If you live in an OC HOA, use the OC Small Claims Court at your own Peril

LETTERS

Back on December 12, 2011 my wife was hauled into small claims court by the Dove Canyon HOA via Seabreeze Mgmt. to answer their complaint that she owed them $5,000 in back dues and fees.

When the case was called before the judge I handed him the law stating that a HOA could not file a lawsuit against anybody unless they first gave them an opportunity to try and resolve their dispute under what is called either an Internal Dispute Resolution (IDR) or an Alternative Dispute Resolution (ADR) process with the Association.

Seabreeze vociferously argued that my wife never asked for an IDR hearing therefore she wasn't entitled to it. At that point, however, we presented the judge with dozens of letters and emails from my wife demanding an IDR hearing.

The judge immediately ruled that the Association had not followed the law and dismissed the case without prejudice. He also stated if they did hold an IDR hearing for us he wanted to see the minutes of that meeting in any future court proceedings on the case.

Several months later we were advised by the Association that they were now going to hold an IDR hearing for us which they did on February 21, 2012.

At that meeting we were grilled by the board about all these phony fees they said we owed them to which I responded that the bank had informed us they had agreed to take the house over through a deed in lieu of foreclosure. The head Nazi on the board then told me there was no reason for me to discuss the bogus fees anymore with the board because they would now look to the bank to collect their fees. In fact when I pressed on with my side of the issue on these disputed fees he told me to shut up and be quiet because the matter had now been resolved with the deed in lieu revelation. They were all jumping up and down that the bank would now pay these fees. The meeting was then adjourned with no written agreement as to any resolution to our dispute. I never even got to discuss our dispute with them.

Several weeks later we got a letter in the mail thanking us for coming to the meeting and saying the board was looking into the matter a little further. From that point on until we were once again served with illegal lawsuit papers in July we never heard one word from them at all. They merely were doing what they did before. Filing an illegal lawsuit in strict violation of the law.

At this point I wrote the Association demanding they drop their illegal suit and give me copies of the so-called IDR meeting minutes on February 21, 2012. They refused to do either saying the suit was legal and the IDR minutes were private and not allowed to be given to me.

From here the whole case deteriorated to the point that I referred to in my letter to the Commission on Judicial Performance.

They spent three months saying they wanted to settle the case with me for the maximum small claims amount of $5,000 only to come up with their 11th hour letter to me that Flynn told them they couldn't settle for $5,000. It had to be $9,000. What's interesting about this is the extra $4,000 Flynn was now saying we must pay was for Association legal and collection fees. In other words Flynn was now advocating on behalf of all his legal and collection buddies to make sure they got paid.

The biggest crime in all this was the fact that Judge Flynn misused his position power and judicial authority by going behind my wife's back in illegal ex-parte discussions with the HOA about her case when she was not present. The fairness and integrity of the judicial system cannot be maintained when you have judges going behind people's backs to discuss and rule on cases in violation of their Constitutional rights of judicial due process.

You could search the world over and you would not be able to find a more disgusting HOA case like this one. These Dove Canyon people and their puppet judge Flynn give a new meaning to the words crooked, greedy, arrogant, narcissist,  lying , bastards.

Alleged Judicial Misconduct: Is Small Claims the right venue to settle HOA disputes?

Alleged Judicial Misconduct: Is Small Claims the right venue to settle  HOA disputes? The jury is still out in Orange County, CA

CA Commission on Judicial Performance

455 Golden Gate Avenue
Suite 14400
San Francisco CA. 94102

September 7, 2012

Gentlemen:

I  would like to lodge a serious complaint of judicial misconduct against judge John L. Flynn III of the Laguna Hills CA. small claims court and certain members of his  court staff. On or about September 6th 2012 Judge Flynn and several members of his  court staff held one or more ex-parte meetings and discussions With plaintiffs of a case in his court without the defendant in the case being present.

The sum and substance of these illegal meetings were outlined in an email to me as follows from one of the plaintiff's management staff personnel.  In this email he said quote:
" As I stated in our most recent phone conversation (of September 6th 2012) based on most recent feedback from the court (about our case to be heard on September 12, 2012) management will be moving the case to civil court. This is due to the high balance on the account. At one point we believed it was permissible to waive high balances in order to make the small claims filing amount limit. Since then we have been advised by Judge Flynn and the court that we cannot "ding" other homeowners for homeowner delinquencies
and waive such large amounts such as in your case".

"The previous negotiations with you were done under the assumption that we, the
Association, were able to waive large amounts in order to make the small claims filing limit. Since then we have knowledge from the court and the judge that waving such amounts is not permissible and we will now dismiss the claim to later file in civil court in order to comply".

On your commission web page you state that quote: "One of the types of judicial misconduct investigated by the commission on judicial performance is when there is receipt of information about a case outside the presence of one party to the litigation." Well  Sir it seems to me that that is exactly what happened in my wife's case. These people all got together and discussed ways to get around all the small claims filing limits. My question is why was my wife not invited or allowed at these meetings to voice her objections over what they were doing in her case.

I should tell you also that this was not the first claim made against my wife in this small claims court by these plaintiffs for this very same amount within the small claims filing limit. The first case was heard several months ago by another judge who dismissed the case because the plaintiff home owner association violated the law by not providing my wife with a fair and reasonable internal dispute resolution program  required under CA civil code 1363.850 before they filed suit against her and as of this date this program has still not been provided to my wife.

This, of course, was the defense my wife and I had prepared in this lawsuit once again..... before based on information from the court and judge Flynn they the association decided  to drop the case in favor of suing my wife once again illegally and in violation of civil code 1363.850 in civil court. I guess what all this means is that judge Flynn and his court play fast and loose with the law over there in his Laguna Hills small claims court and in so doing deprive people of their constitutional right of due process under the law.

I rest my case. I hope You will investigate this complaint forthwith and apply whatever appropriate sanctions and punishment you deem necessary to prevent this type of judicial and court misconduct from happening again.

Thank you.
Sincerely
William Kirkendale

Coto de Caza Free Speech on Trial – Honorable John L. Flynn III presiding

Posted By CotoBlogzz

Coto de Caza, CA – while most pundits speculated over what the Supreme Court would do about the individual mandate included in the ObamaCare legislation, most also warned not to read too much into the Justices’ line of questioning.  Most of the pundits were right on the latter, wrong on the fate of the individual mandate.

Something similar can be said about the trial of free speech in Coto de Caza, now in the hands of the Honorable John L. Flynn III. Not much different from  the Leisure World’s Golden Rain Foundation Vs Franz and Golden Rain Foundation vs. Lyon.  In that case (1994) 16 Small Claims Court complaints were filed because the board of directors refused  access to GRF’s financial records.  The case ended up with the California Supreme Court (1999) which sided with the residents – however, some 80% of the initial residents died by the time, the Supreme Court Decision was handed down – something critics say the association was counting on, in the first place.

A Small Claims action was filed against Coto’s CZ Master Association board of directors alleging that the association not only failed to comply with Civil Code § 1365 but that that it continues to claim it is beyond local, state and federal jurisdiction.  The Honorable John L. Flynn III presided during the trial held July 23, 2012.

The session included an action brought against a pooch named Austin Powers by two separate dog sitters.  In both cases, the plaintiffs claimed the pooch’s owner owed the money.  In both cases the owner denied he owned money and claimed to have little recollection of the facts.

Another case dealt with a $3,000 Vercace dress bought off the run-away and subsequently damaged during dry cleaning.  The dry cleaning operation owners, supported by an expert witness, claimed the problem was a manufacturer’s defect.

Then there is the case of a labor relations issue where a young main claimed a loan-modification managed of a defunct-business owed him $10,000.  The manager denied he had first hand knowledge of wrong-doing inside the organization and that he had no interaction with the plaintiff.

In all three cases, the Honorable John L. Flynn III was deliberate, attentive and genuinely interested to hear the two sides of the story.  In all three cases, simply listening to the two sides present its case, made it extremely difficult to render an impartial verdict.

In this case, the Honorable John L. Flynn was visibly disconcerted  when I mentioned I was a representative of the independent media, and when I noted that the association used an attorney to notify me that it would not comply with Civil Code § 1365, unless I signed a Shut Up rule.

I argued that the association was claiming to be beyond the jurisdiction of local, state and federal law.  For example, the California Public Records Act not only deals with disclosure of records, but also the format of the request and the denial process as follows:

6253.1.  (a) When a member of the public requests to inspect a public record or obtain a copy of a public record, the agency, in order to assist the member of the public make a focused and effective request that reasonably describes an identifiable record or records, shall do all of the following, to the extent reasonable under the circumstances:

(1) Assist the member of the public to identify records and information that are responsive to the request or to the purpose of the request, if stated.

(2) Describe the information technology and physical location in which the records exist.

 (3) Provide suggestions for overcoming any practical basis form denying access to the records or information sought.

 (b) The requirements of paragraph (1) of subdivision (a) shall be deemed to have been satisfied if the agency is unable to identify the requested information after making a reasonable effort
to elicit additional clarifying information from the requester that will help identify the record or records.

 (c) The requirements of subdivision (a) are in addition to any action required of an agency by Section 6253.

 (d) This section shall not apply to a request for public records if any of the following applies:

 (1) The public agency makes available the requested records pursuant to Section 6253.

(2) The agency determines that the request should be denied and bases that determination solely on an exemption listed in Section 6254.

(3) The public agency makes available an index of its records.

§ 6253.9  Electronic format

§ 6255 (a)  Denial
The agency shall justify withholding any record by demonstrating that the record in question is exempt under express provisions of this chapter or that on the facts of the particular case the public interest served by not disclosing the record clearly outweighs the public interest served by disclosure of the record. .

Further, the records in question are Form 990s – According to the IRS, not only are form 990s supposed to be made available to anyone who asks, but the IRS makes these available to the general  – which is how we obtained our copies, without having to sign a Shut Up Contract.

The form 990s filed by the CZ Master Association with the IRS state that contrary to the Sarabanes Oxly Ac (SOX)t, it does not have a documented whistleblower procedure and does not have a documented conflict of interest procedure.  Worse:  The form 990s also indicate that all individual board members are available at the Keystone address, but when the Orange County Sheriff’s Department (OCSD) attempted to serve the members, Keystone refused stating “they do not work for Keystone”

CZ Master Association 990 available from IRS - not Shut Up Rule requiredd

As justice Ginsberg might say, those in the know don’t talk.  Those who talk don’t know.

We do not know how the Honorable John L. Flynn III will rule in this case.  However, just like  the Leisure World’s Golden Rain Foundation Vs Franz and Golden Rain Foundation vs. Lyon, we are ready for the next round, regardless of the outcome.

Ladera Ranch Traffic Accident Rates Stabilize, Coto de Caza continues at all time high
Coto de Caza, CA - While Ladera Ranch registered 16 injured, 16 property damage and 4 DUIs during the fourth quarter of 2011, the community experienced seven injuries, 12 property damage and no DUIs in the first quarter ending March 30, 2012, according to figures from the California Highway Patrol San Juan Capistrano Office

Coto de Caza, CA - The good news for Coto de Caza residents is that the quarter-to-quarter accident rate for the quarter ending March 31, 2011 is significantly down from the previous quarter. Coto de Caza and Ladera Ranch 1Q2011 Public Safety Review
Coto de Caza, CA –By its own words and actions, it is fair to argue that Coto de Caza’s local governance is not only apathetic when it comes to public safety, but its own actions actually result increase the risk to residents. Worse, seems like adults in Coto de Caza have similar views as the local governance.
Our research over close to ten years indicate that whether a community is safe or not, is primarily a function of residents and local governance, not law enforcement. Consider that when a city in Orange County is deemed the safest city, what about the other 11 cities or the unincorporated areas? What about Coto de Caza with the highest crime rate in history in early 2010. After all, only common denominator is that the OCSD is the law enforcement agency. What does the OCSD do differently in the safest city, as opposed to the least safe city under its watch?

Coto de Caza's Traffic Incident Rate at Critical Danger Levels
Coto de Caza, CA - While the Coto de Caza's total population has been shrinking for the last ten years, including placement of 17 property liens for the month of January 2011 out of roughly 3500 homes, the policies pursued by the CZ Master association board of directors, the local governance, have consistently increased traffic with a reduction in CHP patrol hours, with predictable results. Consider that for close to a decade, we have consistently shown conclusive evidence that there is a direct correlation between the extent of the CHP traffic enforcement efforts and the number of traffic accidents in the community.

Coto de Caza, CA - The CotoBuzz Journal has documented the one-sided hate-hate relationship between the CZ Master Association board of directors and law enforcement agencies in general, and the California Highway Patrol (CHP) specifically (CHP). In an open board meeting for example, a board member called the Orange County Sheriff's Department (OCSD) extortionists! Despite the public abuse the CHP has received from the Coto de Caza board of directors ever since the board was coerced into bringing the CHP back for pro-active traffic patrol, figures indicate that the CHP has been doing its job: - The Chart below was published Sept. 30, 2006.

As complaints mounted and calls for his termination increased, a blatant example of the most recent deception is board member Jerry Mezger’s revelation that the Property Management Company’s general manager is not a Keystone employee, but rather a highly paid association employee “CJ works for the Board and not Keystone.  Keystone merely handles the payroll and other personnel technicalities.  Keystone has no authority to hire, fire, or discipline CZ’s General Manager”.

The Coto de Caza Board of directors meeting held, appropriately on July 13, 2006, provided yet more evidence of the involution of the safety committee:
