Coto de Caza, CA - Wasted lives and wasted laws. Sounds like a Freddie Fender country song, but sadly, that captures Coto de Caza’s CZ Master Association’s leadership's approach to public safety that led to the first traffic fatality in the community, followed by one more three months later, the third one in January 2014, and multiple near misses in the last few weeks:
Here is an overview of the anti-law culture promoted by the local governance:
One of the first acts of the current HOA board of directors was to recklessly fired the CHP, the only law enforcement agency at the time, authorized to do traffic patrols in unincorporated areas of Orange County. Public outcry forced the HOA to rehire the CHP shortly after the first fatality in the community.
As a law suit mitigation strategy, the HOA is supposed to provide 520 traffic patrol hors per quarter. The only way the CHP is able to provide manpower is by using over time. In an open board meeting, the HOA board's president Robert Varo, calls the CHP captain an extortionist.
After the board is forced to re-hire the CHP to patrol Coto de Caza, it is not able to, because Keystone Pacific employees fail to file for re-certification making the streets not patrol worthy.
Three months after the first traffic fatality, Mr. Morteza Manian is killed while driving his bicycle.
By the second quarter of 2007, CHP patrol hours dropped some 60% from 2006 levels, mostly, because resources have been allocated by CHP management to other communities, as a result of “public spectacles, as Robert Varo despectively referred to actions by Ladera Ranch residents, trying to get additional law enforcement in their community
The Sheriff is coming, the Sheriff is Coming.
The severe CHP manpower shortage is welcomed by the HOA, as it has not been fond of law enforcement as evidenced by the extortionists and public spectacle comments, so the board jumps on the Senate Bill SB-298 bandwagon, promising residents that soon the Sheriff will do the traffic patrol.
SB-298 states in part: The Board of Supervisors of the County of Orange or the city council of a city within that county may, as part of a pilot project, contract to provide supplemental law enforcement services to homeowners associations, as defined in Section 4080 of the Civil Code, on an occasional or ongoing basis to enforce the Vehicle Code on a homeowners associations privately owned and maintained road, as provided by Section 21107.7 of the Vehicle Code.
SB-298 is finally signed into law by Governor Brown in 2013. while the accident rate continues to increase and the CHP patrol hours decrease. Predictably, the third traffic fatality happens when a young man traveling southbound on Vista del Verde approaching Cherry Hills Drive at a high rate of speed strikes a curve north of Cherry Hills Dr. coming to rest on a concrete wall at the residence of 37 Cherry Hills Dr.
The Sheriff is fired, the Sheriff is fired
Since the last fatality, there have been several near-misses, but even with SB-298 in place, the board has refused to hire the Sheriff for supplemental law enforcement and meet its obligation to provide 530 hours of traffic patrol. In fact, it fired the Sheriff. in 2025, the board met with a OCSD representative to tell him it was not interested in contracting the OCSD under SB-298: wasted effort, wasted days, wasted legislation. All the while board member Phil Mitchell not only claims he is unable to verify the public safety statistics we publish on a quarterly basis, but that there is nothing wrong with golf crossing signs encouraging lazy, stupid golfers to cross the most dangerous curve in Coto the Caza, right after several near misses, knowing full well that the board has refused to even meet with the OCSD South Post command.
The SJC CHP Office Undermanned - The Fonseca Effect
Unfortunately, since the last fatality, the CHP, under Captain Jim Fonseca, seem to be unable to provide the necessary 520 hours traffic patrol but also seems to be going through a high turnover rate (three public information officers) and unable to process routine FOIA requests.

businesses at the tune of $3.0 million per year. If you patronize a
business within the gates, you get a free pass, no questions asked. On
the other hand, if you are a dues- paying CZ Master Association member and you
are using a service vehicle, are hitching a ride, or just bought a new car,
before you are allowed inside the Coto de Caza gates, you must provide the
attendant not only you address, but also you password. At that point, the
attendant, a person you do not know, has access to all your most private
information.

first traffic fatality in Coto de Caza in the last ten years. Sadly, this week
also marks the Three Month Anniversary of Mr. Morteza Manian’s death, as he was
struck by a teen age female, while he was riding his bicycle southbound on
Lexington Way approaching the intersection of North Hampton Place. Mr. Manian
was transported to Mission Regional Hospital, and succumbed to his injuries in
the late hours of 3/12/2006. The teen driver was eventually arrested and
charged with vehicular manslaughter, felony hit and run and resisting and
delaying or obstructing an office

at the Sports Park to support Keystone staff members rather than have them in
rented space outside Coto. This is not a smart decision for a variety of
reasons. First, where is the money coming from to build this space? It is
certainly not free. So rather than pay rent through a Keystone billing, we will
have one more asset on our books to support one way or another. Second, even if
it does make sense, office space for our property management company should be
outside our gates at the Welcome Home Center at the Oso Gate since many who
need to see Keystone are not Members of our Association. Assuming the current
incompetent CZ Board could get control of the Welcome Home Center property
which is essential and if the Welcome Home Center could be tented and freed of
termites which is a problem, the structure there would be perfect for a
Management office. So before building anything at the Sports Park all efforts
should be focused on acquiring the Welcome Home Center one way or another; not
building offices at the Sports Park.

Despite the public abuse the CHP has received from the Coto de Caza board of
directors ever since the board was coerced into bringing the CHP back for
pro-active traffic patrol, figures indicate that the CHP is doing its job:
Trend for accident rate is down and close to pre-firing levels. Just as
important, the number of Coto residents arrested for DUI is down. See chart
below for actual accident rate.
The unincorporated, gated community, facing a rising crash
rate, seeks an enforcement strategy that residents are willing to live with.
The recent crash that killed a speeding teenager in a gated
south Orange County enclave left behind skid marks and a devastated family and
has rekindled debate about traffic control that mirrors concerns in private
communities throughout the state.

died instantly Friday night when he lost control of his Mazda3 Hatchback and
crashed into the side of a Coto De Caza home. California Highway Patrol
authorities say that Franz was driving at a high speed on Vista Del Verde, a
main road in the community, when his car struck a curb and became airborne,
launching 50 feet in the air before hitting a tree and landing on the wall of a
home on Cherry Hills Drive. The car scraped the building, but did not injure
the residents - a mother and a daughter, who were inside watching TV at the
time of the crash.

Coto de Caza, CA –By its own words and actions, it is fair to argue that Coto de Caza’s local governance is not only apathetic when it comes to public safety, but its own actions actually result increase the risk to residents. Worse, seems like adults in Coto de Caza have similar views as the local governance.
Our research over close to ten years indicate that whether a community is safe or not, is primarily a function of residents and local governance, not law enforcement. Consider that when a city in Orange County is deemed the safest city, what about the other 11 cities or the unincorporated areas? What about Coto de Caza with the highest crime rate in history in early 2010. After all, only common denominator is that the OCSD is the law enforcement agency. What does the OCSD do differently in the safest city, as opposed to the least safe city under its watch?

Coto de Caza, CA - While the Coto de Caza's total population has been shrinking for the last ten years, including placement of 17 property liens for the month of January 2011 out of roughly 3500 homes, the policies pursued by the CZ Master association board of directors, the local governance, have consistently increased traffic with a reduction in CHP patrol hours, with predictable results. Consider that for close to a decade, we have consistently shown conclusive evidence that there is a direct correlation between the extent of the CHP traffic enforcement efforts and the number of traffic accidents in the community.
