2008 Coto de Caza Elections - Next Chapter, the Climax

The next chapter in the 2008 CZ elections is scheduled to be written the first week in April, 2008, when the CZ kangaroo court convenes to elect CZ district delegates.

Traditionally CZ boards have treated the event nonchalantly, so much so that, a good number of CZ residents are not even aware that delegate selections are taking place - we have fielded a number of questions from residents wanting to know what the process is to volunteer as delegates, for example. It is also fair to say that the CZ board dedicates more ink time to socialist agenda items, delegate elections. After all, delegates are restricted to a one-year term and they only vote for potential board members and vote to recall the board if necessary.

The problem is that the use of district delegates is no where near emblematic of a representative local government – delegates do not have to disclose how they vote, and they certainly do not have to vote the will of the residents in their district. More a symbol of total lack of accountability. Take for instance the results of the most recent elections to consider direct popular elections:

70% of CZ members who voted support Direct Popular Elections, and

69% of Delegates who voted support Direct Popular Elections and

Allegedly, the majority on the Board supports Direct Popular Elections, so

what happened? Direct Popular Elections amendment failed!

It has been our position that as long as CZ continues to support an arcane system designed to keep a vested majority in total control of the association affairs, district delegate elections are more important that voting for CZ board of directors, for obvious reasons.

Hence we suggest that CZ residents vote only for those delegates absolutely, positively committed to Direct Popular Elections and delegates willing to stand up in public and in private and voice their position. If you do not have enough information, feel free to send us a note at buzz@cotobuzz.com

No Apathy in Coto de Caza - Right?

Who said CZ Masters Association (Coto de Caza) residents are apathetic? As of last count only 6 out of 46 CZ districts representing some 10% of the voting units, do not have delegates. These districts include The Legacy/Enclave/Stonefield Estates, Andalusia, Oak Ridge, Glen Eagles and Stonefield Private Collection/San Marino

Whereas five districts, representing some 13% of the voting units not only have a district delegate, but also have an alternate – these are: Coto Country Homes, Los Verdes, Hillsboro, Fairway Estates, Greystone Villas, Rosewood

What is the function of a CZ District Delegate? Only to elect a board of directors and to recall a board of directors. View a CZ District Delegate as a Democratic Super Delegate: Delegates can vote any way they wish, in secret, with absolutely not accountability!

We know of a number of absentee titleholders who are interested in voting, but so far have received little to no information on what the process is.

We continue to maintain that in order to combat CZ resident apathy is to obliterate the district delegate system, which provides a small minority, the opportunity to manipulate, legally and otherwise, any election, yielding a community exposed to the whims of that minority – who want to turn Coto into a city and continue socialist agendas, for example. Better yet, consider the results of the recent election (poorly) designed by the CZ board, allegedly to bring direct popular election:

Allegedly, the majority on the Board supports Direct Popular Elections, yet, what happened? Direct Popular Elections amendment failed!

We strongly suggest that if you want to bring direct popular elections to the CZ master association, that you contact your neighbors and ask them to volunteer for district delegate, particularly in those districts without representation, and even those without an alternate – of course, it is better these potential candidates support direct popular elections: Remember, voting for a district delegate at the moment, may seal the fate of direct popular elections, at least for the next elections cycle. The Reason: Because delegates are not accountable to anyone!

Your point is well taken. In any democracy in the world, this ballot initiative passed overwhelmingly. But in Coto because of the rules put in place by the developer to disenfranchise our Members, this amendment failed. The CZ Board needs to listen to the will of people and make this happen through whatever extraordinary means necessary. The very idea that 69% - 70% of the people can agree on anything is pretty amazing in and of itself. The Board cannot allow Bob Varo , who has already caused litigation that cost the Association a lot of money, to control the agenda in Coto. JM



Let’s not forget that the CZ Board-friendly media reported, err…paraphrased the election as “above board”.- Buzz



The story that I saw from Mark Eades (OCR) is really incorrect. He did not get it right. What he should have said is that in spite of overwhelming support for Direct Popular Elections in Coto, the developer installed governing documents, which were intentionally designed to disenfranchise CZ Homeowner/Members prevented the passage of the initiative. He should have gone on to report that 70% of homeowners who voted were in favor of the amendment and that 69% of Delegates present also voted to support the Amendment. Those are the facts. It is disappointing when the press does not get the story straight. And, there is former CZ Board Member namely ME pushing for a DO OVER in May during regular elections under threat of litigation to finally bring Direct Popular Elections to Coto. This too should be part of the story. JM

The CZ Board absolutely should implement a Do Over for the direct popular election amendment during the next regular Board election cycle in May to avoid a costly court case that CZ will lose because they will be defending the indefensible. Think of it. The bulldog litigator that I will hire will be arguing that CZ is a quasi-city and that our Board is really more like a city council. Once that is established, we will demonstrate all the ways that our Delegate system is corrupt. I can even testify as to how I manipulated the process when I ran for the Board. We will speak to proper checks and balances. And, finally, we will argue that all we are asking for is the same voting rights that exist outside our gates demonstrating that our governing documents were designed by the developer specifically to disenfranchise our Members. This case will be a piece of cake.

CZ’s attorney, perhaps Harkins; but I doubt it since he is not a litigator will be arguing to support the same corrupt system that exists in Communist China, Vietnam and Cuba that disenfranchises our members and has been used by one group or another for years to manipulate our Board elections. We will subpoena all former Board Members to discuss how they were elected and all the documents that go with past elections. I just don’t see how it is possible to defend the indefensible when we are fighting in Iraq and Afghanistan to bring them voting rights that we don’t have in Coto. What could the argument possibly be for preventing direct popular elections in CZ?

What California liberal judge (all of them) is going to rule against democracy? CZ will lose after spending a lot of money on legal fees. Of course, we will demand that my legal fees be covered as well. If we can get away with it, we will even ask for punitive damages because my rights have been intentionally violated for years. Who knows, this could turn into a multi million dollar contingency case; after all this is California . So, the Board needs to implement a Do Over to avoid these legal fees. This amendment was overwhelmingly approved by any standard. The CZ Board needs to listen to the will of the people not Bob Varo who should be recalled from office. The argument not only has merit, but it should be done using the Harkins' proposed "amendment that provided for true direct elections without any Delegate involvement" , and without payola to loyalist - that is, extend delegate terms for instance.

There should also be an explanation from the board as to why such proposal was rejected in the first place.

I absolutely agree. The DO OVER in May should just involve the Direct Popular Election Amendment written in plain language not to confuse the issue. If it passes, the Delegate term will become irrelevant anyway. The Home Office Amendment is a waste of time and will only lead to litigation. We should leave well enough alone on that issue and just use “Don’t ask, Don’t tell related to home offices. JM

Forbidden Broadway at Saddleback College

Special Victims Unit Gala Fundraiser- silent auction, opportunity drawings, and live music.

March 12, 2008

The side-splitting savagery known as Forbidden Broadway, written and directed by Gerard Alessandrini, is on the road again and making a stop at the McKinney Theatre, Saddleback College, on April 27 at 3:00 p.m. with pre-show activities at 2:30 p.m.

Now celebrating its record-breaking 25th year in New York, this year’s Special Victims Unit include the puppets of “Avenue Q”, the witches of “Wicked”, “Billy Joel’s Movin Out”, and new looks at old favorites “La Cage aux Folles”, “Little Shop of Horrors”, “Les Miz”, “Beauty and the Beast”, and “Chicago”. Rounding out the laughs are Mel Brooks’ “The Producers”, Abba’s “Mamma Mia” and “Thoroughly Modern Millie”; with lots more Broadway past and present.

Forbidden Broadway is the recipient of an Obie award, the Outer Critics Circle Award, and the 2005 Drama Desk Award for Best Off Broadway Musical.
An evening of surprises and hilarious antics is promised to theatre lovers of all ages. Also included will be a silent auction, opportunity drawings, and live music.

Tickets are $50 and will benefit scholarships for talented performing and visual arts students as well as funding master classes with professional artists and unique art gallery offerings.

Saddleback College is located at 28000 Marguerite Pkwy in Mission Viejo , just east of Interstate 5 at the Avery Parkway exit. Parking is available in Lot 12. Take Avery Parkway to Marguerite Parkway turn left to the third traffic light, which is Saddleback’s Marguerite entrance. Turn right into the campus and take the second left to “ Theatre Circle ,” turning right into Lot 12.

OC Sheriff personnel not criminally liable in death of Chamberlain- OCDA

If we could have proven that any member of the Sheriff's Department, was criminally responsible for the death of Mr. Chamberlain, there is no question that indictments would have been issued

OCDA Tony Rackauckas announced today the conclusion of the criminal portion of a grand jury investigation into the beating murder of inmate, John Chamberlain and the indictment against three former inmates. Nine former inmates, in total now, face murder charges, with no other criminal indictments expected at this time based on the investigation. Their trial is currently scheduled to begin on June 13.

According to Rackauckas, the investigation was looking into whether there was a failure of duty or malfeasance by any Sheriff's jail personnel; whether any Sheriff personnel aided and abetted the murder of Chamberlain or was criminally liable in his death; whether there was a violation of existing investigative protocol; identify other inmate assailants; and any other facts involving the investigation into the Chamberlain matter.

During the nine months of service by the Special Grand Jury, 79 witnesses were called including 42 Sheriff's personnel and five retired Sheriff's officials, including former Sheriffs Michael Carona and Brad Gates.



Responding to critics “.. that based on the press accounts and rumors about the failure of Sheriff's personnel to perform their duties, the grand jury should have issued indictments against them”, Rackauckas, notes that, “..in order to charge anyone with a crime, we must prove beyond a reasonable doubt all of the elements of the offense.” And proceeds to cite California Penal Code section 192(b) to support his argument, concluding that “If we could have proven a case that any member of the Sheriff's Department, from the lowest ranking to the top of the Department, was criminally responsible for the death of Mr. Chamberlain, there is no question that indictments would have been issued”, according to the DA.



Mr. Rackauckas then indicates that because “.. of the voluminous nature of the proceedings, the transcripts will not likely be available for public examination until approximately eight weeks from now” and promises that “as soon as I am legally able to reveal the facts presented to the Special Criminal Grand Jury, I look forward to submitting a detailed report to the Board of Supervisors and the public”. The Rackauckas adds “I want this report to facilitate a public dialog about how in-custody deaths should be investigated in Orange County. We are going to discuss what penal reforms should take place in Orange County and clean up our act”

Dave Archibald, a former CZ board member was buzzed off the Coto Discussion Forum as of March 1, 2008. He becomes only the second forum participant to be banned since its inception.

The first person expelled from the forum, also a former CZ board member, was booted for his attempt at censoring the content posted in the forum.

The Coto Discussion Forum is open to all Coto de Caza Residents, regardless of political affiliation, personal or professional agendas and is for the most part self-managed and self-regulated. As such, participants are encouraged to minimize their ad hominem attacks, and instead attack the status quo.

In Archibald’s case, he was Buzzed twice, prior to him being banned from the forum.

Given that online is a media-poor environment and considering that Archibald may be simply misinterpreting the content or even a case of self-bounded rationality he was asked to debate the issue face-to-face. He declined.

United Director Sentenced to First Offender Alcohol Program

Laguna Woods Village - A United Director member and allegedly a vocal supporter of the management company was sentenced to three years probation, $250 fines, 3 months First Offender Alcohol Program and restitution, according to records filed with the Superior Court of California, County of Orange Central Justice Center, case 06HM03641. A plea of not guilty was recorded 06/01/2006. Subsequently sentence was imposed 06/15/2006 while restitution was recorded 07/03/2007. The support for the property management company is relevant given the removal of previous United President removed because allegedly “he accidentally sent confidential information to a non-director” - the property management company has consistently refused to comment for any of our stories.


The sentence is a result of three counts of violations to the California Vehicle Code 23152(a/b) Driving under the influence of alcohol/drugs and reckless driving 23103(a) filed 11/18/2005 with the County of Orange Central Justice Center

Chauncey Bailey, editor of the Oakland Post was gunned down as he walked to work in August of last year. Law enforcement agents believe he was murdered because of his investigation into a business called Your Black Muslim Bakery.

In 1976 Don Bolles, founding member of the Investigative Reporters and Editors (IRE), was murdered by a car bomb in part because of his investigation into public corruption. Bolles murder led to the formation of the Arizona Project. Bob Greene, the Newsday investigative editor, calls the Arizona Project an insurance policy: No journalist’ work could be stopped by a bullet or a bomb.

Although murdered, Bailey was not stopped. The Chauncey Bailey Project is a clearinghouse for information and home for more than two dozen editors, reporters, students and news organizations, designed to pick up where Bailey left off on the investigation of Your Black Muslim Bakery. IRE member Mary Fricker states “Our goal is to send this message far and wide. You can’t kill a story by killing a journalist”.

At a local level, there have been various attempts at silencing the CotoBuzz Journal, including the use of legal resources by the CZ association’s board of directors. Such acts have led us to the creation of the LOPE – List of Prominent Enemies.

However, no opinion or story has generated more anti-Buzz sentiment as our efforts to put the spotlight on CZ subsidies. As Fricker might say, . You can’t hide the subsidies by silencing the CotoBuzz Journal.

FISA Fizzled, Osama, Obama Delighted

On February 17, 2008, the US intelligence community lost critical tools that allowed them to monitor terrorist communications because the House Leadership chose not to extend authorization for the Terrorist Surveillance Program (TSP). The focus of the program is to provide the intelligence community with the tools it needs to protect the United States and its citizens, while also protecting the civil liberties of those impacted by such collection.

FISA was originally passed in 1978 (50 U.S.C. §§ 1801) and the Protect America Act (P.L. 110-55) became law on August 5, 2007, which addressed the changes in technology that have taken place over the past 30 years. The Majority Party has refused repeatedly to consider the Senate’s bipartisan bill in the House, which would update and extend the authorization of the Foreign Intelligence Surveillance Act (FISA). The Senate passed the revised FISA bill on February 12, 2008, by a 68-29 vote.

The Director of National Intelligence, Mike McConnell wrote in an opinion editorial in the Washington Post:

“Expiration would lead to the loss of important tools our workforce relies on to discover the locations, intentions and capabilities of terrorists and other foreign intelligence targets abroad. Some critical operations, including our ability to adjust to dynamic terrorist threats that exploit new methods of communication, which sometimes requires assistance from private parties, would probably become impossible. And the difficulties we face in obtaining this essential help from private parties would worsen significantly if the act expires or is merely extended without addressing this issue. Without long-term legislation that includes liability protection, we will be delayed in gathering -- or may simply miss -- intelligence needed to protect the nation. (Mike McConnell, Op-Ed, "A Key Gap In Fighting Terrorism," The Washington Post, 2/15/08)



Is there any doubt that Obamaists are aware that our intelligence capabilities are limited during this time and are more than eager to take advantage of this lapse?

Congressman Ken Calvert and others, in an effort to move this issue forward to the floor, have signed onto H.R. 5440, known as the FISA Amendments Act. H.R. 5440 is the same language as the bi-partisan Senate passed bill.

Consider if immunity is necessary to protect the telecommunications companies that cooperated with the government’s request for surveillance assistance in order to ensure the companies are able to cooperate in the future. The Supreme Court recently rejected a challenge to the National Security Agency’s warrantless surveillance program in the case of Civil Liberties Union v. National Security Agency. A three-judge panel of the U.S. Court of Appeals for the 6th Circuit ruled 2-1 in July that the plaintiffs, led by the ACLU, lacked standing to bring the case.

Consider that if the cooperation of such providers is critical to the government's capacity to pursue electronic surveillance to gather foreign intelligence information, and is also essential for collection of communications records for pattern analysis. If the telecommunication providers who responded to the government's requests or demands for assistance did so in good faith, upon assertions by the government that the demand was lawful and that a court order was not required, would you then conclude the providers should be given relief regarding pending law suits?

Many people are rightly concerned about the privacy issues and the ability of the government to monitor U.S. citizen conversations – this issues is about having the right tools to track terrorists overseas who may be seeking to harm the US

If you agree that FISA should not fizzle, write your House and Senate representative.

Michael Amzie Holley’s Roofing Slippery Slope and arraignment

Michael Amzie Holley’s, a roofing contractor and business owner will be arraigned tomorrow on charges of failing to provide Workers' Compensation Insurance for an employee who fell from a roof and failing to pay the insurance company more than $700,000 in premiums.
Holley is charged with two counts of perjury by declaration, two counts of recording false and forged instruments, one count of misrepresenting facts to the State Compensation Insurance Fund (SCIF), seven counts of making a fraudulent statement, one count of presenting a fraudulent material statement to obtain compensation, one count of making a false statement to discourage an injured worker from claiming benefits, one count of willfully failing to pay taxes, and one count of failing to file a return with the intent to evade taxes.

Holley also faces sentencing enhancements for aggravated white collar crime over $500,000 and property damage over $150,000. If convicted, he faces a maximum sentence of 19 years and four months in prison. Holley is being held on $2 million bail and is scheduled to be arraigned tomorrow Wednesday, February 27, 2008 at 9:00 a.m. in Department C-55, Central Justice Center, Santa Ana.

Holley is accused of purchasing a minimum workers' compensation policy from SCIF and failing to state that he employed subcontractors, paid workers in cash, hired unlicensed employees, and leased employees from other companies. Holley is accused of paying his employees approximately $815,000 in cash to hide the fact that So Cal Roofing had workers.

Holley is accused of receiving the insurance based on his false declaration, and entering into a contract requiring SCIF to cover all workers employed by Holley, even those employees unknown to the insurance company. Holley is accused of submitting inaccurate payroll reports to SCIF, resulting in a $703,000 underpayment of insurance premiums. To hide the fraud, Holley is accused of failing to file a tax return to avoid paying $188,000 in taxes to the State.

White supremacist convicted of hate crime at Irvine Spectrum

Ryan Lawrence Monfils, 20, a self-proclaimed white supremacist was convicted today of a hate crime for the unprovoked attack of an African-American security guard outside of Dave & Buster's at the Irvine Spectrum. Stanton, pleaded guilty to one felony count of a hate crime battery. He was sentenced to six months in jail, three years of formal probation, and is banned from the Irvine Spectrum.

At approximately 5:30 p.m. on February 2, 2008, Monfils was leaving Dave & Buster's at the Irvine Spectrum with two friends. As he left, the defendant saw the victim, an African-American security guard, standing outside in uniform. Monfils began yelling racial slurs at the victim, threw a lit cigarette in his face, and attacked him by punching the victim repeatedly. Two Irvine Police Department officers on foot patrol arrived at the scene, and Monfils made racial slurs to one of the two police officers, who is African-American.

An Argument Against Democracy – The 2008 US Oprahfied Presidential Elections

According to the Canada Business Center (2003) research suggests that “as much as 93% of a person’s total perception is the result of images conveyed to the brain in one way or another”

It has been said that most of us think we think, but in reality, there are very few people who actually do so. Reasons given are time constraints and the fact that in general our responsibilities increase at an average of 10%/year and lacking a stimulating environment.

Myrna Blyth, long-time editor of Ladies Home Journal and founding editor of More, is author of Spin Sisters: Katie Couric, Oprah, Barbara Walters and others. She charges that these spin sisters are selling misery, feelings of inadequacy and a liberal agenda to women in America. The end result is that a large population cannot think on their own and blindly follow the spin sister's advice.

Consider that in the 2008 Oprahfied Elections, it is plausible that Oprah’s candidate can become the president of the United States - For all we know, Barack Obama could make the best president of the United States ever – we just have not seen any evidence to date, there is any content in his character.

Blyth’s assertions are self-evident in this presidential election – a good number of people in the US cannot think independently and blindly follow recommendations of people such as the spins sister. If this is how democracy works in the 21st Century, perhaps democracy is not your grandpa’s democracy.

We have offered the seven identified OC Sheriff candidates; Jack Anderson, Bill Hunt, Craig Hunter, Kevin Keyes, Ralph Martin, Ken Maddox and Paul Walters, the CotoBuzz Journal as a platform to communicate with their respective potential supports. We have also posed to them a number of questions – we shall be publishing their responses in the order we receive them.

Following is a virtual chat with candidate Kevin Keyes


CBJ: Do you agree that the OCSD needs a corporate culture extreme makeover?

K. Keyes: Yes, while there are many good people, the good must weed out the bad and we would implement an accountability program. Mediocrity is not acceptable, accountability is.
CBJ: What are your top ten priorities for the OCSD if selected?

K. Keyes: Well, there is actually another election soon after the appointment so I will give you an initial list and see how we do.

The first and most important is to restore honor to the office that was taken by its last office holder.

Second is to restore the trust of the taxpayers.

My executive team would immediately begin a financial accounting audit. All vendor contracts, contractors, suppliers would be required to re-bid all jobs and services supplied to the department. All monies will be noted on where the funds come from and where it all goes made available to the taxpayers. The new round of competition should provide for significant cost savings. This would include retirement and benefit packages. All costs itemized and all expensed noted. No more “MISC” columns.

I would change the CCW policy to a “shall” issue approach. The 2nd amendment gives Americans that right, not the sheriff’s office. There are many laws for who can and cannot carry a weapon but the interest must be to assist those asking not make it more difficult or reserve ccw’s for only those politically connected.

Work with union to change union work rules on sheriff rotations on jail service and work with jail division to reduce costs.

Begin complete implementation of existing computer networks so officers in the field have access to data.

Review sheriff threat and review need for protection unit. A review of all staffing requirements in tandem.

Meeting with federal counterparts and implement screening for illegal aliens in custody and arrange for turnover to feds for deportation.

Meet with all department leaders, develop a five-year plan on all equipment replacements for future budgeting, cost analysis, cost reductions.

Then, I’ll have to get re-elected.

CBJ: What/who is your biggest obstacle to getting the post?

K. Keyes: While I have been in the professional business community for 27 years, I am not a public figure. I am also not a career sheriff. I am a citizen of our community that believes I can do the job and am interested in fixing the problems.

CBJ : What do you see as the main problems with the Orange County Board of Supervisors

K. Keyes: I have not met with them yet to determine their course of action so I cannot determine that yet.

CBJ : What do you see as the main problems with the Orange County DA?

K. Keyes: Their lawyers.

Seriously, I read your website and saw you use satire so I thought I’d throw it in.

I would like to have a new attorney for the office and they would meet with the DA, review all existing known problems and a plan to correct within 30 days.

The sheriff’s department is huge, it will be difficult to implement major changes but the longest journey starts with the first steps. I believe by example I can earn the trust and respect of the officers and restore the pride of being an OCSD member a badge they can wear with pride.
