In the article titled Lawmaker protests censorship of 'God', published by the Associated Press, October 4, 2007, Jim Abrams reports that as a result of Speaker of the House Pelosi’s decision to censor God, Republican Rep. Michael Turner is taking exception to the systematic secularization of policies associated with flag certificates – in essence censoring God.

“Under the flag program, begun in 1937, people may request through senators and House members one of the many flags raised and lowered over the Capitol every day”, writes Abrams. In a flag requests, Abrams writes “The Architect's office, citing its own rules, returned the certificate with the word "God" excised”.

Clearly, Speaker Pelosi has no objection to the US Post Office's release of the "Muslim Christmas" stamp - "This is a proud moment for the Postal Service, the Muslim community, and Americans in general as we issue a postage stamp to honor and commemorate two important Islamic celebrations," said Azeezaly S. Jaffer, Vice President, Public Affairs and Communications for the Postal Service, in a press release issued by the US Post Office announcing Stamp Release No. 01-054/ - The Press release notes that "the Eid stamp commemorates the two most important festivals—or eids—in the Islamic calendar: Eid al-Fitr and Eid al-Adha. On these days, Muslims wish each other "Eid mubarak," the phrase featured in Islamic calligraphy on the stamp. "Eid mubarak" translates literally as "blessed festival," and can be paraphrased as "May your religious holiday be blessed."- See below for reaction to such a release by the USPO in what we refer to as an "righteous indignation" email doing its rounds in the Internet again - , or the Intifada debacle associated with the soon to open Madrassa in Brooklyn, or the various on-going efforts by the ACLU to remove the Ten Commandments from public view - apparently the notion of One Nation Under (one) God has gone the way of the dinosaur!

If this happens in Washington, what can you expect in wannabee cities – say, Coto de Caza, where the local governing body has been trying to censor the CotoBuzz Journal, an electronic newspaper of general circulation, for years? First, the local governing body used what we refer to as the L.I.G..I.T – League of Information Generals in Information Technology to intimidate us. When that failed, they resorted to various botched legal maneuverings. Recently, they have let loose a neuron ominously proclaiming “ If the CotoBuzz Journal has nothing positive to say about the CZ board, it should shut up!”

NOTE" A Coto Discussion Forum reader took exception to our posting the "righteous indignation" email therein and said in part: "It may surprise you to know that some people of all faiths or no faith enjoy the spirit of the Christmas season. I have always thought we would all be better off sharing the joy rather than exploiting our differences".

The question is not whether a CZ Master Association dues increase is coming, a third in less than four years. If the heated discussion between former members of the CZ board of directors in the Coto Discussion Forum is any indication. The real question is when and how high!

Business Management 101 indicates that prior to answering the question of when and how high, one might want to look at the major CZ expenditures. For example, landscape, gate access infrastructure and property management.

It is generally agreed that an argument for a gated community is for safety. In theory, a gate is supposed to remove the opportunity of a crime, similar to locking a car or home. Numerous studies also show that most security breaches are consummated by insiders.

Then there is the CZ gate access controls process. Functions more as a placebo: Coto residents driving a car without a transponder - say because of auto maintenance, such resident needs to drive a loaner, - is held at the gates and interrogated with “rank and serial number”-type of questions, whereas, any non-Coto resident can drive right through, no questions asked!

Additionally service providers routinely solicit business from other Coto residents – guess what happens to the possibility for crime and vandalism? Exactly! – The CZ gates instead of removing the opportunity for a crime create the opportunity for one. The OCSD’s Crime and Vandalism figures appear to bear this out, since crime and vandalism rates for 3Q2006 and 2Q2007 are at an all time high.

Other CZ facility usage for consideration

· Horse trails are used by 10% of dues-paying CZ residents

· Sports Park is used by some 10% of dues-paying CZ residents

· According to former security Director, roughly 30% of CZ budget is spent on non-CZ dues paying members

· Non-CZ resident Golf club patrons are free to roam the CZ community anytime they wish.

· Non-CZ resident Equestrian patrons free to roam the CZ community anytime they wish

· Non-CZ resident restaurant patrons free to roam the CZ community anytime they wish

Miscellaneous considerations

Consider that the LWV property management company’s fees have increased some 69% without documented evidence showing the increase was absolutely, positively necessary.

Consider that the CZ board hired a private security company without any evidence of due diligence

Consider that the CZ board has failed to get competitive bids for property management services in years!

You are absolutely correct and now seem to get the point that I have
been trying to make. Dues will only increase going forward unless
the members are willing to materially cut the services being
provided.

Even when your buddy Joe was on the Board and negotiating vendor
contracts the expenses increased. Dues increases during that period
were only avoided by the addition of new dues paying members in the
southern part of Coto whose tracts were not yet being maintained by
CZ Master. Once that era ended we went from $165/mo to $190/mo.

The "user fee" assumptions are not substantiated by facts and cannot
be relied upon to solve this problem. They will only raise pennies
towards problems requiring real dollars to solve.

Non-members will not pay enough in fees to solve these problems. Any
increase to members is just a dues increase in disguise. Former CZ board member

You missed the point. The issue is not either/or, and certainly not to cut services, as much as it is to manage the budget better: Gate access control as currently implemented is a waste. There are those who argue that the Sheriff is responsible for crime and vandalism – missing the crime of opportunity notion altogether. Consider the attempted rape in December 2006: The CZ BOD was quick to say that the perpetrator was not a CZ resident – however, for all practical purposes, the fact that he was allowed in with no questions asked, makes him a “CZ insider”.

A drastic measure that CZ should consider is to finger print all non-CZ residents entering the gates. For example.

The 10 principles of crime opportunity [RFN1]

1. Opportunities play a role in causing all crime, not just common property crime

2. Crime opportunities are highly specific

3. Crime opportunities are concentrated in time and space – Dramatic differences are found from one address to another even in a high crime area.

4. Crime opportunities depend on everyday movements of activity – Offenders and targets shift according to their routine activities (eg. work, school leisure). For example burglars visit houses in the day when the occupants are out at work or school.

5. One crime produces the opportunities for another – For example, a successful break-in may encourage the offender to return in the future or a youth who has his bike stolen may feel justified in taking someone else's as a replacement.

6. Some products offer more tempting crime opportunities – For example easily accessible electrical items such as DVD players and mobile phones are attractive to burglars and robbers, 'hot product'.

7. Social and technological changes produce new crime opportunities – Products are most vulnerable in their 'growth' and 'mass marketing' stages, as demand for them is at its highest.

8. Crime can be prevented by reducing opportunities – The opportunity reducing methods of situational crime prevention cut across everyday life, though they can be tailored to specific situations.

9. Reducing opportunities does not usually displace crime –

10. Focused opportunity reduction can produce wider declines in crime – Prevention measures in one area can lead to a reduction in another nearby, a 'diffusion of benefits'. This is because offenders might overestimate the reach of those measures.

Coto's Dads Take Matters Into Own Hands, Get A+: CHP Collision Report, 3Q2007

Kudos Coto Moms & Dads for doing what the CZ BOD refused to even consider!

The 3Q2007 CHP collision figures just received from the CHP show a quarterly collision level (on an annualized basis) comparable to the levels the Coto de Caza community experienced prior to expulsion of the CHP by the CZ Master Association board of directors, leaving the community with no pro-active traffic patrol for more than two years. After the firing of the CHP, the collision rate doubled each year, leading to the first traffic fatality in the community in December 2005, and three months later, the second fatality that was largely ignored, not only by the CZ board, but also by the Orange County Register.

The new low collision levels logged during 3Q2007 are despite the fact that total patrol hours per month are down roughly 60% from 2005 levels. That there is no concerted community awareness programs to speak of, and no proactive work done to identify and eliminate blind alleys, where most near miss accidents usually happen.

Immediately after the first fatality in December 2005, the CZ master association board of directors was coerced into rehiring the CHP for pro-active traffic patrol. A note posted in the Coto Discussion Forum, authored by the then security chairperson, on Friday, December 9 in response to former board member, Joseph Morabito's charges of board negliglece reads:"The Board agreed last night to rehire the CHP after concerned residents voiced their opinion unequivocally and unanimously that we wanted CHP back in here immediately. CHP have started patrolling effective immediately in anticipation of a contract with CZ Master (a friend already received a tickets AND was glad they were back). I just wish it could have happened early. It just might have made a difference - and it breaks my heart".

It is often argued that hindsight is 20-20, however, what happens when public servants fail to even consider recommendations from responsible leaders, such as CHP's captain Helzig? The letter below was sent to the CZ master associatio board of directors days before the first fatality:

The CZ board of directors-friendly Orange County Register on the other hand, in the article titled Community mourns Coto teen killed in crash, published Friday, December 9, 2005 quotes then president Robert Varo’s misguided reason for firing the CHP "For three years, ending in January 2004, the CHP was contracted for traffic enforcement; the development association paid about $115,000 a year for up to 40 hours a week of patrols. CZ Master Association President Robert Varo said the agreement was ended because the community was not getting enough services for the money it paid"

While Hillsboro district delegate Robert Bellamy exhorts Coto parents to get involved in the most important public safety issue of proactive traffic patrol and writes “I believe that it is time for the residents of Coto de Caza to unite and very aggressively do what we as individuals can do to help secure proactive traffic enforcement from both the CHP and the OC Sheriff. Well placed telephone calls to CHP officials, Supervisor Wilson and Sheriff Carona will go a long way if we present a united front and maximize the political clout that residents here possess"

The move however, was largely ineffective in the short term, as the CZ master association let road certification expire, meaning that the CHP was not able to operate, then simply blamed it on a missing tickler file.

At about this time, we challenged the board to commit to lowering the old time high collision rate to 2002 levels. The board did not even respond.

Although CHP patrol hours are down during 2007, the citations per hour have doubled. Hardly an explanation for the significant decrease in the number of collisions during 3Q2007. We suspect that major drivers are the responsible Coto Moms and Dads, “cool dads”, notwithstanding as well as the criminalizing of underage drinking in California. Kudos Coto Moms & Dads! - you have done what the CZ BOD did not even consider doing!

We should note that according to CHP’ Officer Goodwin, two of the collisions were caused by two DUI 18 year old Coto residents, subsequently arrested.

Greetings

I can certainly understand when the CZ BOD’s president says that it is mind boggling to deal with City Hall. It is more so when one deals with a BOD who wants to turn Coto into that same bureaucracy!

However, besides the fact that we are confident we can prove in a court of law that the decision to fire the CHP does not pass the Business Judgment Rule, simply bringing in the Sheriff is NOT pro-active traffic control.

As we have written so many times, we subscribe to CHP Captain Elzig’s pro-active traffic control formula:

Effective pro-active traffic controls must include:



1. Awareness campaign – In the past, Lt Deck and Captain Elzig have communicated with the CZ board and volunteered to launch such campaign. She has even volunteered to attend CZ Master Board meeting and discuss the issue with residents!



2. Visibility – simply having a CHP or Sheriff’s patrol car around the most dangerous roads minimizes speeding – even if the vehicles are un-manned - most accidents occur in three roads within Coto – hence these are not “accidents”.



3. Community patrol – as shareholders we have the duty to enforce the corporation’s rules. Neighborhood watches need to be coordinated with the other security initiatives.



4. Issuing citations – A strong deterrent – All violators should then be held accountable for their actions. This does not mean that only certain violators are cited. If socially challenged Country Club and Concert patrons, and others, do not have the self-control to hold their liquor or any other drugs, cannot or will not obey traffic laws, AND they are targeted, they should then be held accountable, just like and speeder or gate runner:



5. Monitoring – by monitoring relevant statistics (as compared to the useless data collected by Securitas), and communicating with the Nationhood watch, the community is best able to determine what adjustments are necessary.



So the issue is not whether to bring in the Sheriff or the CHP. The issue is to have an effective pro-active traffic control plan, which we have been requesting from this board for over two years.



The fact that the board is having predictable problems in bringing in the Sheriff, is not an excuse for not implementing the other components of the plan, ANY plan.



I urge the board, Keystone and legal counsel to take immediate action, articulating and implementing an effective pro-active traffic control plan. Otherwise, an objective person will immediately see individual and collective negligence written all over any future accidents within Coto.



Obviously, I have given this issue a lot of personal attention, volunteered to collaborate on a security strategic plan, and volunteered to provide data to the Keystone GM – no response.



This time, I do expect to hear from you on the subject at your earliest convenience, for the commonwealth of all Coto residents.

The Art Gallery at Saddleback College presents A Brush with Nature art exhibition on November 5 through November 21 in the Saddleback College Art Gallery.

Like the sun that rises in the east and sets in the west husband and wife artists Jim Zenhua Zhang and Xiaoxing Yu were both born in China and have settled in Irvine . They continue the traditional style of Chinese painting on rice paper. Their delicate landscapes and floral studies are a breath of fresh air. This is an intimate exhibition you don’t want to miss.

A Brush with Nature is free and open to the public and can be viewed on November 5 through November 21, Monday through Wednesday, Noon to 4 p.m. and Thursday evenings, 4:00 to 8:00 p.m. There will be an artist reception on Thursday, November 1 from 6:00 to 9:00 p.m.

Saddleback College is located at 28000 Marguerite Pkwy in Mission Viejo , just east of Interstate 5 at the Avery Parkway exit. Parking is available in Lot 12. Take Avery Parkway to Marguerite Parkway turn left to the third traffic light, which is Saddleback’s Marguerite entrance. Turn right into the campus and take the second left to “ Theatre Circle ,” turning right into Lot 12. The Gallery is located adjacent to the McKinney Theatre.

Don't Tease Me Bro! - Jazz Bros At Saddleback October 31, 2007

It is time for this two brained and multi-limbed creature to lead a musical project of its own. As leaders and composers, Jean-Michel Pilc and Ari Hoenig bring their sense of musical architecture to Saddleback College on Wednesday, October 31 at 4pm in FA 101. Pilc on piano and Hoenig on drums create sounds and flows that are always different. The Hoenig-Pilc Project should prove an exhilarating experience for jazz lovers and anyone who wants to experience something unique and fascinating. Tickets are $10 at the door.

Saddleback College is located at 28000 Marguerite Pkwy in Mission Viejo , just east of Interstate 5 at the Avery Parkway exit. Parking is available in Lot 12. Jazz studies at Saddleback College emphasizes creativity through improvisation and ensemble performance. Focusing on the historical, theoretical and intuitive aspects of this American music, Director Joey Sellers and an outstanding cadre of nationally recognized musicians comprise the jazz faculty. Curricula include Improvisation, Jazz Composition and Arranging, Jazz History Syllabus, Jazz History Audio, Jazz History Podcast, Jazz Piano, Saddleback Big Band, Jazz Lab Ensemble, and Combos.

CZ Master Association Budget Compromise Not Realistic Under Current Environment

“If you cannot be diligent in the small things, how can you expect to be diligent in the big ones”?

Prior to and after the announced resignation of Jerry Mezger from the CZ Master Association board of directors, former director Joseph Morabito has been making an argument for a more sensible approach to the management of the association affairs. Such argument has been mostly met with what we refer to the “volunteer fallacy”, which goes something like this: Hey, as long as volunteers are making the decisions for the association, everything they do is just fine. In fact, instead of kicking them in the shin for mismanaging the association finances, go ahead and tell them Good Job – Keep it up!

In attempts to justify his proposal(s) Mr. Morabito writes:

“I identified about a million dollars in potential new revenues that could come from various user fees. Even if that number was reduced to $500,000 a year, all of it could go to landscaping renovation projects over a five year period to get the initial job done without another dues increase for this purpose. However, that will not entirely solve the problem because landscaping renovation is a forever process given that many plants seem to have a 10 – 15 year plant life after which they look pretty bad. There is no Reserve line item to deal with landscaping renovation. It is not part of the regular Reserve study; but it should be included as a Reserve line item because this size expense cannot be dealt with using normal operating funds alone unless there are big cuts in other expenditures and/or regular dues increases. Where else is the money going to come from? My guess from our past work is that there is probably about $3,000,000 of landscaping renovation that needs to be done now in the older parts of CZ. That number will just continue to grow if nothing is done to deal with this problem. It can only get worse.

In reality, each district should be indicated in the Reserve Fund for a complete plant make over about every 12 years with the exception of leaving trees in place. And, or it might be that if we go more natural as was the case in Canyon Estates and some other newer areas that we can do it once and then just let the slopes become part of the natural canyon environment which could just require periodic trimming for fuel modification to meet fire department requirements. However, on that basis since there is nothing in Reserves to cover landscaping renovation and we don’t have the money to do it in our operating budget, the question remains how do we address this problem? My guess is that it will have to be through some combination of charging higher user fees, dues increases and reducing other expenses so that the pain is fairly and more evenly distributed. Also, raising dues too high is not good for property values so that should not be the only approach used. Higher dues also are a greater burden on young families and seniors and those living in smaller homes, which again brings up the fairness issue

It is my contention that we both need to fund the landscaping renovation work that needs to be done now, probably over a five year period under some strategic plan and we need to start building a Reserve line to cover the work in the future and forever going forward. If we go natural, it may be that we can go out longer and/or the amount of work we may need to do could be reduced; but one way or another we need a plan that is the long term approach. We started down that road during the Glisson/Rose years; but we were not there long enough to finish the work. Ignoring the problem, will not make it go away. I for one will not be critical of a balanced approach to raise these funds; however, dealing with subsidies would have to be part of the plan”

It is our contention that Mr. Morabito continues to make excellent suggestions for responsible use of the CZ associations’ money – the only counter proposals come in the form of ad hominem and ridicule. What is clearly needed is a compromise that assures no association increases. In budget discussions with Mezger on a CZ board, a compromise is impossible. On a board without Varo/Mezger a compromise is realistic.

Consider the California budget where $145 billion spending plan was approved only after a compromise was reached, ending the longest stalemate in 30 years! – but only after legislators agreed to address “myriad’s of concerns” – yet the same time the legislation continues to enact frivolous legislation such as SB-528

Several global Taiwanese companies are in the habit of not throwing away paper that has been printed on one side. Instead, they cut them up, glue them together and use them as a poor man’s Post It™ notes. Not because they save that much money. In fact, it may just be more efficient to throw the used paper away and buy Post It™ notes! – The main reason for this practice is to show employees the value of stewardship, embodied in the old adage: “if you cannot be diligent in the small things, how can you expect to be diligent in the big ones”? – Hence our continued argument against subsidies as small as they may be.

The question is whether the Zipeprman/Yocham board can exert the leadership required to reach a compromise or whether it will outsource the work to Keystone, much like the Marina Hills board has managed Keystone. Unfortunately, our money is on the latter – after all, remember the volunteer fallacy!

Resident’s Voice, a Laguna Woods Village volunteer association, critical of the property management company and the non-profit homeowners association, today announced the launch of what they call Phase 2 and are asking other Laguna Woods Village Residents for help in distributing their message. Their goal is to deliver such message to every manor in Laguna Woods Village, by Tuesday, October 22, 2007

In the article titled , YOUR HOME AS THE GROUP'S CASTLE published September 30, 2007 by the Wall Street Journal, the author cites results from a survey of 3,000 newsletter subscribers conducted by ServiceMagic.com, a Golden, Colo.-based as “69% of homeowners polled said associations are either a "major headache" or a "minor annoyance," though 25% of respondents had not lived under an association”, mentions two most frequently common interest development (CID) complaints: “Unexpected increases in dues and unwelcome rule changes”, then goes on to advice on what potential CID buyers should do before they buy--- the CZ Masters Association is no stranger to these complaints.

An astute blogger noting that figures do not lie but liars figure – comments on how the numbers were reported in the survey:

“…let's look at the numbers. That 69% is out of the total number of respondents -> but 25% of the total number of respondents never lived in an association -> so you are really looking at 69/75 instead of 69/100 who have problems with HOAs.

69% of respondents (out of 100%) claim problems ranging from minor annoyance to major headache. But 25% (out of that 100%) never lived under an association. So only 75% of the respondents lived in an association. So the number of people that lived in associations and complained about them is 69/75 = 92%. This is in stark contrast to Community Association Institute's (CAI) claim that 95% of the people living in associations love them. Looks more like 92% have issues with them according to this survey"
Buzz: We specifically sold an investment condo with positive cash flow because the HOA Board so screwed up the Association’s finances that I feared the need for significantly escalating dues would ultimately negatively impact value. They were already at $325 a month when we sold with $3.5 million in repair work that needed to be done and no Reserves to do it. The only option that did not require a vote of the Members was 20% dues increases every year as far as the eye could see to both cover these repairs and eventually deal with Reserves that were down to almost nothing.



CZ probably needs to spend about $3 million or more on landscaping renovation now with no money to do it or in Reserves to cover it. Mezger was always bragging about getting Reserves up to 70% or more; but there is no money in Reserves to cover landscaping renovation. So Mezger’s argument was bogus. When and how does the current CZ Board plan to deal with landscaping renovation? There is no strategic plan to deal with this ticking time bomb. And, unless the CZ Board deals with subsidies going to non-members, the only way to deal with this major expense is significant dues increases for our Members. It is what it is. Why do you think I keep sounding the alarm bells about subsidies? Be assured, I am not chicken little. I know what I am talking about. JM



P.S. It would cost $300,000 or more just to do the face of The Woods and there are many more areas that need major work too
