home to an arena soccer rink that was converted from a roller hockey rink. SAMLARC also maintains a popular skate and dog park that are located within SAMLARC's Canada Vista Park.



Dove Canyon is a private residential community located in eastern Rancho Santa Margarita with approximately 1,200 homes and 5,000 residents.

The CZ Master Association is the largest homeowners association in Coto de Caza with approximately 3,400 homes.

Heck, the Varo/Yocham CZ board of directors even filed a Small Claims Court action against Coto CAN - the Coto Community Action Network! - The obvious conclusion is that if you live in the CZ Master Homeowners Association, you better check your personal opinions at the gate, otherwise be ready to face the judge – not a good idea.  More on a judicial misconduct tracker later.

As a former CZ Board Member and concerned citizen, I can say without condition that Bob Varo and Jerry Mezger should not be re-elected to the CZ Board because they do not understand the foundation concepts of Board Member fiduciary responsibility, ethical behavior and conflict of interests. Coto de Caza, CA – The verdict  is in, in the Small Claims Court trial  30-2012-00570806-SC-SC-HLH,  held July 23, 2012,  against the Coto de Caza Homeowners Association, otherwise known as CZ Master Association. In the case, it was alleged that the association not only failed to comply with Civil Code § 1365 but that  it continues to claim it is beyond local, state and federal jurisdiction,   The Honorable John L.
