John Sellers' HOA Fight in Arizona

As John Sellers continues the good HOA fight in Arizona, judge Kowal has ruled in his favor on a request to inspect records against The Crossing at Willow Creek HOA.  He has also compiled a database - see below

See below for an Arizona HOA contact data base at the moment. All in it represents public records. Certain lists have been excluded where not fully public

And he states:

In feedback, there are some Management Companies with whom people are not exactly enamored.

One such company, which I coincidentally happen to know extremely well, is HOAMCO - http://www.hoamco.com

They cost my Association in Prescott where I used to live, 18 months of assessments in legal fees in 2007 from Ekmark & Ekmark and came very close to rendering it insolvent. All over a copy of a violation notice we requested as Association records, and sent to the HOA President over her childrens illegal ATV use on subdivision vacant lots. The OAH ordered it to be given up and they wanted us to take us to the US Supreme Court over an “invasion of privacy”. The case is on the blog and also attached. What you see in the tip of a very big iceberg.

Interestingly, Hoamco advertise their skills at “working behind the scenes” on their web site - “HOAMCO has been in the community management profession 25 years, working behind the scenes to help associations like yours create ideal environments for people to raise families and live happily.

George Orwell would love that.

Any feedback, either via the blog, or by return email not for publication, would be appreciated

Marolt: Fear and loathing of homeowners' associations

I still hate homeowners’ associations. A few years back I was stirred up because an association board member was driving around Snowmass Village taking pictures of newspapers left in people’s driveways after 11 in the morning, which is apparently against a covenant or two, and then publishing them on the Internet to embarrass the culprits.
