Coto de Caza: 4Q2007 Crime and Vandalism Flash Report

The CZ Board will not do it - Here is to you Coto Dad - keep it up!

The bad news is that the 3Q2007 flash crime and vandalism report showed a troubling upward trend, particularly when crime and vandalism rate per capita in Coto de Caza was twice that of Ladera Ranch.



The good news is that the 4Q2007 flash report indicates a significant dip, similar to the one we have seen anent traffic collisions

Given that in spite of the CZ board of directors' failure to even consider the advice of CHP's Lt. Helzig to reduce traffic collisions (instead call CHP extortionists, refuse to allow time from a board meeting for a public awareness announcement by CHP management, but turn complete control of an entire board meeting to trashy TV producers, for example), and that the CHP enforcement hours are down some 60% from 2007, and yet the traffic collisions are in a downward spiral, we concluded that Coto parents must be taking public safety matters into their own hands.

Something similar seems to be happening with crime and vandalism in the commnity. Despite periodic promises from the CZ board of directors that The Sheriff is coming, Sheriff enforcement hours are negligible. We have asked Lt. Griffin for the number of enforcement hours per month to correlate with the figures about, but we have not had a response. Hence, here is to you Coto Dad - keep it up!

A significant difference observed in the 3Q2007 between the two communities is in the age group of those involved in reported infractions. Of three age groups: 20 years and under, 21-29 and 30 years and over, in Ladera Ranch, the mid-range age is responsible for 40% of the reported incidents, whereas in Coto de Caza, the age group of 20 and under is responsible for a whopping 42% of the incidents!. For the 4Q3007 flash report, the Coto de Caza figures have change little: 20 and under = 43%, 29-21=23% and 30+ = 35%

“Village Snopes would be nice to dispel myths that are causing havoc on the mutual boards”, reads an article titled “ Rumors false, and published December 18,2007 by the OCR. The article asserts that according to Third Mutual president Cynthia Conner, claims that the board is planning on removing director Stanley Feldstein are untrue. This coming right after Mr. Felstein was “politically assassinated” as president of Third Mutual and replaced by none other than Ms. Conner.

Ms Conner has correctly observed that “ while officers serve at the pleasure of the board, directors are voted on by mutual members”, but this should not be a surprise to anyone familiar with HOA politics, and perhaps one reason why Mr. Felstein’s total political demise was not consummated earlier? On the other hand, a director can be removed by simple resolution of the board if that director does not meet basic qualifications. Paraphrasing President Clinton when he tried to define the word “is”, it all depends what “basic” means. Or a more recent example from Presidential Candidate Governor Mit Romeny, it all depends what “seeing” means – does it mean I need to be there to “see”?

Interestingly, the Resident’s Voice commented on Ms Conner’s jab aimed at her critics: “Residents Voice believes that there is/was indeed a plan, and a desire, by the Group of Six to remove Feldstein from the Board. This belief is corroborated by Conners subsequent statement during this Board meeting, that, “Over the past month there has been a lot of discussion about what it takes to remove a director from the board… “ If there was no plan, or desire, to remove Feldstein, then why did the Group of Six spend a month discussing “what it takes to remove a director” from the Board?

Ms Conners lamented that “ there was no place where residents could debunk rumors”. But of course, she is not correct. “Performing the hajj, the annual Muslim pilgrimage more ancient than Islam itself, is complicated and confusing even for those well-versed in Islam — so it's particularly intimidating for someone who's hardly religious”, writes Associated Press’ writer Scheherezade Faramarzi from Mecca, Saudi Arabia, in a piece published December 17, 2007. Faramarzi adds “As a secular journalist covering this central pillar of Islam, which began Monday, I am determined to go through the rites with an open mind.”

, the pilgrimage to Mecca (Makkah), is the largest annual pilgrimage in the world. It is also the fifth pillar of Islam, an obligation that must be carried out at least once in their lifetime by every able-bodied Muslim who can afford to do so. It is a demonstration of the solidarity of the Muslim people, and their submission to their God.

The pilgrimage occurs from the 8th to the 12th day of Dhul Hijjah, the 12th month of the Islamic calendar. Because the Islamic calendar is a lunar calendar, the event cannot be pegged to the Gregorian calendar, which is approximately eleven days longer. In 2007, Hajj takes place from December 17 to December 21.

The Hajj is associated with the life of Muhammad, but the ritual of pilgrimage to Mecca predates Islam, and was considered ancient even during his lifetime in the 7th century. Many Muslims believe that it goes back to the time of Abraham in 2000 BC.

Faramarzi's article provides a fascinating view of what transpires during Hajj: “The mass of humanity is awe-inspiring — and that is part of the point. The hajj is a deeply personal rite for the faithful, a chance to get closer to God, walk in the footsteps of Muhammad and Abraham and receive the forgiveness of sins. But it is also a communal experience, a symbol of the unity of the Islamic world”. Faramarzi then describes what seems to be a rare occurrence: “The close mingling of men and women here is remarkable, when in all other areas of life — particularly in Saudi Arabia — the genders are strictly segregated. In much of the Arab world, men and women are separated when they pray in mosques, and many conservative men consider it a sin to shake hands with women. But here in the most sacred place in the Muslim world, men and women pray side by side and touch without the slightest inhibition. A major theme of the hajj is the equality of all mankind before God — man and woman, rich and poor, young and old.”

Over the years, Rick Cryder, founder of Angels of Love, has taught hundreds of inmates the craft of welding and given them a chance to give something back while rehabilitating their lives in the process. The program is one of many inmate programs in the Orange County Jail system. .

“A hospital is the last place a child wants to be on Christmas Eve. Unfortunately, illness doesn’t always “stand down” for the Holidays,” reads an OCSD press release announcing the Angels of Love visit to the Children’s Hospital of Orange County.

Tomorrow morning 10 a.m., at Children’s Hospital of Orange County, some 200 kids will have an angel watching over them as they struggle with illness this holiday season. The beautiful, hand crafted stained glass angels, encased in 24K gold, come courtesy of inmates at the James A. Musick Facility and Rick Cryder, founder of Angels of Love.

Since 2002, angels have also been given to the families of each fallen law enforcement officer and fire fighter in the State of California, along with many others in our nation. Angels of Love has donated hundreds of angels to families who have experienced tragedies in their lives. These include families of the military killed in Iraq and Afghanistan, the Virginia Tech shootings, Oklahoma City bombing, Columbine, 911 terrorist attacks and other world events.

But Cryder’s ministry takes on an extra special significance during the holidays. He doesn’t exactly don the red suit, and he’s not bringing that shiny new bicycle, but he does bring some much needed “comfort and joy” to children and their families. This past Friday, he delivered about 100 angels to Children’s Hospital of Los Angeles. Tomorrow, 200 more kids, who will likely be spending their Christmas at CHOC, will be receiving a precious and beautiful gift, hand-made by the unlikeliest of elves.

Following in the footsteps of the teddy bear once named Mohammed case (where UK teacher Gillin Gibbons was charged with inciting religious hatred and convicted of the less-serious charge of insulting Islam for letting her pupils name a teddy bear "Muhammad,"), now comes word from Saudi Arabia that the Girl of Qatif, a rape victim woman sentenced to prison and a public lashing after being gang-raped has been pardoned by the Saudi monarch.


“Human rights activist Fawziya Al-Oyoni, who is based in the Eastern Province, said that the king’s pardon brings some relief to women, but it doesn’t clear the rape victim from being blamed”, writes Ebtihal Mubarak in the Arab News article titled Abdullah Pardons ‘Qatif Girl’

According to the AP’s Abdullah Shihri, “The woman, known only as "the Girl of Qatif," was convicted of violating Saudi Arabia's strict Islamic laws against mixing of the sexes because she was in a car with a man she was not related to when the seven men attacked and raped them both in 2006”.

The king’s pardoned was made official Monday when it was “.. published in the Al-Jazirah newspaper, which is deemed close to the royal family. But it did not appear in any other local media or the state-run news agency — in an apparent attempt to play down the case at home”, according to Shihri.

In Monrovia, Liberia, “after 14 years of darkness, street lights shine amid the shattered buildings”, writes AP writer Terry Leonard in his article titled Liberia tries democracy with new leader, “ And the new president — the first woman elected to head an African country — stands under an umbrella in the driving rain to launch repairs to a street that seems to have more holes than pavement”, he continues.

In Laguna Woods Village, residents sent a strong pro-change message to the Third Mutual board of directors, electing Stanley Feldstein as director, who quickly as president, threatened the status quo by actively “following the money” and asking the tough questions –scaring the “Dirty 1/2Dozen” directors who recently held an alleged secret meeting culminating in the political assassination of Stanley Feldstein. Parliament is controlled by the opposition, for the first time in its history. And President Ellen Johnson-Sirleaf promises a new deal funded by donors and investors lured by peace and good governance”, writes Leonard

In LWV, the local governing body has been deaf to calls for reform and demands of transparency and responsible fiscal management. Promptly after Mr. Feldstein was taken out, new board president Cynthia Connors, in "impromptu few comments" wallowed in the never never nebulosities of open ended possibilities pledging transparency and mending the community – perhaps analogous to the assassin game Sock Wars.

“In Liberia, the new openness at the top is obvious just from switching on the radio. Government officials are guests on talk shows almost daily, explaining policies, taking suggestions and fielding angry complaints. The justice minister tells a caller frankly that some police are corrupt. Every new initiative is presented for public comment”, continues Leonard

In Laguna Woods Village, the mending game continues. In recent weeks, about 150 people around the world are being asked something along the lines of “are you dead yet?” These assassinations have participants in pins and needles. In the Socks Wars game, each participant is required to knit a pair of socks for another player and ship them off to the target. Players are assassinated (eliminated) from the contest, when they receive the socks. What we can figure is that in the Laguna Woods Third Mutual assassin game, a secret closed meeting is called to “mend the community”, then a director who does not follow the established rules is “mended”, err…. politically assassinated.

We understand that the “Dirty ½ Dozen” has scheduled a mending session for December 18 at 9:30 am in the Administration Building Board Room. It is reported that Mr. Feldstein is being mended permanently from the board, because as a supporter puts it: “Mr. Feldstein has become too dangerous to the "Dirty1/2 Dozen and the interests they represent. Mr. Feldstein dared to ask questions. His knowledge, ethics and common sense was a challenge to lesser minds. Mr. Feldstein's only transgression is a desire for fiscal transparency so that residents facing rising assessments, might know where their money is going and how it is being spent”. We should note that when we reported on the first alleged "secret closed door meeting, we received notes that such meeting never took place - but Mr. Feldstein was removed as president anyway, so it is this time with people telling us that the alleged "mending" is not taking place - LWV residents will be the first to know if Mr. Feldstein is permanently assassinated....err mended.

Coto de Caza DUI Collision (Skendarian) Lawsuit Settlement

According to court records filed in Superior Court in Orange County dated November 28, 2006, the Skendarian lawsuit settlement worked out includes:

· Defendant’s insurer is to pay Skendarians $100,000

· Defendant’s insurer is to pay Skendarian’s minor $100,000

· Shannon is to pay Skendarian $40,000 as the “Shannon Settlement Amount”

· Shannon and employer to pay Skendarian $600,000 in certain monthly installments after entry of “good faith settlement” order under Code of Civil Procedure section 877.6

Settlement presumes several dismissals by parties involved, including Shannon and Shannon’s employer's cross-complaints filed on their behalf in this action.

Case No 05CC02855 involves a traffic accident that occurred September 22, 2004 at the intersection of Vista del Verde and Mackenzie Lane (undisputed fact). The defendant was visiting Coto de Caza as a guest of Coto de Caza Gold Club, having earlier participated in a golf tournament (undisputed fact). CZ Master Association and Keystone are included in the list of the defendants.

Court document indicate that CZ Master defense relied almost exclusively on actions taken by previous board of directors. Whereas the stated actions related to the administration in charge when the accident occurred, may have been misleading, such as the implication that the Sheriff could legally be engaged in pro-active traffic enforcement in Coto de Caza during a period it was expressly forbidden by County ordinance.

How ironic that CZ defense centered around past Board Actions; when Varo/Mezger ignored everything past Board Members were saying to them for more than two years in reference to the Sheriff and CHP in Coto. Somehow, Mr. Zipperman was able to get one of the other parties to pick up $50,000 of this judgment because I am told that CZ ultimately paid $50,000 rather than the $100,000 deductible indicated. A winter solstice holiday greeting specially for SOCAL Journalists

It is widely recognized that the media in general has a high concentration of locofocos, and is often characterized as "far-left secular progressives who despise the military, traditional values and religion," by Fox News commentator Bill O'Reilly.

“Hooray for San Francisco; we need these people in” in South Florida, reads an article posted in the Internet by the Broward County Atheists Group, immediately following the desecration of a Catholic Church in San Francisco, California and in response to Mr. O'Reilly, who brought national attention to the incident.

What might Mr. O'Reilly opine about a neo-locofoco group of journalists who apparently are following in the footsteps of the Orange County DA’s office who apparently no habla Christmas, and plan on a “Holiday Mega-Mixer” to be held December 18, 2007 at the Redwood Bar and Grill in downtown L.A. with the call to action: “Journalism groups unite to bring you the best holiday celebration of the season”

Scheduled participation groups include: The Greater Los Angeles Chapter of the Society of Professional Journalists, CCNMA: Latino Journalists of Californi, National Lesbian & Gay Journalists Association-Los Angeles Chapter, Asian American Journalists Association-Los Angeles Chapter, New America Media, Black Journalists Association of Southern California, LA Press Club and the National Association of Hispanic Journalists - Region 8
Since this group of SOCAL journalists apparently no Habla Christmas, we would like to share the same winter solstice holiday greeting we shared with the OCDA's office:

The Orange County DA's Office No Habla Christmas

A winter solstice holiday greeting specially for the OCDA

December 14, 2007

As part of an ongoing commitment to improve the quality of life in Orange County communities, the Orange County District Attorney's Office (OCDA), Delhi Community Center, and Toys for Tots will celebrate the season with 40 special families at the 9th Annual Adopt-a-Family event. The holiday party will be held tomorrow, Saturday, December 15, 2007 from 9:00 a.m. to 12:00 p.m. at the Delhi Community Center at 505 East Central Avenue, Santa Ana.

The Delhi Community Center selected 40 families needing some cheer during the holidays. They will receive holiday dinner gift certificates and toys for their children, which were donated by OCDA's staff, family, friends, and affiliates. The adopted families are invited to attend a holiday celebration to receive their gifts and participate in a fun-filled morning featuring arts and crafts activities, balloons, baked goods, and an opportunity to meet and take pictures with Santa Claus.

Whereas the Orange County Sheriff’s Department will host a Christmas Cruise, we found it interesting that in the politically correct world of the Orange County DA Santa Claus is mentioned, given the recent complaints by a special interest group claiming that as typically depicted Santa is weight challenged and the group would prefer to see a slimmer, trimmer, buff version.

Also interesting to see that in the Spanish version of the press release announcing the event, “special families” is translated as low income, and Holidays is translated as Christmas, where as Santa Claus is translated as Papa Noel.

Apparently the Orange County DA no habla Christmas and no habla Low Income. Hence, we com posed a winter solstice holiday greeting specially for the OCDA's office:

Orange County Sheriff's Department Christmas Cruise

Orange County Sheriff's Department Christmas Cruise

December 13, 2007

On Wednesday, December 19, 2007, at approximately 6:00 p.m., Undersheriff JoAnn Galisky will host a harbor cruise aboard the vessel “Crystal.” The boat will depart from the Lido Village at Via Lido and Newport Blvd.

The passengers will include a combination of over 200 “Make-A-Wish” children, their siblings and parents and volunteers. They will be treated to a two and one-half hour dinner cruise. The cruise will include a surprise visit from Santa Claus, who is expected to arrive by fireboat with gifts for the children.

The Sheriff’s Department will host the event in cooperation with the Orange County Chapter of the “Make-A-Wish” Foundation, through the generous support of Dave New and Friends of the Harbor, as well as Electra Cruises and Basin Marine. Dozens of local citizens have generously donated monetary support and volunteered hundreds of hours to make this event a success.

A limited amount of space is available for members of the media to participate in this Holiday Party. Reservations must be made by 3:00 p.m. on Monday, December 17, 2007, with Donna Muleady at the Sheriff’s Media Relations Office at (714) 647-7042.

Coto de Caza DUI Collision Lawsuit Notes

Case No 05CC02855 involves a traffic accident that occurred September 22, 2004 at the intersection of Vista del Verde and Mackenzie Lane (undisputed fact). The defendant was visiting Coto de Caza as a guest of Coto de Caza Gold Club, having earlier participated in a golf tournament (undisputed fact). CZ Master Association and Keystone are included in the list of the defendants.

The case includes statements form the CZ Master Association to the effect that “On October 1, 2003, the Orange County Board of Supervisors voted to hire ten new Sheriff deputies and two supervisors to patrol the unincorporated portions of South Orange County, including Coto de Caza. Based on the action of the Orange County Board of Supervisors and assurances from the Orange County Sheriff that it would provide increased patrols of Coto de Caza, CZ Master terminated its contract with the CHP and substituted the services of the Orange County Sheriff to enforce traffic in Coto”

The CHP contract was terminated on January 2004 (undisputed fact). On September 22, 2004, the defendant was traveling well over the speed limit with a blood alcohol level of at least 0.13%, struck the front driver’s side of plaintiff (undisputed fact).

Skendarian lawsuit details- Varo Should Resign

I am laughing hysterically at what fools Bob Varo and Jerry Mezger were when they actually believed they were going to get proactive Sheriff’s coverage from the county as their justification for firing the CHP. There is no fool like and old fool as the saying goes. In addition to the tragic deaths on our streets and many accidents during the period we had the Wild West in Coto, that Varo/Mezger decision cost our Members $50,000. And, I understand it would have been $100,000; but for the work of Steve Zipperman who negotiated a lower contribution. Joseph Morabito
Hi Joe:

We are still trying to figure out how the Sheriff’s statement substitution for the CHP fits in. Recall that it is only recently the Orange County Board of Supervisors repealed an ordinance that made it legal for the Sheriff to effect traffic patrol in Coto.

Further, we are looking for references (if any) for the missing tickler file that allowed road certification to expire, making any pro-active traffic patrol a moot point.
Obviously, that was the Association’s defense. Firing the CHP was probably cited as the basis of the plaintiff’s case against CZ especially since Varo stated publicly at Board meeting that they were firing the CHP because club members were concerned about being cited for DUI’s coming out of the club. CZ probably argued that the Sheriff was a substitute making the CHP unnecessary. What other case could they have argued? JM

Our point is the if that was indeed the CZ argument given the facts, then it would be false and misleading at best: That is, the Sheriff under the conditions as existed then would not have been able to legally patrol Coto - which is why the supervisors needed to act. Not to mention road certification expiration.

Whatever yo u do, do not forget our troops

During this busy time of year it is not unusual for our stress level to go up, as we go into overdrive. Nonetheless, it is important that we remember our soldiers, marines, airmen and sailors who are far from home and their families. After all, the freedom and liberties, some of which we are able to enjoy in our community, for which we are so thankful are secure by our men and women in uniform.

Regardless of which side of the fence you are in, and despite the utter silence from the noveaux locofocos, our troops are making significant military gains in Iraq, and we pray the politicians will soon follow.

If you would like to send a care package or card to a deployed service member, please visit www.americasupportsyou.mil for a list of organizations, many of whom will be coordinating holiday packages to the troops. If you have a family member or friend serving overseas, please use the table below as a guide for when you should ship your card or package. Basically, you must mail by December 4th for anyone serving in Iraq or Afghanistan and by December 11th for all other overseas military postings.
